NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the Planning and Zoning Commission of the
City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho at the hour of 7:00 p.m. on February 8, 2000 for the purpose of
reviewing and considering the application of 4M Leasing/Canvest for a Vacation of utility
and drainage easements along the inside lot line to lots 5 and 6, block 2 of Commerce
Park Subdivision currently zoned IL.
Amore particular description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Street, and is available for inspection during
regular business hours.
A copy of the application is available upon request. Any and all interested
persons shall be heard at said public hearing and the public is welcome and invited to
submit testimony.

Dear Shari:
Please accept our subject easement vacation application. It is the desire of 4M
Leasing/Canvest to add an addition onto the existing building; on I,~ot G, Block 2 of said
Commerce Park Subdivision, at 3650 Commercial Court, Meridian. The addition to this
building will extend over the lot line on the west side of said Lot 6. Therefore, as 4M
Lasing;/Canvest owns both said I,ot 5 and Lot 6, Block 2, they have retained our finx~ to
prepare a property line adjustment survey to move said lot line to the west to
accommodate the expansion. We have received easement relinquishment letters 1Tom all
the affected utilities and a verbal from Gary Smith at Meridian Public Works.

VI~REAS, by platted subdivision easement recorded in Book 45 of Plats at Pages 3721
and 3722, in the records of Ada County, State of Idaho, Commerce Park Subdivision, granted to
IDAHO POWER COMPANY an easement (the "Easement") for the construction, operation and
maintenance of certain power line facilities upon the following premises located in Ada County,
State of Idaho, to-wit:
Commerce Park Subdivision located in the SW% Section 9, Township 3 Nor[h, Range 1
last, B.M., Ada County, Idaho.
AND, WHEREAS, it is no longer necessary or desirable that a certain portion of the
Easement be retained.
NOW, THEREFORE, in consideration of the premises, IDAHO POWER COMPANY
does hereby release and abandon that certain portion of the Easement over the following
described lands:
The utility and drainage easement along the inside lot line common to Lots S and 6,
Block 2, of Commerce Park Subdivisio», as recorded in Book 4S of Plats at Pages 3721
and 3722, official records of Ada County, Idaho, as described by Note 1 on said plat.
This partial release does not change the 25.00 foot easement along the exterior boundary
or adjacent to the street dedicated to the public.

lands covered by the Easement and any and all prescriptive or other rights the Grantee has
acquired through occupancy and use over time of said remaining lands shall remain and continue

This matter coming on regularly before the City Council at its regular meeting
on the 7th day of March, 2000, at the hour of 7:30 p.m., and Brad Hawkins-Clarlc,
Assistant Planner for the Planning and Zoning Department, appeared and testified at
the hearing, and appearing and testifying on behalf of the Applicant was Jim
Washburn, and the Council having received the record from the Planning and Zoning
Commission and its recommendations to the City Council, and no objection having
been received makes the following Findings of Fact and Decision and Order.

STATEMENT OF LEGAL AUTHORITY AND JURISDICTION
CONCLUSIONS OF LAW
Easements shall be vacated in the same manner as streets. {LC. § 50-
1325}.
2. The vacation of an easement which was accepted as part of a platted
subdivision shall be vacated pursuant to the provision of Chapter 13,
Title 50 Idaho Code {LC. § 40-203 (6)}.
3. Any person, firm, association, corporation or other legally recognized
form of business desiring to vacate a part of a plat which is inside the
boundaries of any City must petition the City Council to vacate. Any
person, persons, firm, association, corporation or other legally
recognized form of business desiring to vacate a plat or any part thereof
which is inside or within one (1) mile of the boundaries of any city must
petition the city council to vacate. Such petition shall set forth
particular circumstances of the requests to vacate; contain a legal
description of the platted area or property to be vacated; the names of
the persons affected thereby, and said petition shall be filed with the
city clerk. Written notice of public hearing on said petition shall be
given, by certified mail with return receipt, at least ten (10) days prior
to the date of public hearing to all property owners within three
hundred feet (300') of the boundaries of the area described in the
petition. Such notice of public hearing shall also be published once a
week for two (2) successive weeks in the official newspaper of the city,
the last of which shall be not less than seven (7) days prior to the date
of said hearing; provided, however, that in a proceeding as to the
vacation of all or a portion of a cemetery plat where there has been no
interment, or in the case of a cemetery being within three hundred feet
(300') of another plat for which a vacation is sought, publication of the
notice of hearing shall be the only required notice as to the property
owners in the cemetery. When the procedures set forth herein have
been fulfilled, the city council may grant the request to vacate with such
restrictions as they deem necessary in the public interest. In the case of
easements granted for gas, sewer, water, telephone, cable television,

