The road will be deeded to the Ada County Highway District by the Meridian School District as soon as completed. (See attached letter). 2. The preliminary street name approval letter from Ada County is attached. River Valley Street is the new approved east/west street that accesses the River Valley Elementary School; and Stokesberry Court is the new north/south cul-de-sac. These names have been reserved by Ada County. We will get a completed approval letter as soon as John Priester, Ada County is available. 3. During neighborhood meetings, the neighborhood requested chain link fencing along the north boundary of the Stokesberry Subdivision. The fencing will be located along the property line. 4. The road will be deeded to the Ada County Highway District by the Meridian School District and thus become a public road. 5. The Final Plat has been revised to reflect conformance with the Preliminary Plat lot configuration. Thirty (30) copies of the Final Plat showing this revision are attached. Below are my comments: 1. Per item #2 on the application, please submit proof of ownership on Meridian School District's property for the portion of N. River Valley Court in the form of a recorded deed showing MSD as owner. 2. Your cover letter states that the street name approval letter from Ada County will be forwarded later but we will need this document before further processing and acceptance of the application. 3. Per condition 2.12 of the approved Findings (pg. 6), please submit detailed fencing plans for the required perimeter fence on the north boundary. Specifically, we're interested in construction materials and location of fence in relationship to the landscaped berm. 4. Per condition 2.23 of the approved Findings (pg. 7), please add a legal representative of the MSD to the Signature Page of the plat demonstrating their agreement to the new N. River Valley Court as a public road on their property. 5. Lot 4, Block 1 does not have frontage on a public street. What was the reason for changing this lot configuration from the Pre. Plat, which showed it as a flag lot? The main difference appears to be that you increased the length/chord of Lot 3 on the cul-de-sac by almost 40 feet, which essentially eliminated the flag of Lot 4. Please modify so this is in conformance with the approved Pre. Plat. Please submit 30 copies of the final plat showing this revision. If I'm missing something here, do enlighten me. All development is to conform to the requirements of the preliminary plat and the conditional use permit for a planned development. We have reviewed this submittal and offer the following comments, as conditions of the application. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: GENERAL COMMENTS: 1. Any existing active irrigation/drainage ditches crossing the property shall be tiled per City Ordinance 12-4-13. The ditches to be piped should be shown on the site plans. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department 2. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells may be used for non-domestic purposes such as landscape irrigation. 3. Two-hundred-fifty-watt and 100-watt, high-pressure sodium streetlights will be required at locations designated by the Public Works Department. All streetlights shall be installed at subdivider's expense. Typical locations are at street intersections and/or fire hydrants. 4. Submit a "Final" letter from the Ada County Street Name Committee, approving the subdivision and street names. Make any corrections necessary to conform. 5. Coordinate fire hydrant placement with the City of Meridian's Water Works Superintendent. FP-00-014 stokesberry.fp Mayor and City Council August 14, 2000 Page 2 6. Provide five-foot-wide sidewalks in accordance with City Ordinance Section 12-5-2.K 7. Assessment fees for water and sewer service are determined during the building plan review process. Each individual building owner shall be required to enter into a Re- Assessment Agreement with the City of Meridian for all uses. An assessment agreement is a vehicle that protects the City of Meridian and the developer in the event that estimated assessments are not in line with actual usages. The agreement provides for reimbursement to the developer for overpayment of assessments and payment to the City of Meridian of any shortfall in assessments. The overpayment shortfall is determined after adequate historical usage. 8. Applicant has not indicated whether the pressurized irrigation system within this development is to be owned and maintained by an association or the Nampa & Meridian Irrigation District. If the system is being proposed as a private system, plans and specifications for the irrigation system shall be reviewed by the Public Works Department as part of the development plan review process. A draft copy of the pressurized irrigation system O&M manual must be submitted prior to plan approval. The City of Meridian requires that pressurized irrigation systems be supplied by a year-round source of water. If a creek or well source is not available, asingle-point connection to the culinary water system shall be required. If a single-point connection is utilized, the developer shall be responsible for the payment of assessments for the common areas prior to signature on the final plat by the Meridian City Engineer. