AIMONETTO ZONED I -L / (CUP -00-024) FINDINGS OF FACT 1. A notice of a public hearing on the conditional use permit vas published for two (2) consecutive weelcs prior to the said public hearing scheduled for June 20, 2000, before the City Council, the first publication appearing and written notice having been mailed to property owners or purchasers of record within three hundred feet (300) of the external boundaries of the property under consideration more than fifteen (15) days prior to said hearing and with the notice of public hearing having been posted upon the property under consideration more than one week before said hearing and the copies of all notices were made available to newspaper, radio and television stations as public service announcements; and the matter having been duly considered by the City Council at the June 20, 2000, public hearing; and the applicant, affected property owners, and government subdivisions providing services within the planning jurisdiction of the City of Meridian, having been given full opportunity to express comments and submit evidence. 2. There has been compliance with all notice and hearing requirements set forth in Idaho Code §67-6509, 6512, and Meridian City Code §§ 11-15-5 and 11-17-5 as evidenced by the Affidavit of Mailing, and the Affidavit of Publication and Proof of Posting filed with the staff report. 3. This proposed development request is in an I -L zone, by reason of the provisions of the Meridian City Code § 11-17-4, a public hearing was required before the City Council on this application. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY JAMES L. AIMONETTO ZONED I -L / (CUP -00-024) - 2 4. The property is located at 2204 Lanark Street, Meridian, Idaho. 5. The owner of record of the subject property is James L. Aimonetto of Boise. 6. Applicant is owner of record. 7. The subject property is currently zoned I -L. The zoning district of I -L is defined within the City of Meridian Zoning and Development Ordinance, Section 11-7-2. 8. The proposed application requests a conditional use permit for placement of a temporary office trailer for 24 months. The I -L zoning designation within the City of Meridian Zoning and Development Ordinance requires a conditional use permit be obtained for most uses including those requested by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-8-1). 9. The Meridian Planning and Zoning Commission recognizes that the proposed application is in compliance with the Meridian Comprehensive Plan. 10. The use proposed within the subject application will in fact, constitute a conditional use as determined by City Ordinance. 11. The Meridian City Council takes judicial notice of its Zoning, Subdivision and Development Ordinances codified at Titles 11 and 12, Meridian City Code and all current zoning maps thereof and the Comprehensive Plan of the City of Meridian, and Maps and the Ordinance establishing the Impact Area Boundary. 12. Giving due consideration to the comment received from the governmental subdivisions providing services in the City of Meridian planning jurisdiction public FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY JAMES L. AIMONETTO ZONED I -L / (CUP -00-024) - 3 facilities and services required by the proposed development will not impose expense upon the public if the following conditions of development are imposed and the following is also found to be required to mitigate the effects of the proposed use and development upon services delivered by political subdivisions providing services to the subject real property within the planning jurisdiction of the City of Meridian: Adopt the Recommendations of the Planning and Zoning and Engineering staff as follows: 12.1 Sanitary sewer and water to this facility would be via existing service lines. Assessments for sewer and water service are determined during the building permit application process. Applicant shall be required to enter into an Assessment Agreement with the City of Meridian. 12.2 No signage was submitted, and none is approved with this application. Signage shall be subject to design review and shall require separate permits. No temporary banners, flags, or signage will be approved under this conditional use permit. 12.3 The applicant shall be required to meet the setbacks of the I -L zone. The temporary building shall be located a minimum of 35 feet from the front property line. 12.4 The Evans Drain and Gruber Lateral are within/adjacent to the northern portion of the property. The Evans Drain is the same drain that abuts R. C. Willey and Wheel City. City Ordinance 12-4-13 requires the piping of all existing irrigation/drainage ditches. The ditches to be piped shall be shown on the site plans. Plans shall be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Worlcs Department. Unless otherwise approved by City Council, the applicant shall be required to submit a bid for the tiling and a letter of credit or cash in the amount of 110% of the cost of piping prior to obtaining occupancy of the temporary building. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY JAMES L. AIMONETTO ZONED I -L / (CUP -00-024) - 4 12.5 All construction shall conform to the requirements of the Americans with Disabilities Act. 12.6 No trash enclosure is shown on the plan. Applicant shall coordinate the location and construction requirements of the required trash enclosure with Meridian Sanitary Service, Inc., and provide a letter of approval from their office when applying for a temporary Certificate of Zoning Compliance. All trash areas are to be enclosed by a screening fence. 12.7 Submit a letter of plan approval from Ada County Highway District when applying for a temporary Certificate of Zoning Compliance. 12.8 Future construction of the permanent building shall meet all Ordinance requirements in existence at the time the building permit is applied for. 12.9 This conditional use permit shall be subject to review upon ten (10) days notice to the applicant. Transfer of the conditional use permit shall be submitted and approved by the Zoning Administrator for any new owners/tenants. 12.10 Provide the Public Works and Fire Departments with information on the method of fire protection to be used for the modular trailers. 12.11 Applicant shall obtain a temporary Certificate of Zoning Compliance and Occupancy Certificate for the modular trailers. 