1. Present Use of the Subject Property:
The property is presently vacant and was vacated approximately sixty (60) days ago by Gem
State Truss Manufacturing.
2. What is intended to be done on or with the property:
The owner proposes to use the property for the transfer of processed milk products and other
perishables. These milk products have been processed into the containers by the processor and
are ready for delivery to retailers and end users. The applicant will pick up the product and
then break down the shipment for delivery to the consumer.
3 The district that pertains to the subject property:
The City of Meridian is the district which pertains to the Subject Property.
4. Characteristics of subject property which prevent compliance with the requirements of
this Ordinance:
It is the intent of the applicant to construct a permanent office/warehouse facility on the
property within twenty-four (24) months. If the applicant were to install the landscaping and
asphalt parking requirements today, much of it would have to be torn up when it came time to
construct the permanent improvements, which would result in an extreme waste of money.
Based on the previous use, the property currently has the current road mix and gravel on the site
in order to hold up under the applicant's proposed use. It is the intent of the applicant to
landscape the frontage next to the street and asphalt an area for employee parking.
5. Minimum requirements of this Ordinance that need to be reduced to permit proposed
use:
The Ordinance requires that landscaping and asphalt be installed prior to applicant's use of the
property. The applicant requests that the landscape and asphalt regulation be deferred so that
applicant can use the property until permanent structures are constructed. It is the intent of the
applicant to landscape the frontage next to the street and asphalt an area for customer parking.
6. Difficulty or hardship which would result if requirements of this Ordinance were applied
to subject property:
The hardship that would result if applicant could not obtain the variance is that applicant would
not be able to use the property because applicant is not in a position to construct any buildings
immediately. Based upon the fact that the property was previously used as a gravel yard for the
construction of trusses, the applicant feels it would be reasonable to utilize the property in its
current condition for up to twenty-four (24) months.
7. Unusual or peculiar circumstances which indicate that regulations of this Ordinance
should not be strictly complied with:
The applicant feels that under the current circumstances in which the property was previously
used as a gravel yard for construction of trusses, storage of materials, and parking, that for the
applicant to continue this use on the property with the gravel surface is not out of the ordinary.
Also, the neighboring uses in the subdivision are not dissimilar to the applicant's request.
Many of the existing users in the subdivision are working with gravel yards without the
requirement of asphalt on their parking areas.
8. Statement that special conditions and circumstances exist which are peculiar to the land,
structure or buildings involved which are not applicable to other lands, structures or
buildings in the same district:
Applicant finds that other uses within the subdivision are similar to the applicant's proposed
use. Applicant feels that special conditions exist, and the applicant would like to utilize the
property for their business in the interim so that business can be conducted at the location while
planning for a permanent office/warehouse facility on the property which, when completed,
would include landscaping and asphalt needed to comply with the City Codes and Regulations.
9. Statement that a literal interpretation of the provisions of this Ordinance shall deprive the
applicant of rights commonly enjoyed by other properties in the same district under
terms of this Ordinance:
Based on the current uses of other users within the subdivision, applicant feels that if they were
not allowed to use the property in its current condition, it would be depriving the applicant of a
use that is enjoyed by others in the existing subdivision.

10. Statement that special conditions or circumstances exist that were not a result of the
applicant's action:
The special conditions that exist is that the applicant is purchasing the property to utilize it for a

Applicant feels that while a variance for the deferral of the landscape and asphalt parking may
not meet the immediate requirement of the Meridian Comprehensive Plan, it does meet the long
term requirement of the Meridian Comprehensive Plan by the applicant providing landscaping
and asphalt surfaces within twenty-four (24) months.
13. A statement of how the granting of the variance would convenience the applicant and how
the applicant would profit therefrom which statement shall also represent whether profit
and convenience is the sole reason why the variance is requested:
By granting this variance, it would allow the applicant to move its business from its current
location in Boise to Meridian and be able to conduct business, which is currently being
restricted because of space and other inefficiencies. The current gravel surfaces of the subject
property is adequate based on the previous use of the site. Applicant feels that deferring the
landscape and asphalt requirement on the property is economically feasible versus putting down
asphalt parking and landscaping, which most likely would be torn up at the time a permanent