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the entire common open area. 9. Please be prepared to respond to each of the comments contained herein, both General and Site Specific, at the August 15, 2000 meeting of the Meridian City Council. SITE SPECIFIC COMMENTS: Sanitary sewer service to this site will be via extensions from the newly installed main for the new River Valley Elementary School. Applicant will be responsible to construct the sewer mains to and through this proposed development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. Sewer manholes are to be provided to keep the sewer lines on the south and west sides of the centerline. 2. Water service to this site will be via extensions from newly installed main for the new River Valley Elementary School. Applicant will be responsible to construct the water mains to and through this proposed development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. Please provide the Public works department with information on anticipated fire flow and domestic water requirements for the proposed site. Water service to this development is contingent upon positive results from a hydraulic analysis by our computer model. Flow and pressure from the existing mains should be monitored with the Meridian Water Department. 3. The Stokesberry Lateral is located along the southerly boundary of the property. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users FP-00-014 stokesberry.fp Mayor. and City Council August 14, 2000 Page 3 association, with written confirmation of said approval submitted to the Public Works Department. A letter of credit or cash will need to be submitted for tiling of the ditches prior to signature on the final plat. 4. Underground year-round pressurized irrigation must be provided to all landscape areas on site. Please submit hook-up and design details based on the proposed landscaping. Due to the size of the landscaped area, primary water supply connection to the City's mains will not be allowed. Applicant shall be required to utilize any existing surface or well water for the primary source. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the entire common open area. 5. Minimum 20-foot-wide planting strips will be required to buffer adjacent residential uses. 6. Building permits will be subject to any trunk line extension fees in existence at the time of application. 7. A condition of the preliminary plat and the recorded development agreement is that the Meridian School District be signatory to the plat, as the first 250 feet of N. Stokesberry Court belongs to the Meridian School District. Although dedication may have taken place previously, City Ordinance defines subdivision as "The result of an act of dividing an original lot, tract or parcel of land into two (2) or more parts. The term "subdivision" shall also include the dedication of a public street and the addition to, or creation of, a cemetery." Staff has recently experienced numerous problems caused by ACHD's acceptance of public streets without even so much as consulting the City. Most of these dedications involve land use decisions which the Ada County Highway District is not qualified to make. Staff requests that the Meridian School District sign the plat to properly dedicate the roadway as part of a recorded plat. 8. Add or revise the following notes: 1 • ...zoning regulations of the City of Meridian, Idahozor as allowed by conditional use. 7. ...highest established seasenal normal groundwater elevation. 11. All lots within this subdivision are subject to the terms of a develo ment agreement recorded in the office of the Ada County Recorder Instrument No 9. Please add a matrix to the face of the plat to indicate reduced setbacks approved as part of the conditional use permit to alleviate confusion at the time building permit application. 10. Please complete the Certificate of Owner and accompanying Acknowledgment. 11. Street signs are to be in place, water system shall be approved and activated, pressurized irrigation system approved and activated, road base approved by the Ada County Highway District, and perimeter fencing is to be in place prior to any building permits being issued. All perimeter landscaping is to be completed prior to issuance of Certificate of Occupancy for any building within the subdivision. The owner and developer Jon Barnes of Properties West, the Meridian School District and the City of Meridian will resolve plat signatures. The first 250 feet of N. Stokesberry Court has already~been dedicated to ACRD and it seems unnecessary to have the School District a signatory on the plat. Further, the issue of Meridian's "subdivision" definition and ACHD's disregard for the city of Meridian's land use planning efforts is best resolved through communications between the two agencies. Requiring additional signatures on this plat presents an unnecessary hardship on Properties West. 8. Notes 1, 7, and 11 will be revised in the manner indicated. 9. A matrix will be added to the face of the final plat detailing the location of the reduced setbacks. 10. This will be completed. 11. The applicant agrees to this condition.
