REV Spurwing Challenge Driving RangeG``~ REVISED CERTIFICATE OF ZONING COMPLIANCE REPORT DATE: October 10, 2012 E IDIAN~- TO: Cornel Larson I D A H O FROM: Bill Parsons, Associate City Planner SUBJECT: Spurwing Challenge Driving Range -CZC-12-021 and DES-12-018 OWNER: The Club at Spurwing, LLC DESCRIPTION OF APPLICANT'S REQUEST The applicant, Cornel Larson, requests certificate of zoning compliance (CZC) and design review (DES) approval to construct a new driving range and three (3) new buildings; 680 square foot training building, .1,121 square foot starter building and 2,260 square foot maintenance building. The subject property is located at 6800 N. Spurwing Way. The proposed outdoor recreation facility received conditional use permit approval on February 7, 2012. DECISION The applicant's request for CZC and DES is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify if you need a building permit and/or inspection. If you need a building permit, you must complete that process before you commence the use or construction. As part of the application submittal, you must provide these plans in PDF format and hardcopy as specified in the Building Services "Plan Intake Checklist': Please contact Building Services for additional details about building permits and inspections. Site Specific Conditions of Approval 1. Prior to releasing Fnal certificate of occupancy of the starter building and the maintenance building, the proposed buildings shall be connected to City sewer. Temporary occupancy for the structures is subject to the discretion of the Building Official. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-SC-3C. 3. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-3B-14A. 4. The site plan prepared by Larson Architects and 2P Pascuzzo and Pate, dated 03/21/12, 03/26/12, 07/27/12 and 09/26/121abeled SP1.0, G1-G4 are approved (stamped "approved" on 04/25/12 and 10/10/12 by the City of Meridian Planning Department) with no changes. 5. The landscape plan prepared by The Land Group and 2P Pascuzzo and Pate, dated 03/09/12 and 10/01/12, labeled L1.0, L1.10 and G3 are approved (stamped "approved" on 04/25/12 and 10/10/12 by the City of Meridian Planning Department) with the following comment: Conditions Document Spurwing Challenge Driving Range CZC & DES REVISED 6. The building elevations prepared by Larson Architects, dated 05/08/12, 07/27/12 and 09/27/12, labeled A-2 and A-4 are approved (stamped "approved" on 10/10/12 by the City of Meridian Planning Department) with no changes. 7. The approved site plan, landscape plans and/or building elevations shall not be altered without prior written approval of the City of Meridian Planning Department. 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 10. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (AZ-11-005, RZ-11-006, PP-11-011, CUP-11-009, and recorded development agreement). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3. 7. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the approved outdoor recreation facility use as set forth in UDC 11-4-3-2. 8. The applicant shall comply with the accessory outdoor storage standards as set forth in UDC 11- 3A-14. CITY ANALYSIS OF UDC REQUIREMENTS At this time City sewer is not available to service the proposed starter building and maintenance building. A provision of the recorded development agreement requires the project to hook-up to City sewer. The Conditions Document 2 Spurwing Challenge Driving Range CZC & DES REVISED applicant is proposing to not occupy the restroom facilities until sewer is available. Staff has coordinated with the building official and land development on the issuance of temporary occupancy. Final certificate of occupancy will not be issued until the building has an operable sewer system provided by the City. Temporary certificate of occupancy will be left to the discretion of the building official. COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before 10/25/2012, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. The administrative design review shall be exercised with the approval period of the underlying permit (CZC) or the approval shall expire. This submittal is intended to modify the above listed CZC and DR previously submitted. The Maintenance Building is a 2,660 s.f. building located adjacent to the 6th tee of the new Challenge Course at Spurwing. It is intended to house material and equipment necessary for the upkeep of the new course. It will also serve as a rest stop for golfers as it has two public restrooms accessed from under a small portico. The proposed cart path to be installed with the golf course will diverge slightly to allow users to park under a roof and use the restrooms at their leisure. The remainder of the building is devoted to a small office, storage space, and a pump room for the course sprinkler system. The exterior of the building is consistent with previously built structures at Spurwing. Exterior wall finishes are to be stucco with afive-foot tall stone wainscot. Asphalt composition tiles are to be used on the roof, which features gable ends on the primary building with a small hip roof extending to protect a portion of the cart path. All finish materials are to match the existing clubhouse in color and texture. As the building's purpose is storage, there are no exterior windows except for one located at the interior office. Two overhead doors allow for equipment /material to be moved in and out of the building and are located on the service side of the building. The building is located adjacent to the 6th tee of the new golf course. A maintenance yard is located to the East of the building and is screened by a six-foot high vinyl fence. This location will allow the building to screen the yard from the golf course. Nine parking stalls are located to the North of the building, accessed from Island Green Court. We believe that this submittal falls into character with the existing club and the previously submitted buildings for the new Challenge Course.