12.12 A maximum twelve (12) month time extension (starting from date of occupancy) shall be allowed. 12.13 This parcel is adjacent to the Union Pacific Railroad. This corridor is designated as a multiple use pathway in the Meridian Comprehensive Plan. Future plans to be submitted with the application for building permit shall need to incorporate landscaping along this corridor. 12.14 The numbered notes shown do not match the site plan. When applying for a temporary Certificate of Zoning Compliance, submit revised plan to correct errors and incorporate additional conditions of approval. Adopt the Recommendations of the Fire Department as follows: 12.17 The lot shall withstand a 70,000 lb. Emergency vehicle. Adopt the Recommendations of the Ada County Highway District as follows: 12.18 Future design plans and construction shall be in accordance with the ACHD Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived in writing by the District. 13. The proposed uses within the subject application will be harmonious with and in accordance with the Meridian Comprehensive Plan and the City of Meridian Zoning and Development Ordinance because: 13.1 The subject property is designated on the "Generalized Land Use Map" as "Existing Urban". 14. The uses proposed within the subject application subject to the conditions herein ordered will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance or intended character of the general vicinity and that such uses will not change the intended essential character of the same area. 15. The uses proposed within the subject application will not be hazardous or disturbing to existing or future neighboring uses. The uses proposed within the subject application will be served adequately by central public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water, and sewer. 17. The uses proposed within the subject application will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors. 18. The development will not result in the destruction, loss or damage of natural or scenic feature of major importance relating to the property. CONCLUSIONS OF LAW 1. The City of Meridian shall exercise the powers conferred upon it by the "Local Land Use PlanningAct of 1975" hereinafter referred to for convenience as the "Act" codified at Chapter 65, Title 67, Idaho Code (I.C. §67-6503). 2. The Meridian City Council may exercise all the powers required and authorized under the "Act" except the power to adopt ordinances by the establishment of a Planning and Zoning Commission by ordinance pursuant to Idaho Code Section 67- 6504 which the City Council of the City of Meridian has established by the passage of the "City of Meridian Zoning and Development Ordinance" at Titles XI and XII, Chapter I, Meridian City Code. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY JAMES L. AIMONETTO ZONED I -L / (CUP -00-024) - 7 3. As part of a zoning ordinance the City Council can, subject to hearing and notice provision required, provide for the process of special and/or conditional use permits which a proposed use is otherwise prohibited by the terms of the ordinance but allowed with conditions under the specific provisions of the ordinance which the City of Meridian has done in the adoption of its zoning ordinances. 4. The City Council has the duty and responsibility to review the facts and circumstances of each application for special use permit to determine prior to granting the same that the evidential showing supports the finding that the following standards are met and that the proposed development: (Meridian City Code § 11-17-3 ) a. Will, in fact, constitute a conditional use as determined by City policy; b. Will be harmonious with and in accordance with the Comprehensive Plan and this Ordinance; C. Will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area; d. Will not be hazardous or disturbing to existing or future neighboring uses; e. Will be served adequately by essential public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such services; f. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY JAMES L. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; h. Will not result in the destruction, loss or damage of a natural or scenic feature of major importance. 5. Prior to granting a conditional use permit in a Light Industrial District (I -L), a public hearing shall be conducted with notice to be published and provided to property owners or purchasers of record within three hundred feet (300') of the external boundaries of the land under consideration for the conditional use permit all in accordance with the provisions of Meridian City Code § 11-17-5 City of Meridian Zoning and Development Ordinance, which provides as follows: "Prior to approving a Conditional Use Permit, the applicant and the Commission and Council shall follow notice and hearing procedures provided in Chapter 15 of this Title. Provided, however, that conditional use applications for land in Old Town and in industrial and commercial districts shall only be required to have one public hearing which shall be held before the Planning and Zoning Commission; and after the recommendation of the Commission is made, the application shall go before the City Council without a public hearing and the Council may approve, deny, or modify the recommendation of the Commission." 6. Following the public hearing and within 45 days after the conclusion of the public hearing the Commission shall, transmit its recommendations to the Meridian City Council with supportive reasons. The Commission shall recommend that the application be approved, approved with conditions or denied. When the City Council approves a conditional use permit it may impose conditions of that approval that reasonably: A. Minimize adverse impact on other development; B. Control the sequence and timing of development; C. Control the duration of development; D. Assure that the development is maintained property; E. Designate the exact location and nature of the development; F. Require the provision for on-site public facilities or services; and G. Require more restrictive standards than those generally required, in this Ordinance. 