Therefore, the accumulative effects of all such encroachments shall be considered by the Commission (and Council) in making any decision. Allowing additional development shall increase the floodplain elevation in the area, but not more than the required 1-foot safety margin. No portion of the proposed development is within the floodway. 2.6 All signage is subject to design review and requires separate permits. No freestanding signs are proposed with this application. If any are proposed in the future, it shall conform to the new Sign Ordinance, as recommended for approval by the Meridian City Council on November 21. This allows for a single freestanding sign not to exceed 70 square feet and 15 feet high, maximum. 2.7 Dimensions of all parking stalls shall conform to minimum dimensions as per city ordinance and ADA. City ordinance requires 9 X 19 standard stalls and 25-foot-wide minimum driveways. ADA requires the van-accessible handicap-accessible stall to have a striped aisle separate from the stall (typically an 8-foot stall and an 8-foot aisle). The handicap parking space shall have van-accessible signage per ADA standards. 2.8 All required improvements must be complete prior to obtaining a Certificate of Occupancy. A Temporary Certificate of Occupancy shall be obtained by providing surety to the City in the form of a letter of credit or cash in the amount of 110% of the cost of the required improvements (including paving, striping, landscaping, and irrigation). A bid shall accompany any request for Temporary Occupancy. 2.9 Applicant shall be required to enter into an Assessment Agreement with the City of Meridian. 2.10 In accordance with City Ordinance 12-13-8-1, underground year-round pressurized irrigation shall be provided to all landscape areas on site. Limitations on periods of use and operation; b. Imposition of deed restrictions; c. Location and arrangement of structures within the floodway and floodway fringe areas to avoid an increase in flood heights during the recurrence of the 100-year flood discharge; d. Requirement for construction of channel modifications, dikes, levees and other protective measures; e. Placement of survey benchmarks; and f. Additional floodproofing measures. 1.5 According to Ordinance 11-11-6, the evaluation of the effect of the proposed use causing an increase in flood heights is based not just on the effect of the single use acting alone, but upon the reasonable assumption that other landowners within the floodplain may need to be allowed to develop to an equivalent extent within the floodplain. Therefore, the accumulative effects of all such encroachments must be considered by the Commission (and Council) in malting any decision. Staff's opinion on this matter is that allowing additional development will increase the floodplain elevation in the area, but not more than the required 1-foot safety margin. No portion of the proposed development is within the floodway. 1.6 All signage is subject to design review and requires separate permits. No freestanding signs are proposed with this application. If any are proposed in the future, it shall conform to the new Sign Ordinance, as recommended for approval by the Meridian City Council on November 21. This allows for a single freestanding sign not to exceed 70 square feet and 15 feet high, maximum. 1.7 Dimensions of all parking stalls shall conform to minimum dimensions as per city ordinance and ADA. This is a staff level approval and will not be heard by the ACHD Commission unless the site plan is changed in such a manner as to not conform with District standards/policy or an appeal of the Planning and Development staff decision is submitted as described within the Standard Requirements outlined below. If the new improvements are damaged during construction, replace the damaged curb, gutter and/or sidewalk on Baltic Street with new curb, gutter and/or concrete sidewalk to match existing improvements. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. Contact ACHD's Utility Coordinator at 387-6258 (with file number) for details. Standard Requirements: This decision of the Planning and Development Supervisor may be appealed to the Ada County Highway District Commission by the applicant or by another party within 15 calendar days from the date of this report. The request shall specifically identify each requirement to be reconsidered and include a written explanation of why such a requirement would result in a substantial hardship or inequity The request will be heard by the District Commission at an evening meeting within 20 calendar days of the District's receipt of the appeal letter. The appellant will be notified of the date and time of the Commission meeting. 2. After ACHD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Planning and Development Supervisor within two days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall specifically identify each requirement to be reconsidered and include written documentation of data that was not available to the Commission at the time of it's original decision. The request for reconsideration will be heard by the District Commission at the next regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which .the reconsideration will be heard. 3. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #193, also known as Ada County Highway District Road Impact Fee Ordinance. 4. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACRD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless awaiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. %'~ ,j'°'~ 8. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The proposed use by Big D Builders is deemed a permitted use in the I-L zone. However, the site is also completely within the 100-year floodplain of Five Mile Creek, and is therefore also regulated by the Floodplain District, Chapter 11 of the Meridian Zoning Ordinance. The proposed structure is required to obtain a Conditional Use Permit for the proposed structure as per the City Ordinance 11-11-2. The purpose of the Floodplain Overlay District (FP) is to guide development in floodplain areas throughout the City of Meridian, and to minimise the expense and inconveniences to the individual property owners and the general public through flooding. Authorized uses in the FP district shall not hinder the movement of flood waters. The FP district is superimposed over other zoning districts, wherever a 100-yeaz floodplain exists (see Ordinance 11-11-1). LOCATION & SURROUNDING USES The subject property is at 200 N. Baltic Place (Lot 3 & northerly portion of Lot 4, Block 2) in Meridian Business Park. It is generally located north of Franklin Road, approximately halfway between E. 1 ~` Street and Locust Grove Road. The lot is currently zoned I-L. The property is located in an azea designated as Existing Urban in the Comprehensive Plan. The surrounding uses follow: North: multi-tenant building with D&A Glass and Caulking Specialties. The elevation of the floodplain on-site is 2611 ft. No finished floor elevation is shown on the submitted plans. The applicant shall verify that the floor elevation of the structure meets this requirement. 3. Materials that are buoyant, flammable, noxious, toxic or otherwise potentially injurious if transported by floodwaters aze prohibited as per Ordinance 11-11-5. Storage of any materials or equipment not having these chazacteristics is permissible only if they have low damage potential and are anchored or are readily removable from the azea. 4. Conditions that may be required by the Commission [and Council] per Ordinance 11-11-4 in approving structures in a Floodplain Overlay Zone through the Conditional Use Process include: a. Limitations on periods of use and operation; b. Imposition of deed restrictions; c. Location and arrangement of structures within the floodway and floodway fringe areas to avoid an increase in flood heights during the recurrence of the 100-year flood dischazge; d. Requirement for construction of channel modifications, dikes, levees and other protective measures; e. Placement of survey benchmarks; and f. Additional floodproofing measures. 5. According to Ordinance 11-11-6, the evahiation of the effect of the proposed use causing an increase in flood heights is based not just on the effect of the single use acting alone, but upon the reasonable assumption that other landowners within the floodplain may need to be allowed to develop to an equivalent extent within the floodplain. Therefore, the accumulative effects of all such encroachments must be considered by the Commission (and Council) in making any decision. Staffs opinion on this matter is that allowing additional development will increase the floodplain elevation in the area, but not more than the required 1-foot safety margin. No portion of the proposed development is within the floodway. 6. All signage is subject to design review and requires sepazate permits. No freestanding signs aze proposed with this application. If any aze proposed in the future, it shall conform to the new Sign Ordinance, as recommended for approval by the Meridian City Council on November 21. Dimensions of all parking stalls shall conform to minimum dimensions as per city ordinance and ADA. City ordinance requires 9 X 19 standard stalls and 25-foot-wide minimum driveways. ADA requires the van-accessible handicap-accessible stall to have a striped aisle sepazate from the stall (typically an 8-foot stall and an 8-foot aisle). The handicap pazking space must have van- accessible signage per ADA standazds. 8. It appears that the landscaping shown on the plan is based on the old ordinance of one 3"-caliper tree per 1,500 s.f. of asphalt. The site plan must be modified to conform to the new Landscape Ordinance, Section 12-13. This will require adding a landscape buffer along all side and reaz lot lines adjacent to a vehicular use area. Applicant must submit a modified site/landscape plan that conforms with the Landscape Ordinance when applying for a Certificate of Zoning Compliance. 9. All required improvements must be complete prior to obtaining a Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a letter of credit or cash in the amount of 110% of the cost of the required improvements (including paving, striping, landscaping, and irrigation). A bid must accompany any request for Temporary Occupancy. 10. Assessments for sewer and water service aze determined during the building permit application process. Applicant will be required to enter into an Assessment Agreement with the City of Meridian. An assessment agreement is a vehicle that protects the City of Meridian and the Developer in the event that estimated assessments are not in line with actual usages. The agreement provides for reimbursement to the developer for overpayment of assessments and payment to the City of Meridian of any shortfall in assessments. The overpayment/shortfall is determined after adequate historical usage. 