By virtue of it's use as a warehouse/trucking facility, open unobstructed access, interior and perimeter site circulation is required, relegating landscaping to the site perimeter adjacent to paved parking. By the same rational, car parking is also limited to the site perimeter. 13. Landscaping; full compliance = (43) 3" caliper trees. Proposed 60% compliance = (26) 3" caliper trees. Parking; full compliance = 64 spaces. Proposed 94% compliance = 47 with 13 future (if needed). Additional parking is available by cross -parking agreement with Lot 5 adjacent. Required parking is well in excess of actual needed parking for this use. 14. Additional landscaping and tree planting has been added to that which was originally approved (by Ada County prior to annexation) creating a tree spacing of 30 ft. o.c. Additional trees would create crowding. Additional parking would inhibit truck circulation and would be in excess of needed parking for warehouse use. 15. This project was originally designed and approved by T & D application under the Ada County Zoning Ordinance in 1994 with anticipated Phase II expansion. Parking, landscaping and site configuration were based on the governing ordinance at that time and did not anticipate the significant increase in parking and landscaping requirements to be imposed by Meridian Zoning Ordinance as a result of recent annexation. Ada County Landscape Requirement; 5% of paved area. (No specific tree requirement). We are proposing 13,970 s.f. of landscaping, 21% of the paving area. Ada County Parking_Requirement; .5/1000 s.f. of building area. 63,138 s.f. at .5/1000 = 32 spaces. We are proposing 60 parking spaces (47 with 13 future). 16. (See #15) This is an existing facility approved under a different ordinance which wishes to expand as originally anticipated, but is being required to increase tree planting by 85% and required parking by 100% over that originally approved. We are proposing to add 1200+/- s.f. of new paving and 30,414 s.f. of building. However, we are being required to provide 3" caliper trees as though we are adding 64,650 s.f. of paving and to provide parking in the same amount as someone developing 63,140 s.f. of new building. 17. Because this is an existing facility, we think negotiation of appropriate upgrades to the existing site would be reasonable. Granting this variance request would confer on this applicant nothing that shouldn't be reasonably considered of any other applicant with an existing facility. 20. The requested variance does not impact or alter the relationship of this project to the surrounding light industrial zone or the intent of the Meridian Comprehensive Plan. 21. Check $250.00 + $1.73 x 4 = $256.92. 22. Granting of this request for variance would allow the owner to maintain required truck circulation while meeting his needs for parking, and at the same time improving the quality of his project by upgrading the existing landscaping with an estimated $10,200 investment in planting materials and irrigation system. 23. APPLICATION AND STANDARDS FOR VARIANCES A variance from the terms of this Ordinance shall not be granted by the Council unless and until a written application for a variance is submitted to the Administrator and the Council. Provide a written narrative containing, where applicable, the following outlined information: 1. Address of subject property. 2. Name, address and phone number of applicant. 3. Name, address and phone number of owners of subject property. 4. Proof of ownership or valid option on the property or a contract interest therein with consent of the titled owner. 5. Legal description of subject property. 6. Present use of subject property. 7. What is intended to be done on or with the property. 8. The district that pertains to the subject property. 9. Vicinity map at a scale approved by the Council showing property lines, existing streets, proposed district and such other items as may be required. 10. Schematic building plans which indicate typical elevation and floor plan of any proposed construction. 11. A list of the mailing addresses of all property owners within three hundred feet (300') of the external boundaries of the land being considered. This list can be obtained from the City of Meridian Planning & Zoning Department. Please request list seven days prior to submitting application. 12. Characteristics of subject property which prevent compliance with the requirements of this Ordinance. 13. Minimum requirements of this Ordinance that need to be reduced to permit proposed use. 14. Difficulty or hardship which would result if requirements of this Ordinance were applied to subject property. 15. Unusual or peculiar circumstances which indicate that regulations of this Ordinance should not be strictly complied with. 16. The PgZ Department received the variance application on 2-17-00. We received their letter requestirg withdrawal on 2-22-00. Our departmert did not transmit BRS's letter to the City ClerWs Office until this past week, after the City spent nxxxy on fulfAling notice requirements. Standard practice Is that the Applicants submit any oorrespondenue regarding meetings (withdmwial requests, etc.) drecw to the City Clerk with copies to us. So, I assumed our letter was simply a dopy and cid riot trur>w* the letter to Will. Our mistake. As I understand from Will, the issue for your consideration is whether or not the City should refund the Applicant their application fee. As stated in Roger Foster's letter, 4M/Canvest chose to redesign their site plan to comply with landscaping and parting requirements rather than follow through with the variance, So, I issued a Certlflcate of Zoning Compliance last week on the site and they are now in the building permit review process.