8. The City of Meridian has, by ordinance, established the Impact Area and the Comprehensive Plan of the City of Meridian, which was adopted December 21, 1993, Ord. 629, January 4, 1994 and Maps. No temporary banners, flags, or sign age will be approved under this conditional use permit. 2.3 The applicant shall be required to meet the setbacks of the I -L zone. The temporary building shall be located a minimum of 35 feet from the front property line. 2.4 The Evans Drain and Grubber Lateral are within/adjacent to the northern portion of the property. The Evans Drain is the same drain that abuts R. C. Will ey and Wheel City. City Ordinance 12-4-13 requires the piping of all existing irrigation/drainage ditches. The ditches to be piped shall be shown on the site plans. Plans shall be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. Staff first, please. Stiles: Mr. Mayor and Council, this is for the property that you previously looked at; a temporary variance on the landscaping and paving portions of the project. You have the recommendations from the Planning and Zoning Commission. The applicant has submitted his position statement requesting deletion of some of those conditions. I'll go over those. He's asked for deletion of the tiling requirement, the Evans Drain — *** End of Side 3 *** Stiles: -- adjacent to this property and our Ordinance does require piping of those ditches. RC Willey and Wheel City have both submitted bonding or letters of credit for piping of that drain in the future. The applicant lists as one of the reasons not to pipe was that Jabil was not required to pipe. That was quite a different situation as they did make an amenity of that lateral and have a pathway along it. So staff would not recommend approval of deleting that Item 1.4. Item 1.5 he has asked for a deletion of that. I think there was a little confusion when the site — there was a plan that was submitted that does not meet Ordinance requirements, but we thought that was submitted in an attempt to at least provide some paving and landscaping for the project. It would in no way meet any Ordinance requirements, but I think that is why that landscaping — well, I'm getting ahead of myself. Sorry. The off-street parking; that is approved temporarily not to be paved. We would not have a problem with deleting that. He has asked for a deletion of Item 1.6, all construction shall conform with the requirements of Americans with Disabilities Act. Staff cannot remove that condition as it's a federal requirement. We have no authority to do otherwise. Item 1.9, this is where the confusion came up because of the plan that was submitted with the Conditional Use Permit, they do show a small, paved area next to the temporary trailer, and also a 15 -foot landscape setback with some trees. I think that because this was submitted with the application, we thought they were proposing at least as a minimum to provide this, but apparently they're not proposing to provide anything at this time. We would not approve of deleting Meridian City Council Meeting June 20, 2000 Page 46 that entire section 1.9 because future construction of the permanent building will need to meet any Ordinance requirements in effect at the time the permit's applied for. Item 1.10, he's asked for deletion of that. We ask that remains there, that it would be subject to review upon 10 days' notice. This is a typical comment that we add to these Conditional Use Permits. We did make an error in having some comments from a previous application, so on Item 1. 10, the second and third sentences of that paragraph should be stricken because they don't apply to this, and the transfer, we would still ask that that needed to be approved. They have asked for a 24 -month occupancy, and the recommendation is for a maximum of a 12 -month period and that they would need to be at least under construction with the permanent building at that time and meet all the landscaping and paving and Ordinance requirements at that time. That's all I have. Corrie: Applicant, Mr. Aimonetto, here? Glencoe: Mayor, members of the Council, my name is Matthew Glencoe; 1011 North Maple Creek Avenue. My office is at 24 South Cole, Suite B in Boise. Yes, as we initially approached this, it was with a 24 -month timeframe to construct and do all the planning. We figured that will be fine and also the reason for the initial proposals on the landscape as it was initially proposed was within 24 months we could get a little done and then give us the time that we would need to get those done. Obviously, our timeframe that we've had to operate has been substantially crunched, so instead of investing the time to worry about the paving and the landscaping, now, I think we can just delve right into full construction and plus the fact that we've already been given an extension on landscaping and paving anyway. So the idea is, at least for my operation, most circumstances and developments are not useful to the owner of the property until some development takes place. My situation is unique in that I really only need the lot and a place to run my office, and they ideally need to be on the same spot. That's one of the reasons we selected this site. It was because we knew that as we're getting things up and running it would serve us in this interim period. Again, we were hoping for 24, but we're committed to being here and being part of Meridian. Again, you know, as I live here, I was instrumental in selecting Meridian, the site of this; we were looking in Nampa and in Boise. It made sense in Boise on a business standpoint, but it also made sense personally. So as far as how it was written and hwy, I was asking for 1.5, 1.6 and 1.9 to be set aside as in relation to the fact that I will just dive in, get a permanent building on site within the next 12 months and then we don't have to fool around with figuring out how to get some landscaping in front and pave a little bit of that. As far as the ADA requirement, that was basically — I haven't seen a single trailer yet that has a ramp up to it. I even asked the people — we're working with two different companies who would supply us with the trailer, and I asked them if we could rent some ramps, and they said they hadn't even had a request for that. That's why I included that comment about the ADA requirement that it being a temporary structure that I was thinking we probably would be able Meridian City Council