11. In accordance with City Ordinance 12-13-8-1, underground yeaz-round pressurized irrigation must be provided to all landscape azeas on site. Applicant shall be required to utilize any existing surface or well water for the primary source. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the landscaped areas. Applicant shall submit irrigation performance specifications in compliance with Ordinance 12-13-8-2 when applying for a Certificate of Zoning Compliance. GENERAL REpUIREMENTS 1. Off-street parking shall be provided in accordance with Section 11-13 of the City of Meridian Zoning and Development Ordinance and/or as detailed in site-specific requirements. 2. Baltic Place Facts and Findings: JAN 2 2 2001 CITY OF MERIDIAN Office/Warehouse A. The Ada County Highway District (ACRD) staff has received the above referenced application requesting conditional use approval to construct a 16,902-square foot warehouse/office. The 1.32-acre site is located on the east side of Baltic Place at its intersection with King Street. This development is estimated to generate 84 additional vehicle trips per day based on the Institute of Transportation Engineers Trip Generation manual. The application and site plan stamped as received by the City of Boise on December 15, 2000 and was submitted to the District on December 20, 2000, has been reviewed by the ACRD Planning and Development staff, and conforms to applicable District standards/policy, or can be made to conform with the change(s) to the plan described in the requirements stated below. B. This is a staff level approval and will not be heard by the ACRD Commission unless the site plan is changed in such a manner as to not conform with District standards/policy or an appeal of the Planning and Development staff decision is submitted as described within the Standard Requirements outlined below. C. On No~~ember December 28, ?000, the Dist~ict Planning and Development staff inspected this site and evaluated the transportation svstem in the ~ icinity. On lanuarv 2. 2001. the staff met as the Disu~ict's Technical Review Committee and reviewed the impacts of this proposed development nn the Dist-ict's transportation svstem. Construct the southern driveway as proposed on the site plan. 3. Pave the driveways their full-required width to a point 30-feet beyond the edge of pavement of Baltic Place. 4. If the new improvements are damaged during construction, replace the damaged curb, gutter and/or sidewalk on Baltic Street with new curb, gutter and/or concrete sidewalk to match existing improvements. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. Contact ACHD's Utility Coordinator at 387-6258 (with file number) for details. Standard Requirements: This decision of the Planning and Development Supervisor may be appealed to the Ada County Highway District Commission by the applicant or by another party within 15 calendar days from the date of this report. The request shall specifically identify each requirement to be reconsidered and include a written explanation of why such a requirement would result in a substantial hardship or inequity. The request will be heard by the District Commission at an evening meeting within 20 calendar days of the District's receipt of the appeal letter. The appellant will be notified of the date and time of the Commission meeting. 2. After ACHD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Planning and Development Supervisor within two days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall specifically identify each requirement to be reconsidered and include written documentation of data that was not available to the Commission at the time of it's original decision. The request for reconsideration will be heard by the District Commission at the next regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. 3. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #193, also known as Ada County Highway District Road Impact Fee Ordinance. 4. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACRD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 7. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations. ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless awaiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 8. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. Case No. CUP-00-OS 7 RECOMMENDATION TO CITY COUNCIL TREASURE VALLEY ENGINEERS, INC. Applicant 1. The property is located at 299 N. Baltic Place, Meridian, Idaho. 2. The owner of record of the subject property is Big D. Builders, Inc. of Nampa. 3. Applicant is Treasure Valley Engineers, Inc. of Nampa. 4. The subject property is currently zoned I-L. The zoning district of I-L is defined within the City of Meridian Zoning and Development Ordinance, Section II-7-2. 5. The proposed application requests a conditional use permit for an office- warehouse in a known flood plain. The I-L zoning designation within the City of Meridian Zoning and Development Ordinance requires a conditional use permit be obtained for most uses including those requested by the Applicant. (Meridian City RECOMMENDATION TO CITY COUNCIL - 1 CONDITIONAL USE PERMIT -OFFICE WAREHOUSE IN FLOOD PLAIN - TREASURE VALLEY ENGINEERS, INC. Zoning and Development Ordinance, Section 11-8-1). 