To Whom It May Concern:
Incompliance with the City of Meridian application requirements, this narrative describes the
proposed request to vacate an existing easement.
The Optimist Club of Meridian, Inc. is requesting the vacation of an overhead power line easement
that was reserved by Idaho Power Company for construction, operation and maintenance. The
easement is a 1S feet wide strip that runs along the north property line.
The Idaho Power Company is in agreement with the easement vacation since the easement is no
longer necessary or desirable.

The Grantor does hereby reserve a~ retain for its own use and benefit:
(1) Ownership of all existing power lines and appurtenant facilities located upon the
following portion of the above~escribed property (hereinafter referred to as the
"Reserved Premises)."
A ten (10) foot wide strip along both the east and west property lines and
a fifteen (15) foot wide strip along the north property lice.
(2) A right-0f--way and easement for the erection and contiinied operation, maintenance,
repair, alteration (including, but not limited to, voltage or capacity upgrades and additional
towers or poles and/or new tower of pole locations), inspection, and replacement of
overhead and/or underground electric transmission, distribution and telephone lines and
circuits of the Grantor, attached to towers, poles, props, guys or other supports, together
with guys, crossarms and other attachments and incidental equipment thereon, and
appurtenances, wide the right to permit the attachment of the wires and fixtures of other
companies or parties, over, under, on and across the above described Reserved Premises.
Together with all rights of ingress aid egress necessary for the full and complete use, occupation
and enjoyment of the Reserved Easement, and all rights and privileges incident thereto, including the right
from time to time to cut, trim and remove trees, brush, overhanging branches and other obstructions which
may injure or intierfere with the Grantor's use, occupation or enjoyment of the Reserved Faaemrnt and the
operation, maintenance and repair of Grantor's electrical system.
At no ti~ shall a~ building, structure or flammable material of airy kind be placed or erected
within the boundaries of the Reserved Easement by Grantee or by Grantee's heir, successors or assigns,
nor shall they bring or permit fA be brought any equipmem or vehicles or material of any kud or nature
within twenty five (25) feet of a~+ of Grantor's. electric power_lines at airy time,. even if the wires sag or
sway as a result of increased temperatures, wind, electrical loading on the wires, or other conditions.
Subject to the foregoing limitations, the parties acknowledge that a portion of the existing building
on the Property is located within the fifteen (15~ foot easement located along the north property line. The
parties agree that the easement reserved by Grantor hereunder relating to the fifteen (15) foot strip along
die north property line is limited to an overhang eaxment only, and shall neither limit Grantee's access to
the railroad nor prevent Grantee from placing structures within said easement. Furthermore, the Reserved
Easements may be used by Grantee for access, parking and other purposes not inconsietem with said
easements, upon the condition that such acts do not imerfere with any existing or future electrical lines of
die Grantor, or result in die violation of airy state, local or federal law or regulation or the National

Electrical Safety Code as the same now exists or may hereafter be amended.
TD HAVE AND TO HOLD, all and singular, the above mentioned ark described premises,
together with the appurtenances, unto the Grantee, and to Grantee's heirs, successors a~ assigns forever.
And the said Grantor, and its successors, shall and will warrant and by these presents forever defend the
Property in the quiet and peaceable possession of Grantee, his heirs, successors and assigns, against all
and every person and persons whomsoever, lawfully claiming the same.
G'I2ANTEE, by recording this instrumem and/or exercising the rights herein granted, agrees to the
terms of Grantor's Reservation of Power Lines and Easements.
THIS CORRECTED WARRANTPDEED supersedes and replaces that Warranty Deed dated the
22nd day of May 1996 and recorded as Instnwient Number 96Ck15664.

Partial Release of Easement
WHEREAS, provided in that certain Corrected Warranty Deed with Reservation of Easement,
dated March 28, 1997, granted by Idaho Power Company to the Optimist Club of Meridian,
Inc, and recorded on the 4th day of April, 1997, as .Instrument Number 97026045 in the records of
Ada County, State of Idaho, IDAHO POWER COMPANY reserved an easement (the "Easement")
for the construction, operation and maintenance of certain power line facilities upon the following
premises located in Ada County, State of Idaho, to-wit: ;
Lots 14, 15, lb, 17, Block 2, Bown's Railroad Addition, according to the official
plat thereof, filed in Book 4 of Plats at Page 165, Records of Ada County, Idaho.
AND, WHEREAS, it is no longer necessary or desirable that a certain portion of the
Easement be retained.
NOW, THEREFORE, in considerataon;of thepremises, IDAHO POWER COMPANY does
hereby release and abandon that certain portion of the Easement over the following described lands:
A fifteen (1 S) foot wide strip along the north property line of the above-described property.
ALL RIGHTS and privileges under the above-described document in and to the remaining
lands covered by the Easement and any and all prescriptive or other rights the Grantee has acquired
through occupancy and use over time of said remaining lands shall remain and continue in the
Grantee and shall not be affected in any way hereby.