Meeting June 20, 2000 Page 47 to sidestep that for the time being. Obviously, any permanent thing has got to be in compliance, and that's not a problem. I'm not asking for any special things. I'm just asking for an opportunity to kind of get things up and running. I'm open to any questions. Anderson: I don't have any questions, but I know ADA, whether it's temporary or permanent, it's not a thing you can get around. It has to be done. Glencoe: How then do other structures that construction sites, trailers and that sort of thing- I'm just going basically off of what I've seen in my experience. Bird: Is yours open to the public? Glencoe: No. Bird: It's strictly for employees? Glencoe: Yes, just employees. Bird: That's how construction trailers get away with it. That's how my trailer gets away with it. Glencoe: I don't have any reason to have customers come to me because that's not my job. I go and take my stuff to them. The other thing, as far as tiling goes, I guess at least the issue being it's many — nobody knows when that thing is actually going to be accomplished. So that's why I was asking for the (inaudible) or exemption or whatever is the process to deal with that. Like I said, I noticed the other situation with the fence, staff mentioned that in the case of Jabil they were making a through -way. I think it's one of the last items in this, No. 1.14 indicates it's part of the Meridian Comprehensive Plan to — yes, multiple -use pathway is part of that anyway. It sounds like that's part of the deal anyway already. Who knows when that will happen. DeWeerd: Mr. Mayor, can Shari address that? The other occupants that are not tied in have bonded for it in case it's in the future required or how is that working? Stiles: RC Willey and Wheel City USA bonded for it. DeWeerd: But you don't know if it will ever be tiled or if it will eventually be improved? Stiles: I think that's something the City needs to look at. That's something that — I've gone out there behind Wheel City USA and it looks like ground water is percolating up from the ground. DeWeerd: So you can't Meridian City Council Meeting June 20, 2000 Page 48 Stiles: Well, you can still pipe it. Nampa Meridian Irrigation District has indicated that you can pipe it with perforated pipe or with open -joint concrete. It's not that it can't be or that they won't allow it, but I just don't have the expertise on that to really address whether we should or not, but it's probably something that we should get somebody that is knowledgeable about those drains and whether it's something that we want to be piped. Bird: Mr. Mayor, I agree with you, Shari, and I think that Gary or Charlie Rountree talked to the Corps regarding that deal about — maybe Glenn — that talked to somebody that — they did not, would not allow any tile if I remember right. Is that right, Gary? Smith: I don't recall specifically, Councilman Bird. I think it was either no tile or it had to be tiled such that it would function as a drain. Bird: Maybe that was it. Smith: Either perforated pipe or open -joint concrete like Shari says. One way or the other. I just don't remember for sure how it was exactly. I remember that we ran into this tiling of Nine Mile Drain through the subdivisions off of Locust Grove, and in that case the Corps would not allow them to be tiled because they still had jurisdiction over that ditch. It did function as a sub -surface drain. DeWeerd: Mr. Mayor, so how would you deal with that condition if you don't know if it can be piped or not? Just put it in the agreement and deal with it when it's decided or — it doesn't seem fair to bond for something that you may not have to do eventually. Stiles: Well, we won't have an agreement on this. It's just Findings of Facts and Conclusions of Law that will be prepared. It's not a Development Agreement or anything like that. I mean, our Ordinance does require piping of drains and ditches. I guess if you say being fair, is it fair to charge the other people that have been in the City to make them bond for it and one not? I think it would be better for us to be consistent. Either we need to return the bonding money back to the other people that have put that money up or — we need to make a decision one way or the other. I guess I wouldn't support leaving it open if they're not going to make it an amenity and put landscaping back there, as these conditions call for, in the future when they come in with their permanent building. I guess that's not an answer either, is it? Nichols: Mr. Mayor, members of the Council, you don't have enough (inaudible) to weigh this type of requirement at this time. It may well be that the source of water in that drainage through agricultural uses that through development may go away. At that time tiling may be appropriate or it might be water that's always going to be there. You don't have the facts in front of you to say that, but, Meridian City Council Meeting June 20, 2000 Page 49 certainly, if this tiling were bonded for by this conditional use application, then it would be later determined that you're not going to make them tile it because it's impossible or impractical and doesn't meet the City's needs, then at that point those bonds can be released. The only thing is, of course, is the applicant has to pay a bond premium now for that. Bird: And they don't get that back Corrie: Any further discussion? Bird: I have none. Corrie: Okay. They're proposing to put another building on this lot. They are not eligible for another split to make it a legal parcel, so they have come in for a Planned Development for two buildings on one lot. We have received — I don't know if you have a copy of it. The applicant has brought this in to me today. I don't have it anywhere in my file. It's a letter from ACHD telling us to disregard their previous correspondence of May 9th that they didn't have any site improvement requirements. And with that, I would ask that the recommendations of Ada County Highway District that appear on the last line of Page 4, and then Items 1.18 through 1.21 be removed as they have rescinded those requirements. They will have to pay impact fees at the time they come in for a building permit. The amount that they show in these recommendations would have applied to the previous building that was built. Applicant Case No. CUP -00-024 RECOMMENDATION TO CITY COUNCIL 1. The property is located at 2204 Lanark Street, Meridian, Idaho. 