6. The Meridian Planning and Zoning Commission recognizes that the proposed application is in compliance with the Meridian Comprehensive Plan. 7. The use proposed within the subject application will in fact, constitute a conditional use as determined by City Policy. RECOMMENDATION 1. The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the conditional use permit as requested by the applicant, subject to the following: Adopt the Recommendations of the Planning and Zoning and Engineering staff as follows: 1.1 The sewer and water systems shall be floodproofed and approved by the District Health Dept. of the Department of Health and Welfare as per Ordinance 11-11-3.A.1. An engineer must certify that the floodproofing requirement has been fulfilled as per Ordinance 11-11-3.A.3. 1.2 Ordinance 11-11-3.A.2 requires that no structure shall be erected unless the main floor is placed a minimum of 1 foot above the elevation of the 100-year floodplain. The elevation of the floodplain on-site is 261 I ft. No finished floor elevation is shown on the submitted plans. The applicant shall verify that the floor elevation of the structure meets this requirement. 1.3 Materials that are buoyant, flammable, noxious, toxic or otherwise potentially injurious if transported by floodwaters are prohibited as per Ordinance I I -11-5. Storage of any materials or equipment not having these characteristics is permissible only if they have low damage potential and aze anchored or are readily removable from the area. RECOMMENDATION TO CITY COUNCIL - 2 CONDITIONAL USE PERMIT -OFFICE WAREHOUSE IN FLOOD PLAIN - TREASURE VALLEY ENGINEERS, INC. 1.4 Conditions that may be required by the Commission [and Council] per Ordinance 11-11-4 in approving structures in a Floodplain Overlay Zone through the Conditional Use Process include: a. Limitations on periods of use and operation; b. Imposition of deed restrictions; c. Location and arrangement of structures within the floodway and floodway fringe areas to avoid an increase in flood heights during the recurrence of the 100-year flood discharge; d. Requirement for construction of channel modifications, dikes, levees and other protective measures; e. Placement of survey benchmarks; and £ Additional floodproofing measures. 1.5 According to Ordinance 11-1 I -6, the evaluation of the effect of the proposed use causing an increase in flood heights is based not just on the effect of the single use acting alone, but upon the reasonable assumption that other landowners within the floodplain may need to be allowed to develop to an equivalent e~ctent within the floodplain. Therefore, the accumulative effects of all such encroachments must be considered by the Commission (and Council) in malting any decision. Staff s opinion on this matter is that allowing additional development will increase the floodplain elevation in the area, but not more than the required 1-foot safety margin. No portion of the proposed development is within the floodway. 1.6 All signage is subject to design review and requires separate permits. No freestanding signs are proposed with this application. If any are proposed in the future, it shall conform to the new Sign Ordinance, as recommended for approval by the Meridian City Council on November 21. This allows for a single freestanding sign not to exceed 70 square feet and 15 feet high, maximum. 1.7 Dimensions of all parking stalls shall conform to minimum dimensions as per city ordinance and ADA. City ordinance requires 9 X 19 standard stalls and 25-foot-wide minimum driveways. ADA requires the van-accessible handicap-accessible stall to have a striped aisle separate RECOMMENDATION TO CITY COUNCIL - 3 CONDITIONAL USE PERMIT -OFFICE WAREHOUSE IN FLOOD PLAIN - TREASURE VALLEY ENGINEERS, INC. from the stall (typically an 8-foot stall and an 8-foot aisle). The handicap parking space must have van-accessible signage per ADA standards. 1.8 It appears that the landscaping shown on the plan is based on the old ordinance of one 3"-caliper tree per 1,500 s.f. of asphalt. The site plan must be modified to conform to the new Landscape Ordinance, Section 12-13. This will require adding a landscape buffer along all side and rear lot lines adjacent to a vehicular use area. Applicant must submit a modified site/landscape plan that conforms with the Landscape Ordinance when applying for a Certificate of Zoning Compliance. 1.9 All required improvements must be complete prior to obtaining a Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a letter of credit or cash in the amount of 110% of the cost of the required improvements (including paving, striping, landscaping, and irrigation). A bid must accompany any request for Temporary Occupancy. 1.10 Applicant will be required to enter into an Assessment Agreement with the City of Meridian. 1.11 In accordance with City Ordinance 12-13-8-1, underground year-round pressurized irrigation must be provided to all landscape areas on site. Applicant shall be required to utilize any existing surface or well water for the primary source. