The subject, 76.24 acres was a portion of the entire NW '/4 of Section 9, Township 3N, Range 1 E that was annexed under one application in 1984. The entire '/4 section was annexed at that time with the I-L zone. When Capital Development submitted and received approval for the preliminary plat of Crossroads in 1992, a rezone application was not submitted nor requested by the City at that time. Similarly, when each of the seven phases came through with fmal plats, the zoning remained in place and continues to this day under the original zone. This rezone application is desirable at this time to correct this oversight. 10. Planning & Zoning staff initiated this zoning amendment and feel it is a necessary and desirable change for two reasons: (a) to update the official zoning map of the City to reflect the actual, built-out use of the land and, (b) to reduce the number of potential conflicts with the Schedule of Use Control for Crossroads residents applying for home occupations (home occupations are not permitted in the I-L zone but are permitted in the R-4 zone). To date, Planning & Zoning has allowed Day Cares and Home Occupations for Crossroads residents, but only as Conditional Uses, which is more expensive and time consuming than the Accessory Use Permit process. This rezone will also allow the City to legally use the R-4 zoning and building standards when determining buffer widths for the future development of the I-L parcel abutting the south boundary of Crossroads and when enforcing other city codes. The adjacent property uses/developments are: North -Family Center commercial development (ShopKo, Office Depot, Sportsman's Warehouse, other future retail pads); I-L zone South -Future extension of Pine Street; vacant I-L parcel East - Westdale Park Subdivision No. 2 (R-8); Seventh-day Adventist Church in an Ada County RT zone, proposed WalMart West -Family Center commercial development (undeveloped, Phase 2), I-L zone 11. This proposed zoning amendment falls within the scope and policies of the City's Comprehensive Plan. The Generalized Land Use Map (dated December 21, 1993) designates the subject property as Existing Urban. Posting Of Hearing Notice On Property: One week prior to the hearing set pursuant to subsection B2 of this Section, the applicant shall post a copy of said notice of hearing of the application on the property under consideration; and after the property has been posted ,- the applicant shall deliver to the Zoning Administrator a notarized statement that he has posted the property and the date the posting was placed. B. Requirements Of Commission: 1. Notify Property Owners: a. Time Of Giving Notice: The Commission shall give notice of the hearing, at least fifteen (15) days prior to the hearing, by certified mail to property owners within the land being considered and to owners within three hundred feet (300') of the external boundaries of the land being considered and any additional area that may be impacted by said application as determined by the Zoning Administrator. b. Contents Of Notice: Said notice, by certified mail, must be deposited with the United States Post Office at least fifteen (15) days prior to the hearing and said notice shall contain a vicinity map of the property, a brief statement of the nature of the application, the name and address of the applicant. ~.5 c. Publication Of Notice: When notice is required to two hundred ~ 3 (200) or more property owners or residents, in lieu of the mail .~~v notification, notice of the proceeding and hearing required hereby may be given by publishing the notice for two (2) consecutive weeks in the official newspaper of the City; provided; that, the second notice appears ten (10) days prior to the public hearing. 2. Hearing Notice And Application Summary Publication: Prior to recommending an application, the Commission shall conduct at least one public hearing in which interested persons shall have an opportunity to be heard. At least fifteen (15) days prior to the hearing, notice of the time and place and a summary of the application to be discussed shall be published in the official newspaper or paper of general circulation within the City. 3. Submit Recommendations To Council: Within forty five (45) days from the hearing, the Commission shall transmit its recommendation to the Council with supportive reasons. CONCLUSIONS OF LAW The Council may take judicial notice of government ordinances, and policies, and of actual conditions existing within the City and State. 2. The City of Meridian has exercised its authority and responsibility as provided by "Local Land Use Planning Act of 1975", codified at Chapter 65, Title 67, Idaho Code by the adoption of Comprehensive Plan City of Meridian adopted December 21, 1993, Ord. No. 629, January 4, 1994. 3. The following is found to be a pertinent provision of the City of Meridian Comprehensive Plan and is applicable to this Application: Land Use Chapter 3.1 The City of Meridian intends to plan for periodic review, monitoring and updating of land uses within the Area of Impact and the Urban Service Planning Area. 4. The requested zoning of Low Density Residential District, (R-4) is defined in the Zoning Ordinance at 11-7-2 C as follows: ~(R-4) Low Density Residential District: Only single-family dwellings shall be permitted and no conditional uses shall be permitted except for planned residential development and public schools. Idaho Code § 67-6511 provides and requires that the City shall establish by ordinance one or more zones or zoning districts in accordance with the adopted Comprehensive Plan and the ordinance establishing zoning districts can be amended with particular consideration given to the effects of any proposed zone change upon the delivery of services by any political subdivision providing public services, including school districts, within the City's planning jurisdiction and that it is in conformance with the Comprehensive Plan. 6. Idaho Code § 67-6511A provides: Each governing board may, by ordinance adopted or amended in accordance with the notice and hearing provisions provided under section 67-6509, Idaho Code, require or permit as a condition of rezoning that an owner or developer make a written commitment concerning the use or development of the subject parcel. The governing board shall adopt ordinance provisions governing the creation, form, recording, modification, enforcement and termination of conditional commitments. 