THIS FIRST ADDENDUM TG DEVELOPMENT AGREEMENT is dated this ~ to day

Winchester Street, Suite #200, Salt Lal~e City, CJtah 841 d7, hereinafter called
OWNERIDEVELOPER.

A, City and FORMF,I~ OWNER entered into that ee~•tain Development
Agreement that was recorded on April 2, 2012 in the real property reca~•ds of A,da County as
Instrument No. 112033247 ("DE~IELOPMENT .AGREEMENT") on the parcel of property as
described in Exhibit A.
B. City and OWNE~IDE~TELOPER now desire to amend the Development
Agreement, which terms have been app~•oved by the Meridian City Council in accordance with
Idaho Code Section 67-6511,

successors shall not meet the conditions of this First Addendum as herein provided, and the
ordinances of the City of Me~•idian that are consistent with the terms of the Development
Agz•een~ent and this First Addendum,
3. 7f any provision of this Fi~•st Addendum is held not valid by a court off' competent
jurisdiction, such provision shall be deemed to be excised fiorn this First AddendL~rn and the
invalidity the~•eof shall not affect any of the other provisions contained het•ein•
~. This First Addendum sets Earth alI promises, inducements, agreements, condition, and

amended without the approval of the City Council after the City has conducted public
hearings} in accazdance with the notice provisions provided for a zo}ling designation
and/or arnendrnent in force at the time of the proposed amendment.
5. This First Addendum shall be effective as of the date herein above written.

shall remain in full force and effect,
