FROM: Sonya Wafters, Associate City Planner SUBJECT: Moxie Java -CZC-12-074; DES-12-045 OWNER: David Holman, Holman Pietras, LLC r DESCRIPTION OF APPLICANT'S REQUEST E IDIAN.~- 1l~Alfl The applicant, Northwest Technologies, Inc., requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval of a 2,027 square foot (s.£) coffee shop with an outdoor patio for Moxie Java. The applicant proposes adrive-thru with two service windows and fagade improvements to the existing building. The coffee shop is classified as a restaurant use and is a principal permitted use in the C-G zoning district. A drive thru establishment is allowed as an accessory use when it is not within 300 feet of another drive- thru facility, residence, or residential district, which this site is not. A Certificate of Zoning Compliance Verification (CZCV-12-026) was recently approved for a change in use of this tenant space from retail to restaurant. The site is located at 1560 N. Locust Grove Road, in the NW 1/4 of Section 8, T.3N., R1E . DECISION The applicant's request for CZC is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to veri, fy if you need a building permit and/or inspection. If you do need a building permit, you must complete that process before you commence the use or construction. As part of the application submittal, you will need to provide one set of the final, stamped "approved" Planning Department plans, stamped and signed by the architect and/or civil engineer as applicable. You must provide these plans in PDF format and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your building submittal set. Please contact Building Services for additional details about building permits and inspections. Site Specific Conditions of Approval 1. Place a sign warning Moue Java customers not to block the driveway within the planter island at the entrance of the site. 2. The site design is approved contingent upon Republic Services approval of the existing trash enclosure location in relation to the proposed drive-thru. The applicant shall coordinate with Bob Olson at Republic Services to ensure the trash enclosure meets their requirements. If changes to the site are required, the applicant shall submit a revised site plan to the Planning Department for approval. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. A surety agreement may be accepted for other improvements in accord with UDC 11-SC-3C. 3. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-3B-14A. 4. ,The site plan prepared by Northwest Architecture on 10/18/12, labeled Sheet A-1.1, is approved (stamped "approved" on 11/1/12 by the City of Meridian Planning Department) with no changes. 5. The landscape plan prepared by Breckon Design on 10/24/12, labeled Sheet L1.1, is approved (stamped "approved" on 11/1/12 by the City of Meridian Planning Department) with no changes. 6. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Department. 7. The elevations prepared by Northwest Architecture on 10/18/12, labeled Sheet A-6.0, are approved (stamped "approved" on 11/1/12 by the City of Meridian Planning Department) with no changes. 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 10. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (CZCV-12-026). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3. 7. The applicant shall comply with the specific use standards for drive-through establishments listed in UDC 11-4-3-11. Conditions Document 2 Moxie Java CZC-12-074; DES-12-045 CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before [date], within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Locust Grove Road Certificate of Zoning Compliance Verification -Application Checklist To Whom It May Concern: The property located at 1560 N. Locust Grove, Meridian, Idaho was purchased this past summer by Holman Pietras LLC. The property was formerly a 7,500 SF Hollywood Video Rental Store with adrive-thru drop-off station. When the property was purchased, the north 3,100 SF of the property had been leased to a yogurt business. The yogurt area's tenant improvements were complete and the business was already in operation. The building was purchased for the purpose of opening a Moxie Java Coffee shop with adrive- thru in the south 2,000 SF of the building. The remaining center portion of the building will be leased to a separate tenant who has not been identified at this time. The building does not present an attractive curb appearance so upgrades to the building are planned to include a porch on the west side and an additional drive-thru access on the south side. The rundown landscaping would be refreshed, the parking lot and drive-thru seal coated and re- striped, and broken curbs replaced. The majority owner of the building, David Holman, is also the majority owner of the proposed Moxie Java which is doing business as Trinity Creek Investments Inc. There is no left turn for south bound traffic on Locust Grove to access the drivelane. 3. Time of high traffic for the proposed Moxie is early AM, and the existing Yogurtz shop opens 11.30am and has high traffic in the evenings when the coffee business is light.