7. Where uncertainty exists with respect to the boundaries of any of the zoning districts as shown on the Official Zoning Map, the following shall apply: 8.1 Where district boundaries are indicated as approximately following the centerline of street lines, highway right-of-way lines, streams, lakes or other bodies of water, the centerline shall be construed to be such boundary; 8.2 Where district boundaries are so indicated that they approximately follow the lot lines, such lot lines shall be construed to be said boundaries; 8.3 Where district boundaries are so indicated that they are approximately parallel to the centerlines or street lines of streets, or the centerlines or right-of-way lines of highways, such district boundaries shall be construed as being parallel thereto and at such distance therefrom as indicated on the Official Zoning Map. Stiles: This application was initiated by staff due to the fact that the entire Crossroads Subdivision is currently zoned light industrial. It's caused us a lot of problems, it's caused appraisers a lot of problems. Every time an FHA loan or HUD loan comes up in that subdivision, they call and ask us what is wrong with Meridian to approve a subdivision in that zone. So Brad Hawkins-Clark initiated it, and we've got a legal description prepared. We've proposed an R-4 zone for the entire subdivision. There are some slight variations from the R-4 zone in that they were complying with an old R-4 zone when they developed this which allowed 70-foot frontages; however, they were still required to meet the 8,000 s.f. minimum lot size. They do have 10 percent open space within this development, and it's really just to clean up to take some workload off of us when the requests come in. Anderson: Mr. Mayor, I guess I have a legal question. Doesn't that require someone to request that you change the zoning and isn't there some notification stuff that has to go on? Stiles: We did do notifications. We did public hearings, we notified everybody within the subdivision when the parcels are less than the five acres, I don't think there are any restrictions on rezoning property at the request of the City. Nichols: Councilman Anderson, Mayor, members of the Council, the City can initiate a rezone. The City has the power to do that. As long as the other requirements are met with regard to notice and also with regard to the lots which may not meet the current subdivision requirements, they would be what's commonly called Grandfathered in as non-conforming uses with regard to those particular lots anyway. So there's no legal impediment to the rezone. Anderson: So all our legal notifications have been met with the property owners? As President of Crossroads Subdivision, I just want to say that most of (inaudible) there's no objection, and we're very happy to see this settled and be R-4. It gives us a better chance to enforce our covenants out there because a lot of people seeing that it has been industrial, I-L zone, they refuse to obey our covenants and so forth which are for R-4 zoning. The only thing that I have a question about: Are we including the common areas which some of those have been annexed to the Nampa Meridian Irrigation District. Down in the future, if they wanted to sell those common areas and so forth, we have some stipulations, but we can agree to do something with that property with the 260 homeowners who own it. If we wanted to turn it into something else so - are we saying that. the common areas are being zoned as R-4 as well as our housing areas? Right now they're all included with the R-4, I mean the I-L zoning. So that's one thing, and the other question I have is don't we have to have a residential access to that property? All our streets are commercial Meridian City Council Meeting May 16, 2000 Page 67 streets. That's the only access we have. We don't have a residential access. We used to have, but when the developer sold East Presidential Drive out to the developers, that was approved ACHD, and they turned that into a commercial street. We would not have a residential access. Harding Street could be a residential access off of Pine Street when Pine Street's developed, and if that's the case, then I would ask that one of the conditions would be in an R-4 zoning that we get a traffic signal light at Harding Street and Pine Street. That's the two questions I'm concerned with in this subdivision. Corrie: Do you want to tackle that one, Shari? Stiles: Sure. As far as the zoning, the entire subdivision would be zoned R-4. The condition of the plat was required of those common areas, so they can't be sold off and used as something else. They have to remain common area. As far as the streets, a condition of the Family Center was when they got to 450,000 s.f. of development around there that's when they'll be required to have that light in at Eagle and Pine; however, down here at Harding, it's unlikely that will be signalized. Unlikely. Well, at this time just due to - it wouldn't warrant a signal at this time. The first locations they usually try to go at the half-mile, but that's all determined through Ada County Highway District when they do traffic counts, and they have to actually warrant that as signal as needed. It wouldn't appear at this time that it would be needed there for quite some time. Maybe something would happen when this Van Auker piece to the south of you developed depending on what kinds of volume it generated from that development, but, did that answer your question? Yehle: (inaudible) residential street access to a subdivision or not (inaudible) R-4? Stiles: No, you're not required to have a residential street access. What we call - these roads within the subdivision are called local streets, and that sets the design criteria for how wide and how it's constructed, but that's not a requirement to have a residential designation on the street in order to access your subdivision. The property is approximately 76.24 acres in size. The property is generally located 1/4 mile south of Fairview Ave. on the east side of Eagle Road, in Meridian. 