power, drainage, and slope purposes, public notice of intent to vacate is
not required. Vacation of these easements shall occur upon the
recording of the new or amended plat, provided that all affected
easement holders have been notified by certified mail, return receipt
requested, of the proposed vacation and have agreed to the same in
writing. {LC. § 50-1306A (1), (2), (3) and (5)}
Pursuant to Meridian City Code §§ 12-10-1 A and B and 12-10-2 A and
B it provides as follows:
12-10-1 APPLICATION PROCEDURE:
A. Application: Any property owner desiring to vacate an existing
subdivision, public right of way or easement shall complete and file an
application with the Administrator. These provisions shall not apply to
the widening of any street which is shown on this Comprehensive
Development Plan, or the dedication of streets, rights of way or
easements to be shown on a recorded subdivision.
B. Administrator Action: Upon receipt of the completed application, the
Administrator shall affix the date of application acceptance thereon.
The Administrator shall place the application on the agenda for
consideration at the next regular meeting of the Commission which is
held not less than fifteen (15) days after said date of acceptance.
12-10-2 COMMISSION AND COUNCIL ACTION:
A. Commission Recommendation: The Commission shall review the
request and all agency responses and make a recommendation to the
Council for either approval, conditional approval, or denial.
B. Council Action:
1. Hearing; Notice: When considering an application for vacation
procedures, the Council shall establish a date for a public hearing and
give such public notice as required by law. The Council may approve,

deny or modify the application. Whenever public rights-of-way or lands
are vacated, the Council shall provide adjacent property owners with a
quit-claim deed for the vacated rights of way in such proportions as are
prescribed by law.
2. Street Improvements; Bond: When considering an application for
dedication procedures, the Council may approve, deny or modify the
application. When a dedication is approved, the required street
improvements shall be constructed or a bond furnished assuring the
construction, prior to acceptance of the dedication. To complete the
acceptance of any dedication of land, the owner shall furnish to the
Council a deed describing and conveying such lands to be recorded with
the County Recorder.
FINDINGS OF FACT
1. 4M Leasing/Canvest, of 5559 W. Gowen Road, Boise, Idaho 83709, is a
legally recognized form of business in the State of Idaho. {see Chapter 6
of Title 53 Idaho Code}
2. 4M Leasing/Canvest, filed a petition for the vacation of a 10-foot wide
public utility and drainage easement for Lots 5 and 6, Bloclc 2 of
Commerce Parlc Subdivision, as dedicated in the Quitclaim Deed from
Donald J. Nelson and Karin B. Nelson, husband and wife, to 4M
Leasing/Canvest, an Idaho Partnership, recorded May 25, 1994, as
Instrument No. 94048996.
3. The legal descriptions of the utility and drainage easements which are
the subject of this petition are:

4. The particular circumstances of the requested vacation is:
The vacation is required to allow expansion of an existing building and
adjustment of a Lot Line in order to conform with the same easement recorded in
Boolc 45 of plats at pp. 3721 and 3722, Ada County Records. Said vacation to being
10-feet South of the North Lot Line of said Lots 5 and 6 and end 25 feet North of
the South Lot Line of said Lots 5 and 6. All utilities are located in the street and can
service projects without having to utilize these easements.
5. The names and, Relinquishment of Easements attached as Exhibit "A",
of the affected by the petition to vacate include:
5.1 The applicant/owner of the property is 4M Leasingf Canvest, alca
Nelson/McAlvain-Commerce Parlc Subdivision, Boise, Idaho, and
~vho applied for the vacation application.
5.2 Intermountain Gas Company, AT&T Cable Services, US West

6. Written notice of the public hearing of this petition was given by
certified mail with return receipt at least ten (10) days prior to the date
of the public hearing to all property owners within three hundred feet
(300') of the boundaries of the area described in the petition, and such

the Idaho Statesman with the last publication which was not less than

WHEREAS, by platted subdivision easement recorded in Book 45 of Plats at Pages 3721
and 3722, in the records of Ada County, State of Idaho, Commerce Park Subdivision, granted to
IDAHO POWER COMPANY an easement (the "Easement") for the construction, operation and
maintenance of certain power line facilities upon the following premises located in Ada County,
State of Idaho, to-wit:
Commerce Park Subdivision located in the SW % Section 9, Township 3 North, Range 1
East, B.M., Ada County, Idaho.
AND, WHEREAS, it is no longer necessary or desirable that a certain portion of the
Easement be retained.
NOW, THEREFORE, in consideration of the premises, IDAHO POWER COMPANY
does hereby release and abandon that certain portion of the Easement over the following
described lands:
The utility and drainage easement along the inside lot line common to Lots S and 6,
Block 2, of Commerce Park Subdivision, as recorded in Book 4S of Plats at Pages 3721
and 3722, official records of Ada County, Idaho, as described by Note 1 on said plat.
This partial release does not change the 25.00 foot easement711ong the exterior boundary
or adjacent to the street dedicated to the public.
ALL RIGHTS and privileges under the above-described document in and to the remaining
lands covered by the Easement and any and all prescriptive or other rights the Grantee has
acquired through occupancy and use over time of said remaining lands shall remain and continue
in the Grantee and shall not be affected in any way hereby.