2. The owner of record of the subject property is James L. Aimonetto of 3. Applicant is owner of record. 4. The subject property is currently zoned I -L. The zoning district of I -L is defined within the City of Meridian Zoning and Development Ordinance, Section 11-7-2. 5. The proposed application requests a conditional use permit for placement of a temporary office trailer for 24 months. The I -L zoning designation within the City of Meridian Zoning and Development Ordinance requires a conditional use permit be obtained for most uses including those requested by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-8-1). 6. The Meridian Planning and Zoning Commission recognizes that the RECOMMENDATION TO CITY COUNCIL - 1 CONDITIONAL USE PERMIT — TEMPORARY OFFICE TRAILER IN I -L ZONE — JAMES L. Assessments for sewer and water service are determined during the building permit application process. Applicant will be required to enter into an Assessment Agreement with the City of Meridian. 1.2 No signage was submitted, and none is approved with this application. Signage will be subject to design review and will require separate permits. No temporary banners, flags, or signage will be approved under this conditional use permit. 1.3 The applicant shall be required to meet the setbacks of the I -L zone. The temporary building shall be located a minimum of 35 feet from the front property line. 1.4 The Evans Drain and Gruber Lateral are within/adjacent to the northern portion of the property. The Evans Drain is the same drain that abuts R. C. Willey and Wheel City. City Ordinance 12-4-13 requires the piping of all existing irrigation/drainage ditches. The ditches to be piped should be shown on the site plans. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. Applicant shall coordinate the location and construction requirements of the required trash enclosure with Meridian Sanitary Service, Inc., and provide a letter of approval from their office when applying for a temporary Certificate of Zoning Compliance. All trash areas are to be enclosed by a screening fence. 1.8 Submit a letter of plan approval from Ada County Highway District when applying for a temporary Certificate of Zoning Compliance. 1.9 The landscaping and paved area shown on the plan (with any required modifications) shall be constructed prior to occupancy. Future construction of the permanent building shall meet all Ordinance requirements in existence at the time the building permit is applied for. 1.10 This conditional use permit shall be subject to review upon ten (10) days notice to the applicant. The current applicant is shown to be the architect, Cole Associates. The applicant should be the owner of the property (Laneyland). AIMONETTO-2204 LANARK STREET: Borup: Steve. Siddoway: Mr. Chairman, Commissioner's this is a property that is on East Lanark Street. This would be Nola Road. Locust Grove here. This is Franklin, this is Lanark Street. Back here is where all the buses are and adjacent to that there is an existing lot asphalt right now or maybe gravel. These are site photos. The applicant is requesting a temporary office trailer to be placed on the site. He has requested 24 months. At the last City Council meeting, City Council entertained a variance on this property for landscaping, granted that variance for one year, not two. Therefore we would recommend that the temporary office trailer be approved for a maximum of one year and at that time the temporary uses should be out and the site should be in full compliance with permanent structure and the landscape requirements as required by the City Council. We have asked the temporary trailed be located 35 feet back from the Meridian Planning ani''-)ning Commission May 24, 2000 Page 27 right of way. We would recommend approval with that modification of one year instead of two. Borup: Is the applicant here this evening Glenco: My name is Mathew Glenco. I live at 1011 N. Maple Creek Avenue. I have been in the employ of Mr. Aimonetto for over 4-112 years. I operate a branch of his company here in the Treasure Valley. Borup: Have you had a chance to review staff comments. Glenco: Yes I have. There are a couple of issues I did want to bring up. The first and biggest is item number 6, requiring a bond of (inaudible) percent or cash for the tiling of the drain. Aside from the obvious issues of the financial burden on a small company, the point I'd like to bring up is I've noticed there is similar drain exists to the west of the Jabil facility. That has been fenced rather than tiled. In the interest of consistency, I propose the same sort of requirement be made in this area. The other issue also is that the status of most of the property owners along that stretch of the drain is probably fairly stable and don't expect to have either new development and some of those issues taken place in the near term. At least to my knowledge it is any body's guess how soon the tiling of that could be done, if ever. Borup: Do you know the size that would require. Glenco: Off hand I do not. I do know that drain is quite large. It is probably nearly as big as the one that is there adjacent to the Jabil property. I would be asking for a waiver for that requirement there on number 6. Borup: You understand we are not the ones that can grant that. The reason is that is part of the City ordinance. That would be another variance for City Council. Correct. Siddoway: Correct. Unless the pipe that would be required—if they are not going to tile it, it would require a variance with City Council. Also just to make it clear, he does not have to bond for it with cash. He can bond with a letter of credit as well. Glenco: Regarding the matter of the time frame. When we initially proposed, we sat down with staff before making the purchase on the property. The number of 24 months came up because the realization we are at the very front end of development of the project. The site is such and selected because we can utilize it as it exists now with these very minor modifications. 