NAMPA MERIDIAN IRRIGATION WILL NOT APPROVE ANY TREE PLANTING IN THEIlt EASEMENT, NOR WILL MERIDIAN SEWER DISTRICT. HOWEVER, NAMPA MERIDIAN WILL ALLOW SHUBERY TO BE PLANTED IN THEIR EASEMENT. 13. ORDINANCE # 11-13-4.B.3---- ONE 3-INCH CALIPER TREE PROVIDED FOR EVERY 1500 SQUARE FEET OF ASPHALT AREA ON THE SITE. 14. THE IRRIGATION AND SEWER EASEMENTS MENTIONED IN #12 COMPRISE 16,582 SQUARE FEET OR APPROXIMATLY 38% OF THE TOTAL PARCEL.( TOTAL PARCEL SIZE IS 43,560 SQUARE FEET) AND APPROXIMATLEY 71% OF THE TOTAL PAVED AND SIDEWALK AREA( TOTAL PAVED AND SIDEWALK AREA IS 23,501 SQUARE FEET). WITH THE RESTRICTIONS OF THE IRRIGATION AND SEWER DISTRICT, AS WELL AS PAVING REQUIRED BY MERIDIAN CITY, THE ORDINANCE # 11-13-4.B.3 IS VIRTUALLY Il~IPOSSIBLE TO COMPLY WITH. 15. EASEMENTS AND REQUIREMENTS MENTIONED IN #'S 12 AND 14 ABOVE. 16. THE LARGE PORTION OF THE PROPERTY THAT IS DEDICATED TO SEWER AND IRRIGATION EASEMENTS IS INDEED UNIQUE AND PECULIAR WHEN COMPARED TO OTHER PROPERTIES OF THIS SIZE IN THE DISTRICT. 17. THE LITERAL INTERPRETATION OF THE PROVISIONS OF THIS ORDINANCE ALONG WITH THE PAVING REQUIREMENTS BY THE CITY WOULD DEPRIVE THE APPLICANTS OF RIGHTS COMMONLY ENJOYED BY OTHER PROPERTIES IN THIS DISTICT UNDER TERMS OF THIS ORDINANCE BY FURTHER REDUCING USEABLE BUILDING SPACE. AS A RESULT OF THE EASEMENTS , PECULAR TO THIS PROPERTY, THE BUILDABLE SPACE AVAILABLE ON THE PROPERTY HAS ALREADY BEEN REDUCED BY APPROXIMATELY 5,950 SQUARE FEET OR 30% OF THE TOTAL PROJECT POTENTIAL WHEN COMPARED TO OTHER COMPARABLE PROPERTIES. 18. THE SPECIAL CONDITONS AND EASEMENTS THAT EXIST WERE NOT A RESULT OF THE APPLICANTS ACTIONS. 19. THE GRANTING OF THE VARIANCE REQUEST WILL NOT CONFER ON THE APPLICANT ANY SPECIAL PRIVILEDGES THAT IS DENIED BY THIS ORDINANCE TO OTHER LANDS, STUCTURES OR BUILDINGS IN THE SAME DISTRICT. IN FACT, THE EXISTING EASEMENTS THEMSELVES LIMIT THIS PROJECT BEYOND COMPARABLE PROJECTS IN THE DISTRICT. 20. N/A 21. $ 286.33 (Z50 + 1.73 x 21) 22. THE GRANTING OF THE VARIANCE WOULD CONVENIENCE THE APPLICANT FROM THE STANDPOINT A LEASEALBE OFFICE/WAREHOUSE/MANiJFACTURING FACILITY COULD BE CONSTRUCTED IN A SUBDIVISION DESIGNATED FOR SUCH USE EVEN THOUGH THE SEWER AND IRRIGATION EASEMENTS THEMSELVES PRESENT LIMITATIONS THAT GREATLY REDUCE BUILDABLE SPACE BASED ON OTHER PROJECTS IN THE AREA. 23.