Borup: The applicant did not come. Staff are you handling their comments. Any
comments Brad? We've got your staff comments. The applicant has agreed to all your
comments.
Hawkins Clark: Yes sir they have.
Borup Staff recommends approval. Anything else we need to know? Any questions
Commissioner's. Do we have any motions?
Brown: I recommend we approve Item 9 the request to vacate 10 foot wide utility and
drainage easements centered on lot line common to lots 5 and 6 ,block 2, commerce
park subdivision located %4 mile east of Eagle Road to include staff comments.
Barbeiro: I second the motion.
Borup: Motion and Second, all in favor?
MOTION CARRIED: ALL AYES
Borup: One final item before adjournment. It has been mentioned at this point about 16
applications in for March all ready. .
Hawkins Clark: I think it is 14. After 10 it really doesn't matter.
Borup: When is the cut off date. Has the cut off date happened for March yet?
Hawkins Clark: It has. First day of February.
Borup: So there won't be any more than 14.
Hawk-ins Clark: There will be a maximum of 10.
Borup: What's the maximum of 10.
Hawkins Clark: We send them back if after 10. You will never see more than new
public hearings.
Borup: No matter how lengthy they-don't you take a look at the projects case by case.

Hawkins Clark: No. Ten new applications regardless and we cut it off there and tell
them they will be on the subsequent meeting.
Borup: What we are saying, if we are going-in April and May your probably not going
to be any better. Now the time to start looking at second meetings. We may have
second meetings for a while. By doing that we can hopefully also not have late ones.
We are within our criteria tonight. We said we don't want to take new long applications
after midnight and we want to adjourn by 1. The 3 o'clock one was the final straw. We
are not going to keep up apparently if we don't start planning double meetings I guess.
So look for a second date in March.
Berg: I don't see you accomplish a lot by going after 10:30, 11 o'clock. We might as
well plan ahead.
Borup: You mean try to get out by 11
Berg: Well, I'm sorry I'd rather get out of here before 11 and have another meeting than
kill yourself the next day. It takes a whole week to get back up.
Hatcher: This is a volunteer position and it shouldn't impact my job tomorrow morning.
I concur with what Will is saying.
Berg: Unfortunately, Tuesday and Thursday are well used so in March we have the 14tH
is a regular meeting and we could have a Wednesday the 22"d which gives you another
week. Your could have the 30tH of March right now, another Thursday.
Brown: Isn't the 30tH a cut off for staff.
Borup: Are we at regular time the 22"d. Was that decided. Was that a 7 o'clock
meeting or can we move it up. We left that at 7. Believe it or not, I did not get that
written down.

Borup: What was that third date?
Berg: 22"d, 29tH, 30tH.
Borup: I am free all those dates. Anyone with a conflict?
Brown: Mr. Chairman, I would move that I believe that this would help us through our
hearing is if we limited the applicant to 15 minutes instead of the hour and a half that
Derrick O'Neill took.

We have reviewed this submittal and offer the following comments as conditions of the application.
These conditions shall be considered in full, unless expressly modified or deleted by motion of the
GENERAL COMMENTS
The two subject lots are located on the north side of Commercial Court, east of Eagle Road, in the
Commerce Park Subdivision and zoned Light Industrial (I-L). The easement is 5-feet wide along
both sides of the interior lot line common to Lots 5 and 6, as designated on the recorded plat for the
Commerce Park Subdivision. The Applicant has an existing building on Lot 6 and plans to expand
the building to the west into Lot 5 and over the subject lot line and existing easement. In order for
the Applicant to expand, they must vacate the existing easement and shift the lot line to the west.
The Subdivision and Development Ordinance (Title 12), Chapter 10, only requires the Commission
to review and make a recommendation on Vacation applications. A public hearing is only required
before the City Council.
SITE REQUIREMENTS
Prior to the issuance of any building permits on the subject lots, applicant must submit
relinquishment of easement letters from all applicable utility companies to the City of Meridian.
RECOMMENDATION
Staff recommends approval.