24 months is simply with recognition of the time we would like to take to plan out the building, get the variances and then construct. So 24 months to plan it and construct it. Twelve is a little unrealistic. If I may, I have some photographs of the property to show what I am proposing is actually not a lot different than what is going on in that neighborhood. We will be more tidy. It is a very large lot. I'll have my office which is the mobile trailer we're talking about. I currently run 4 medium duty rigs which are single axle straight trucks, plus 2 or 3 refrigerated trailer Meridian Planning an, ,)ning Commission May 24, 2000 Page 28 types and then a tractor. Most of our operation will be confined in one small portion of the lot. The other matter is also related to number 16 regarding the corridor for the pathway. In the landscaping of this with the drain there, I don't really have access to where I understand where that pathway would be. Borup: I think they were talking about landscaping on your property. Is that right Steve. Siddoway: The landscaping would be on their own property line adjacent to the railroad right of way as it is deemed a future pathway corridor multiple use. Glenco: I don't have a fence on our side there, but the neighbors do because there is a bit of an easement on the south side of the drain. That is what I have. Borup: Any questions from the commission. Norton: Your business is transferring milk products. Will you be storing milk products on the property. So your permanent building is going to require some refrigeration. Does that take more time to build then just a normal warehouse, for instance. Glenco: Again, I am very early in the stages. I can not see how it would not. A normal warehouse could be a very simple structure. Special provisions need to be made in determining refrigeration. There is a time frame to get a hold of the equipment and then to have it installed. Norton: You have single axle trucks coming to bays to pick up milk products, is that correct. Glenco: Yes. Norton: Only single axle. Glenco: Yes. The trucks that I use to distribute our product are single axle. They come in on larger or dual axle trailer rig. We break out those loads and load them into smaller straight trucks. Brown: Steve, on item 15 you are recommending there not be an extension. I am curious about that. Would the ordinance allow an extension of temporary permit. Siddoway: (Inaudible) 12 months and it would be considered a modification of a conditional use permit which under the current system basically a new conditional use permit they would have to submit. Brown: You don't have any extension provisions in the conditional use permit. Siddoway: No, unless you write them into conditions. For example you could make one of the conditions to the permit that a potential 12 month extension can be granted by Meridian Planning and—",ning Commission May 24, 2000 Page 29 City Council and then apply for that in 12 months. Unless it is specifically stated in this conditional use permit that an extension would not require a new conditional use permit and 12 months from now they wanted to extend, it would require one. Brown: Do you have a substantial completion that you take in that to activate it. Siddoway: I don't think so. In 12 months the temporary trailer goes away. Substantial completion would certainly help their argument for extension to council. Brown: Matt, what is going to be your process. Are you going to build a warehouse. Are you going to pave. What are you looking at. Glenco. The first priority in construction would be the office -1000, 1500 square feet. Issues as far as the warehouse itself, yet to be determined. We have taken a fairly rapid approach to doing this because of circumstances we are faced with as a business. What I am proposing to do on this lot, we've been doing for 3 years but on the property of our main supplier. The conditions there have—we have been reading the writing on the wall for months and feel the need to get off the property. Also to open up new opportunities but I am not too surprised at some point if I get a letter or phone call, we need you off by X. Our first priority was finding a property and securing it then going with the process. So, unfortunately I don't have as many answers as I'd like to. That is why 24 months is more realistic than the 12. Brown: But how long do you anticipate the temporary trailer being there. Glenco: I think 24 would be the outside. Brown: Your going to have the temporary trailer even through the office is going to be built first. Glenco. That would be the first priority. Obviously the trailer would need to be used. Brown: Once the office is done then would the trailer be gone even thought the warehouse might not. Glenco: Oh yes. Barbeiro: The plan is to build a separate office from the warehouse or to build an office in the warehouse? Glenco: I would expect it to be separate buildings because the needs of a warehouse in a construction need to be dock high and things of that. An office would be self contained. There might be a doorway into the warehouse. Barbeiro: It is not unreasonable that you could build an office, later build your warehouse connected to the office and you could have a 1000 square foot (inaudible) Meridian Planning and ning Commission May 24, 2000 Page 30 up within three months from the time you break ground. I think it is reasonable that 12 months because you could have an office up in 90 days. The permitting process would be 2 months and a month to get your architectural up so, 6 months—if you started tomorrow, in 6 months you could have a building up. That gives you an extra 6 months beyond that to get an office up. Glenco: I could take a modular unit such as what I am proposing to use, knock the wheels out from under it and be in compliance as I understand things. I am not sure through since we have talked to architects and gone that route, that is necessarily how we want the final thing to look. We pride ourselves on a high level of quality and our presentation, the way we do business and that is going to carry through. I am saying, don't know. Barbeiro: I never suggested a modular unit. You could do a complete slab (inaudible) building or a — Glenco: Perhaps some of this is based on my ignorance at this point. I am learning as I go. I have never done this before. I would like it to be done in 12 months and the concern is that there be a buffer there so that we get the whole thing plus I would