2. The owners of record of the subject property are various. 3. The Applicant is City of Meridian, Idaho. 4. The property is presently zoned as Light Industrial (I-L), and is being developed as a residential subdivision. 5. The Applicant requests the property be rezoned to Low Density Residential (R-4). The City are requesting the rezone to "clean up" the zoning map and bring the zoning more into line with a residential development. 6. The subject property is within city limits of the City of Meridian. RECOMMENDATION TO CITY COUNCIL - 1 REQUEST FOR REZONE -CROSSROADS SUBDIVISION BY CITY OF MERIDIAN 7. The entire parcel of the property is included within the Meridian Urban Service Planning Area as the Urban Service Planning Area is defined in the Meridian Comprehensive Plan. 8. The Applicant's requested rezoning of the subject real property as R-4 is consistent with the Meridian Comprehensive Plan Generalized Land Use Map which designates the subject property as Existing Urban. 9. There are no significant or scenic features of major importance that affect the consideration of this application. As stated in our comments, since more than 200 property owners were effected, the City did not send individual notices but it was posted and the homeowners association president was notified. The main impact on the rezone really will be on home occupations and specifically day cares which in other zones they can do more than 6 kids with their day cares and in the R-4 they can do a maximum of 5. In terms of impact on the residents that live in Crossroads, that is really the main impact. Otherwise, it is simply a clean up of the map or the zoning map. Borup: Thank you, any questions. The subject, 76.24 acres was a portion of the entire NW `/4 of Section 9, Township 3N, Range lE that was annexed under one application in 1984. The entire `/4 section was annexed at that time with the I-L zone. When Capital Development submitted and received approval for the preliminary plat of Crossroads in 1992, a rezone application was not submitted nor requested by the City at that time. Similarly, when each of the seven phases came through with final plats, the zoning remained in place and continues to this day under the original zone. This rezone application is desirable at this time to correct this oversight. 10. Planning & Zoning staff initiated this zoning amendment and feel it is a necessary and desirable change for two reasons: (a) to update the official zoning map of the City to reflect the actual, built-out use of the land and, (b) to reduce the number of potential conflicts with the Schedule of Use Control for Crossroads residents applying for home occupations (home occupations are not permitted in the I-L zone but are permitted in the R-4 zone). To date, Planning & Zoning has allowed Day Cares and Home Occupations for Crossroads residents, but only as Conditional Uses, which is more expensive and time consuming than the Accessory Use Permit process. r., r This rezone will also allow the City to legally use the R-4 zoning and building standards when determining buffer widths for the future development of the I-L parcel abutting the south boundary of Crossroads and when enforcing other city codes. The adjacent property uses/developments are: North -Family Center commercial development (ShopKo, Office Depot, Sportsman's Warehouse, other future retail pads); I-L zone South -Future extension of Pine Street; vacant I-L parcel East - Westdale Park Subdivision No. 2 (R-8); Seventh-day Adventist Church in an Ada County RT zone, proposed Wa1Mart West -Family Center commercial development (undeveloped, Phase 2), I-L zone 11. A brief history of how the subdivision (76.24 acres) was originally zoned Light Industrial is on page two of the application, item #9. The main potential impact on property owners relates to day cares. To date, the City has accepted applications for Group Day Cares (6-12 children) in Crossroads under the Conditional Use Permit process. However, under the proposed R-4 zone, these larger size day cares are prohibited. Only Family Day Cares (1-5 children) are permitted in this zone. Of course, residents must still comply with any CC&R provisions dealing with day care operations. Any resident currently operating a Group Day Care with a valid CUP will be allowed to continue. The application will not have any affect on property lines, easements, common areas or other features of the plat. The majority of residential lots in the subdivision do not meet the minimum area or frontage standards of the R-4 zone. However, the majority exceed the minimum R-8 standards. The R-4 zone was selected since it has the more restrictive standards and more accurately reflects the overall density of the subdivision. Mr. Ramon Yorgason, President of Capital Development, Inc. and developer of the subdivision, and Mr. Ray Yehle, current president of the Crossroads Homeowner's Association, were both informed of the City's intent to rezone in February.
