APPLICATION SUMMARY The applicant, Scott Schoenherr, has submitted an application requesting approval to vacate a 10-foot wide public utility, drainage, and irrigation easements located on the common lot line between Lots 10 and 11, Block 1 of Central Valley Corporate Park. IL STAFF RECOMMENDATION Staff recommends approval of the proposed vacation application. III. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The subject property is located at 690 S. Industry Way on Lots 10 and 11, Block 1, Central Valley Corporate Park in the southwest'/4 of Section 18, Township 3 North, Range 1 East. B. Applicant: Scott Schoenherr 408 E. The subject application is a request to vacate platted easements. Per Meridian City Code, a public hearing is required before the City Council on this matter. The UDC does not require the site be posted with a public hearing notice sign. B. Newspaper notifications published on: October 15, and 29, 2012 C. Radius notices mailed to properties within 300 feet on: October 11, 2012 VI. LAND USE A. Existing Land Use(s): The subject property lies within Central Valley Corporate Park, is zoned C-G, and is currently developed with an existing multi-tenant commercial building. The existing building is constructed over the easements being proposed for vacation. B. Character of Surrounding Area and Adjacent Land Use and Zoning: The subject site is surrounded by commercially developed property, zoned C-G. C. History of Previous Actions: In 1989, the properly was platted as part of Central Valley Corporate Park. Later, a record of survey (ROS 4357) was approved consolidating the lots however, the ROS did not vacate the platted easement. • In 2005, a certificate of zoning compliance was approved to develop a 14,526 square foot office building. D. Utilities: NA 1. Public Works: a. Location of sewer and water: NA b. Issues or concerns: None E. Physical Features: 1. Canals/Ditches Irrigation: NA 2. Hazards: NA VII. AGENCY COMMENTS MEETING No comments were received by the Planning Department from other City departments for the subject application. Please see the public record for the VAC file for any written comments that may have been submitted by other agencies. VIII. ANALYSIS Analysis Leading to Staff Recommendation: The applicant requests approval to vacate the two 5-foot wide permanent public utilities, drainage, and irrigation (PUDI) easements located on the common interior lot line between Lots 10 and 11, Block 1 of Central Valley Corporate Park. The two lots have been consolidated into one property through a record of survey. An existing commercial building is constructed over said easements and no utilities are located within the easements (see Exhibit A.1). All public utilities (Idaho Power, Century Link, Cable One, Intermountain Gas) have given consent to relinquish the easement. NMID submitted a letter stating the only easement it has in the area is the 60-foot wide Nine Mile Creek easement along the eastern boundary which is to remain protected.