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the landscaped areas. Applicant shall submit irrigation performance specifications in compliance with Ordinance 12-13-8-2 when applying for a Certificate of Zoning Compliance. Location and arrangement of structures within the floodway and floodway fringe areas to avoid an increase in flood heights during the recurrence of the 100-year flood discharge; d. Requirement for construction of channel modifications, dikes, levees and other protective measures; e. Placement of survey benchmarks; and £ Additional floodproofing measures. I.5 According to Ordinance 11-11-6, the evaluation of the effect of the proposed use causing an increase in flood heights is based not just on the effect of the single use acting alone, but upon the reasonable assumption that other landowners within the floodplain may need to be allowed to develop to an equivalent extent within the floodplain. Therefore, the accumulative effects of all such encroachments must be considered by the Commission (and Council) in malting any decision. Staff s opinion on this matter is that allowing additional development will increase the floodplain elevation in the area, but not more than the required 1-foot safety margin. No portion of the proposed development is within the floodway. 1.6 All signage is subject to design review and requires separate permits. No freestanding signs are proposed with this application. If any are proposed in the future, it shall conform to the new Sign Ordinance, as recommended for approval by the Meridian City Council on November 21. This allows for a single freestanding sign not to exceed 70 square feet and 15 feet high, maximum. 1.7 Dimensions of all parking stalls shall conform to minimum dimensions as per city ordinance and ADA. City ordinance requires 9 X 19 standard stalls and 25-foot-wide minimum driveways. The Ada County Highway District (ACHD) staff has received the above referenced application requesting conditional use approval to construct a 16,902-square foot warehouse/office. The 1.32-acre site is located on the east side of Baltic Place at its intersection with King Street. This development is estimated to generate 84 additional vehicle trips per day based on the Institute of Transportation Engineers Trip Generation manual. The application and site plan stamped as received by the City of Boise on December 15, 2000 and was submitted to the District on December 20, 2000, has been reviewed by the ACHD Planning and Development staff, and conforms to applicable District standards/policy, or can be made to conform with the change(s) to the plan described in the requirements stated below. B. This is a staff level approval and will not be heard by the ACHD Commission unless the site plan is changed in such a manner as to not conform with District standards/policy or an appeal of the Planning and Development staff decision is submitted as described within the Standard Requirements outlined below. C. On November December 28, 2000, the District Planning and Development staff inspected this site and evaluated the transportation system in the vicinity. On January 2, 2001, the staff met as the District's Technical Review Committee and reviewed the impacts of this proposed development on the District's transportation system. The results of that analysis constitute the following Facts and Findings and recommended Site Specific Requirements. Paae l MCUP00-OS 7 The following requirements are provided as conditions for approval: Site Specific Requirements: Relocate the proposed northern driveway approximately 52-feet to the south to align with East King Street. 2. Construct the southern driveway as proposed on the site plan. 3. Pave the driveways their full-required width to a point 30-feet beyond the edge of pavement of Baltic Place. 4. If the new improvements are damaged during construction, replace the damaged curb, gutter and/or sidewalk on Baltic Street with new curb, gutter and/or concrete sidewalk to match existing improvements. Segments to be replaced shall be determined by ACHD Construction Services staff. Contact Construction Services at 387-6280 (with file number) for details. 5. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. Contact ACHD's Utility Coordinator at 387-6258 (with file number) for details. Standard Requirements: This decision of the Planning and Development Supervisor may be appealed to the Ada County Highway District Commission by the applicant or by another party within 15 calendar days from the date of this report. The request shall specifically identify each requirement to be reconsidered and include a written explanation of why such a requirement would result in a substantial hardship or inequity. The request will be heard by the District Commission at an evening meeting within 20 calendar days of the District's receipt of the appeal letter. The appellant will be notified of the date and time of the Commission meeting. After ACRD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Planning and Development Supervisor within two days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall specifically identify each requirement to be reconsidered and include written documentation of data that was not available to the Commission at the time of it's original decision. The request for reconsideration will be heard by the District Commission at the next regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #193, also known as Ada County Highway District Road Impact Fee Ordinance. 4. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all Page 2 MCUP00-OS 7 applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 7. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless awaiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 8. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. Conclusion of Law: ACRD requirements are intended to assure that the proposed use/development will not place an undue burden on the existing vehicular and pedestrian transportation system within the vicinity impacted by the proposed development. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY The subject parcel is zoned I-L in Meridian Business and Industrial Park. The proposed use by Big D Builders is deemed a permitted use in the I-L zone. However, the site is also completely within the 100-year floodplain of Five Mile Creek, and is therefore also regulated by the Floodplain District, Chapter 11 of the Meridian Zoning Ordinance. The proposed structure is required to obtain a Conditional Use Permit for the proposed structure as per the City Ordinance 11-11-2. The purpose of the Floodplain Overlay District (FP) is to guide development in floodplain areas throughout the City of Meridian, and to minimise the expense and inconveniences to the individual property owners and the general public through flooding. Authorized uses in the FP district shall not hinder the movement of flood waters. The FP district is superimposed over other zoning districts, wherever a 100-year floodplain exists (see Ordinance 11-11-1). LOCATION & SURROUNDING USES The subject property is at 200 N. Baltic Place (Lot 3 & northerly portion of Lot 4, Block 2} in Meridian Business Park. It is generally located north of Franklin Road, approximately halfway between E. 1 ~` Street and Locust Grove Road. The lot is currently zoned I-L. The property is located in an area designated as Existing Urban in the Comprehensive Plan. The surrounding uses follow: North: multi-tenant building with D&A Glass and Caulking Specialties. South: vacant lot, zoned I-L. East: Masonry Builders Products. West: multi-tenant office/warehouse building and other vacant lots. The sewer and water systems shall be floodproofed and approved by the District Health Dept. of the Department of Health and Welfare as per Ordinance 11-11-3.A.1. An engineer must certify that the floodproofing requirement has been fulfilled as per Ordinance 11-11-3.A.3. 2. Ordinance 11-11-3.A.2 requires that no structure shall be erected unless the main floor is placed a minimum of 1 foot above the elevation of the 100-year floodplain. The elevation of the floodplain on-site is 2611 ft. No finished floor elevation is shown on the submitted plans. The applicant shall verify that the floor elevation of the structure meets this requirement. 3. Materials that are buoyant, flammable, noxious, toxic or otherwise potentially injurious if transported by floodwaters are prohibited as per Ordinance 11-11-5. Storage of any materials or equipment not having these characteristics is permissible only if they have low damage potential and are anchored or are readily removable from the area. 4. Conditions that may be required by the Commission [and Council] per Ordinance 11-11-4 in approving structures in a Floodplain Overlay Zone through the Conditional Use Process include: a. Limitations on periods of use and operation; b. Imposition of deed restrictions; c. Location and arrangement of structures within the floodway and floodway fringe areas to avoid an increase in flood heights during the recurrence of the 100-year flood discharge; d. Requirement for construction of channel modifications, dikes, levees and other protective measures; e. Placement of survey benchmarks; and f. Additional floodproofing measures. 5. According to Ordinance 11-11-6, the evaluation of the effect of the proposed use causing an increase in flood heights is based not just on the effect of the single use acting alone, but upon the reasonable assumption that other landowners within the floodplain may need to be allowed to develop to an equivalent extent within the floodplain. Therefore, the accumulative effects of all such encroachments must be considered by the Commission (and Council) in making any decision. Staffs opinion on this matter is that allowing additional development will increase the floodplain elevation in the area, but not more than the required 1-foot safety margin. No portion of the proposed development is within the floodway. 6. All signage is subject to design review and requires separate permits. No freestanding signs are proposed with this application. If any are proposed in the future, it shall conform to the new Sign Ordinance, as recommended for approval by the Meridian City Council on November 21. This allows for a single freestanding sign not to exceed 70 square feet and 15 feet high, maximum. CUP-00-057 Big D Builders.CUP.doc Mayor, Council and P&Z January 12, 2001 Page 3 7. Dimensions of all parking stalls shall conform to minimum dimensions as per city ordinance and ADA. City ordinance requires 9 X 19 standard stalls and 25-foot-wide minimum driveways. ADA requires the van-accessible handicap-accessible stall to have a striped aisle separate from the stall (typically an 8-foot stall and an 8-foot aisle). The handicap parking space must have van- accessible signage per ADA standards. 