expect if we are building one it would make sense to be doing the other at the same time. Brown: We are trying to help you here. You might not think that. The recommendation is for 12 months and we are trying to get the 24 months but what we are looking at is— lets say in 12 months the trailer is gone and you've got an office. If that is the case then we could recommend to City Council that they do an extension to get your warehouse, which would give you the other 12 months. That is the way I am viewing it. To keep going back to the 24 months keeps telling me well we will just stick with what staff is saying because you don't know what your doing and we don't know what your doing. We have to have some time frame. With the condition and the way I understand what Steve is :oiling me is that at the end of the 12 months you have to file a whole new application and start over. I think that is crazy in my opinion so I am trying to help so that 12 months down the road you just ask for an extension. Borup: Kent I was interested in you statement on if construction had started on the project. Brown: Mr. Chairman, in some of the other jurisdictions that I have dealt with it is a determination that the planning director can make water sewer and maybe some street improvement if those are required, landscaping, they view those as substantial that they are going to do this project so that it doesn't end up like a Smiths grocery store on Fairview. That is what the city realistically is looking at. We just have to have a time frame. Borup: Where do we go from here. Do you see any problem with having the building under construction in 12 months. Meridian Planning anc'")ning Commission May 24, 2000 Page 31 Glenco: I do not see a problem with that. Borup: How you planning on handling the landscaping. That was discussed at City Council last week. You had 12 months on that and your saying even if the building isn't done that you'll have the landscaping done. Glenco: That should not be a problem. Landscaping for the full lot will come into play as we're looking at construction. The initial phase of the landscaping could be done separate from the building. As I understood I need to have the black top and the landscaping completed before I occupy the site and that I see as being doable and then we dig in with the construction. Hatcher: I think under a very conservative approach what your looking for the scope, size of your outfit, would be a phased project and to satisfy everyone's requirements here is that the office space of the project be under construction within a 12 month period. I would encourage you to have it done in 12 months but if it is not done you can come back for an extension of the conditional use permit. That way a simple review. Under a conservative approach being able to —you mentioned attacking the warehouse and the office at the same time. Seeing your not even sure what you want yet. Lots of details to be done and if you try to roll it into one big project I would be skeptical that it would be under construction in 12 months. I would recommend (inaudible) as a phase and I would recommend to you that you immediately get going on a office space so the trailer can be removed. Swatey: Mr. Chairman, may I say a couple things. I hate to say this but I get this strange feeling that we are setting ourselves up for another Cherry Lane problem. I want to go back to Steve on number 15. Didn't you say that City Council just approved a variance for a 12 month period? Siddoway: On landscaping. Swartley: Before we go for another 2-1/2 hours like the last item, these require variances, both number 6 and 15. The CUP is allowed for a 12 month period and then he will have to reapply. Your setting yourself up for the same sort of Cherry Lane problems, I foresee, that had with the golf course. If you saying something along the lines of starting construction, or part of the project being finished, that is too ambiguous of a term. I just wanted to bring that to your attention and I believe staff's recommendations are what should be followed. Brown: Do you have a problem with putting landscaping along your northern boundary. Hatcher: With legal councils comment do you feel that being able to have the office space constructed within 12 months. I see it as a potential but the biggest factor is obviously finances, not so much construction and design and all that. You show the overall size of you building and then work toward that in phases. That is how I would approach to City Council in approving you variance. Barbeiro: Are you open to an addition to that. I would like to include that the temporary office trailer be removed on a certificate of occupancy for an operable office, so if they were to get it done in 9 months, the trailer be removed. Brown: I'd ask the question of staff. Is that a requirement of code to do that? Siddoway: By requiring the trailer to be removed upon occupancy of the office? I think if you had a conditional use permit they'd allow it to stay for 12 months, even if the office was complete. Barbeiro: Okay then pull that. Hatcher: I just had one for staff. I am reading you recommendation on enforcement. If I understand this right, at the end of the 12 month period your means of enforcement would be that utilities be disconnected. You'd cut them off basically at 12 months. Borup: That's if they weren't given an extension. Hatcher: Right. Obviously the extension would have to be approved before that 365th day. This is a application to do a second primary structure at the rear of the property. Basically, staff recommends the approval of the project with the comments submitted. We have had some discussion before the meeting with the applicant. In general no big issues in this one. Borup: Is the applicant or representative here. Wildwood: Susan Wildwood. I am a attorney to practice law with offices in Boise and I am here on behalf of Terrace Plaza, LLC. The only comment we have with regard to the staff comments has to do with paragraph 5 and 6. Staff had questioned the purpose of the 9 foot graveled area west of the proposed building and had recommended that shrubs and trees or sod be placed in that area to provide a cooler effect on the west side and then made additional reference in paragraph 6 with regard to the additional trees that need to be planted in order to meet the minimums for the ordinance. I indicated Tuesday that we would be happy to place those additional trees as recommended in paragraph 5. We would be removing that graveled area and would put the additional landscaping there. It is impossible to know when these or future property owners could be required to participate in this project. Finally, contact with staff at the Nampa -Meridian Irrigation District lead me to believe that they would not approve tiling this drain and lateral. 