I read the findings on the above mentioned public hearing (item 3# on Planning
and 'Zoning agenda dated May 24, 2000) and believe a correction is in order. Page
32 of'the May 24 minutes reflect that the motion made by Commissioner Kent
Brown specifically included that the temporary building was approved ,for only 12
months (not 24 months.)
It is my opinion that this information would be very help to Meridian Cite, Council
Members. Attached are the pertinent documents.

construction of the permanent building shall meet all Ordinance
requirements in existence at the time the building permit is applied for.

temporary office trailer for 12 month to be placed on the property I -L by James
Aimonetto, 2204 Lanark Street subject to staff recommendations. I would recommend
to the applicant minus the motion that he submit for a variance for that time to be
allowed an extension and I think it applicable that you look at phasing because if you
are totally sure that you have the size of your building, you can be like Food Services
and they are continuing to grow on their building and I know that is why the other
jurisdictions that I have dealt with look at a substantial completion. You show the
overall size of you building and then work toward that in phases. That is how I would
approach to City Council in approving you variance.
Barbeiro: Are you open to an addition to that. I would like to include that the temporary
office trailer be removed on a certificate of occupancy for an operable office, so if they
were to get it done in 9 months, the trailer be removed.
Brown: I'd ask the question of staff. Is that a requirement of code to do that?
Siddoway: By requiring the trailer to be removed upon occupancy of the office? I think
if you had a conditional use permit they'd allow it to stay for 12 months, even if the office
was complete.
Barbeiro: Okay then pull that_
Hatcher: I just had one for staff. I am reading you recommendation on enforcement. If
I understand this right, at the end of the 12 month period your means of enforcement
would be that utilities be disconnected. You'd cut them off basically at 12 months.
Borup: That's if they weren't given an extension.
Hatcher: Right. Obviously the extension would have to be approved before that 365th
day.

of the 9 foot graveled area west of the proposed building and had recommended that
shrubs and trees or sod be placed in that area to provide a cooler effect on the west
side and then made additional reference in paragraph 6 with regard to the additional
trees that need to be planted in order to meet the minimums for the ordinance. 1
indicated Tuesday that we would be happy to place those additional trees as
recommended in paragraph 5. We would be removing that graveled area and would put
the additional landscaping there. That is the only thing we would add to the staff
comments.

This matter coming on regularly before the City Council on the 16th day of
May, 2000, upon the Applicant's time request for a twenty-four (24) month
extension within which to complete the landscaping and asphalting of the parking lot
located at 2204 E. Lanark Street, Meridian, Idaho, and good cause appearing:
IT IS HEREBY ORDERED AND THIS DOES ORDER THAT:
The above named Applicant is hereby granted a twelve (12) month extended
ORDER GRANTING A TWELVE (12) MONTH
TIME EXTENSION FOR LANDSCAPING/ PAGE 1 OF 2
ASPHALTING (VAR -00-009)
period of time from the date of this Order within which to complete the landscaping
and asphalting of the parking lot located at 2204 E. Lanark Street, Meridian, Idaho, a
complete legal description is described as set forth in Exhibit "A" attached hereto and
consisting of one page, for the above entitled request.
The Applicant shall malce sure the parking lot asphalt will be able to support
the weight of a 70,000 pound emergency vehicle. Additionally, the ACHD shall
review the Site Plan and if there are any changes or any future design plans and
construction then it shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived in writing
by the District.

The Ada County Highway District (ACHD) staff has received and reviewed the application and site
plan for the item referenced above. ACHD does not have any site improvement requirements at
this time. The ACHD Commission will not hear this item unless the site plan is changed in such
a manner as to require Commission review.
All future design plans and construction shall be in accordance with the Ada County Highway
District Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived in writing by the District.
Contact Ms. Joyce Newton for payment of possible road impact fees prior to building construction
in accordance with Ordinance #193, also known as the Ada County Highway District Road Impact

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the City Council of the City of Meridian will hold
a public hearing at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, at the
hour of 7:30 p.m. on May 16, 2000, for the purpose of reviewing and considering the
application of James Aimonetto for variance request to defer landscaping and
asphalting of the parking lot for up to 24 months to allow applicant to design and
construct a building on the property located at 2204 E. Lanark Street in an I -L zone.
A more particular description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Street, and is available for inspection during
regular business hours.
A copy of the application is available upon request. Any and all interested
persons shall be heard at said public hearing and the public is welcome and invited to
submit testimony.