8. It appears that the landscaping shown on the plan is based on the old ordinance of one 3"-caliper tree per 1,500 s.f. of asphalt. The site plan must be modified to conform to the new Landscape Ordinance, Section 12-13. This will require adding a landscape buffer along all side and rear lot lines adjacent to a vehicular use area. Applicant must submit a modified site/landscape plan that conforms with the Landscape Ordinance when applying for a Certificate of Zoning Compliance. 9. All required improvements must be complete prior to obtaining a Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a letter of credit or cash in the amount of 110% of the cost of the required improvements (including paving, striping, landscaping, and irrigation). A bid must accompany any request for Temporary Occupancy. 10. Assessments for sewer and water service are determined during the building permit application process. Applicant will be required to enter into an Assessment Agreement with the City of Meridian. An assessment agreement is a vehicle that protects the City of Meridian and the Developer in the event that estimated assessments are not in line with actual usages. The agreement provides for reimbursement to the developer for overpayment of assessments and payment to the City of Meridian of any shortfall in assessments. The overpayment/shortfall is determined after adequate historical usage. 11. In accordance with City Ordinance 12-13-8-1, underground year-round pressurized irrigation must be provided to all landscape areas on site. Applicant shall be required to utilize any existing surface or well water for the primary source. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the landscaped areas. Applicant shall submit irrigation performance specifications in compliance with Ordinance 12-13-8-2 when applying for a Certificate of Zoning Compliance. GENERAL REQUIREMENTS 1. Off-street parking shall be provided in accordance with Section 11-13 of the City of Meridian Zoning and Development Ordinance and/or as detailed in site-specific requirements. 2. Paving and striping shall be in accordance with the standards set forth in Sections 11-13-4.D. and 11-13-4.E. of the City of Meridian Zoning and Development Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements. 3. A drainage plan designed by a State of Idaho licensed architect or engineer is required and CUP-00-057 Big D Buildets.CUP.doc Mayor, Council and P&Z January 12, 2001 Page 4 shall be submitted to the City Engineer per City Ordinance 11-13-4.B.4 for all off-street parking areas. All site drainage shall be contained and disposed of on-site. 4. Outside lighting shall be designed and placed so as to not direct illumination on any nearby residential areas and in accordance with City Ordinance Section 11-13-4.C. 5. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Sections 9-1-4 and 9-4-8. Wells may be used for non-domestic purposes such as landscape irrigation. 6. All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing or lying adjacent and contiguous to the parcel shall be tiled per City Ordinance 12-4-13. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. 7. All construction shall conform to the requirements of the Landscape Ordinance 12-13. 8. All trash and/or garbage collection areas shall be enclosed on at least three (3) sides in accordance with City Ordinance Section 11-12-1.C. Coordinate trash enclosure locations and construction requirements with Sanitary Service Company (SSC) and provide a letter of approval from SSC to the Planning & Zoning Department when applying for a Certificate of Zoning Compliance. 9. Provide five-foot-wide sidewalks in accordance with City Ordinance Section 12-5-2.K. 10. All signage shall be in accordance with the standards set forth in Section 11-14 of the City Zoning and Development Ordinance. 11. The Ada County Highway District (ACRD) staff has received the above referenced application requesting conditional use approval to construct a 16,902-square foot warehouseloffice. The 1.32-acre site is located on the east side of Baltic Place at its intersection with King Street. This development is estimated to generate 84 additional vehicle trips per day based on the Institute of Transportation Engineers Trip Generation manual. The application and site plan stamped as received by the City of Boise on December 15, 2000 and was submitted to the District on December 20, 2000, has been reviewed by the ACRD Planning and Development staff, and conforms to applicable District standards/policy, or can be made to conform with the change(s) to the plan described in the requirements stated below, ~ B. This is a staff level approval and will not be heard by the ACRD Commission unless the site plan is changed in such a manner as to not conform with District standards/policy or an appeal of the 1'lam~ing and Development staff decision is submitted as described within the Standard Requirements outlined below. C. On November December 28, 2000, the District Planning and Development staff inspected this site and evaluated the transportation system in the viciiuty. On January 2, 2001, the staff met as the District's Technical Review Committee and reviewed the impacts of this proposed development on the District's transporrtation systen.