1.5, 1.6, & 1.9: I have applied for and received a 12 month extension to complete landscaping and asphalting of parking areas on our property. My original request was for a 24 month extension. We will have a permanent structure on our site within the 12 months allowed. Sanitary sewer and water to this facility would be via existing service lines. Assessments for sewer and water service are determined during the building permit application process. Applicant will be required to enter into an Assessment Agreement with the City of Meridian. An assessment agreement is a vehicle that protects the City of Meridian and the Developer in the event that estimated assessments are not in line with actual usages. The agreement provides for reimbursement to the developer for over payment of assessments and payment to the City of Meridian of any shortfall in assessments. The overpayment/shortfall is determined after adequate historical usage. 4. No signage was submitted, and none is approved with this application. Signage will be subject to design review and will require separate permits. No temporary banners, flags, or signage will be approved under this conditional use permit. 5. The applicant shall be required to meet the setbacks of the I -L zone. The temporary building shall be located a minimum of 35 feet from the front property line. 6. The Evans Drain and Gruber Lateral are within/adjacent to the northern portion of the property. The Evans Drain is the same drain that abuts R. C. Willey and Wheel City. City Ordinance 12-4-13 requires the piping of all existing irrigation/drainage ditches. The ditches to be piped should be shown on the site plans. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. Unless otherwise approved by City Council, the applicant shall be required to submit a bid for the tiling and a letter of credit or cash in the amount of 110% of the cost of piping prior to obtaining occupancy of the temporary building. 7. Off-street parking shall be in accordance with the standards set forth in Section 11-13-4 of the City of Meridian Zoning and Development Ordinance and in accordance with the Americans with Disabilities Act (ADA) requirements. All site drainage shall be contained and disposed of on-site. The aisle for the handicapped space shown on the plan needs to be increased to a minimum width of eight feet and appropriate signage provided. 8. All construction shall conform to the requirements of the Americans with Disabilities Act. 9. No trash enclosure is shown on the plan. Applicant shall coordinate the location and construction requirements of the required trash enclosure with Meridian Sanitary Service, Inc., and provide a letter of approval from their office when applying for a temporary Certificate of Zoning Compliance. All trash areas are to be enclosed by a screening fence. 10. Submit a letter of plan approval from Ada County Highway District when applying for a temporary Certificate of Zoning Compliance. The landscaping and paved area shown on the plan (with any required modifications) shall be constructed prior to occupancy. Future construction of the permanent building shall meet all Ordinance requirements in existence at the time the building permit is applied for. 12. This conditional use permit shall be subject to review upon ten (10) days notice to the applicant. The current applicant is shown to be the architect, Cole Associates. The applicant should be the owner of the property (Laneyland). Transfer of the conditional use permit will need to be submitted and approved by the Zoning Administrator for any new owners/tenants. 13. Provide the Public Works and Fire Departments with information on the method of fire protection to be used for the modular trailers. 14. Applicant must obtain a temporary Certificate of Zoning Compliance and Occupancy Certificate for the modular trailers. 15. A maximum timeframe needs to be established for allowing use of the temporary trailers. The C.U.P. application states 24 months as the estimated timeframe. If approved, Staff recommends a maximum approval period of 12 months (starting from date of occupancy). City Council must approve of any time extension beyond 12 months via a modification of the conditional use permit, which modification must be approved prior to the 12 -month expiration date. Staff will not recommend approval of any extension beyond the 12 -month period. If approved, disconnection of sewer and water services at the end of the 12 -month period should be a condition of approval due to the enforcement problems associated with "temporary" uses. 16. This parcel is adjacent to the Union Pacific Railroad. This corridor is designated as a multiple use pathway in the Meridian Comprehensive Plan. Future plans to be submitted with the application for building permit will need to incorporate landscaping along this corridor. 17. The numbered notes shown do not match the site plan. When applying for a temporary Certificate of Zoning Compliance, submit revised plan to correct errors and incorporate additional conditions of approval. Land Use 3.1 Industrial development within the urban service planning area should receive the highest priority. 3.5 Industrial development should be encouraged to locate adjacent to existing industrial uses. Natural Resources and Hazardous Areas 3.1 Protect the potential beauty and recreational trail opportunities of all Meridian waterways. 4.1U Developments contiguous to natural waterways, irrigation canals, laterals and drainage ditches must consider all available information concerning floodplain waterways. 5.7 Runoff shall be controlled on site or integrated into a watershed plan in a manner to maintain natural runoff rates, reduce erosion and road hazards and to maintain the area's water quality and recharge capabilities.
