The applicant, Ron Larson, requests certificate of zoning compliance (CZC) approval to construct a new
884 square foot addition to an existing 4,416 square foot building located at 32 E. Bower Street. The
purpose of the addition is to extend the enclosed storage area for the building.
Currently, the subject property is developed with three (3) existing buildings:
Building A - 4,416 square feet
Building B - 6,000 square feet
Building C - 6,000 square feet
Due to the MSC II project, one of the existing 6,000 square foot warehouse buildings must be demolished
(see attached site plan).
The subject property is 0.69 acres, zoned O-T (Old Town).
NOTE: The present uses (contractor's yard and warehouse) on the site are defined as non-conforming
under UDC 11-1A-1. Typically, the UDC requires a conditional use permit to enlarge a structure
containing anon-conforming use. With the loss of the building, the amount ofnon-conformity on the
property has been decreased and the addition of the enclosed storage area does not increase the amount of
non-conformity that existed prior to the MSC II project. For this reason, the director finds the site has not
extended the non-conformity and approves the building addition without requiring procurement of a
conditional use permit.
Further, the O-T district requires new construction to be a minimum of two stories in height. The
proposed addition is an expansion of the existing storage area. The UDC requires accessory outdoor
storage to be incorporated into the overall site design so visual impacts of these functions are fully
contained and screened from view of adjacent properties, railway corridor and public streets. Currently,
the yard is screened with chainlink fencing with slats which does not meet the screening requirements in
the UDC. For this reason, the director has determined the use of the addition is to provide screened
storage along the railway corridor thus two story construction is not applicable and approves the
submitted single-story elevations as proposed.
DECISION
The applicant's request for CZC is approved with the conditions listed in this report.

need a building permit and/or inspection. If you need a building permit, you must complete that
process before you commence the use or construction. As part of the application submittal, you must
provide these plans in PDF format and hardcopy as specified in the Building Services "Plan Intake
Checklist': Please contact Building Services for additional details about building permits and
inspections.

Process Conditions of Approval
1. No signs are approved with this application. Prior to installing any signs on the property,
the applicant shall submit a sign permit application consistent with the standards in UDC
Chapter 3 Article D and receive approval for such signs.
2. The applicant shall complete all improvements related to public life, safety, and health as
set forth in UDC 11-SC-3B. A surety agreement maybe accepted for other improvements
in accord with UDC 11-SC-3C.
Upon installation of the landscaping and prior to inspection by Planning Department staff,
the applicant shall provide a written certificate of completion as set forth in UDC 11-3B-
14A.
4. The site plan is approved (stamped "approved" on 10/02/12 by the City of Meridian
Planning Department) with no changes.
5. The building elevations are approved (stamped "approved" on 10/02/12 by the City of
Meridian Planning Department) with no changes.
6. The approved site plan and building elevations shall not be altered without prior written
approval of the City of Meridian Planning Department.
7. The applicant shall pay any applicable impact fees prior to the issuance of a building
permit.
8. If any changes must be made to the site plan to accommodate ACRD requirements, the
applicant shall submit a new site plan to the City of Meridian Planning Department for
approval prior to issuance of the building permit.
9. The applicant shall complete all required improvements prior to issuance of a Certificate of
Occupancy. It is unlawful to use or occupy any building or structure until the Building
Official has issued a Certificate of Occupancy.
Ongoing Conditions of Approval
1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that
meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping
as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14.
2. The project is subject to all current City of Meridian ordinances and previous conditions of
approval associated with this site.
3. The issuance of this CZC does not release the applicant from any previous requirements of
the other permits issued for the site.
4. The applicant has a continuing obligation to comply with the outdoor lighting provisions as
set forth in UDC 11-3A-11.
5. The applicant shall comply with the accessory outdoor storage standards as set forth in
UDC 11-3A-14.
CITY COUNCIL REVIEW
The applicant or a party of record may request City Council review of a decision of the Director. All
requests for review shall be filed in writing with the Planning Department on or before 10/17/12, within
fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-SA-6B.

If City Council review of the decision is not requested, the action of the Director represents a final
decision on a land use application. You have the right to request a regulatory taking analysis under Idaho
Code 67-8003.
EXPIRATION
Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure
shall expire if said construction or alteration has not commenced within one year of the date of issuance
of the Certificate of Zoning Compliance.
The subject Certificate of Zoning Compliance is valid until October 2, 2013.

Please find listed below a "narrative" describing the reason for the need for this 26 ft x 36 ft
building addition.
Due to the Meridian split corridor project, ACRD purchased one (1) of our three (3) existing
buildings (50 ft x 120 ft), which is currently being demo-ed to make way for the new split
corridor road. A portion of this building was used by us, Viking Automatic Sprinkler Co. to
store our tools and ladders.
Due to the loss of this valuable storage space, we were forced to build a new 26 ft x ;i~~
building addition on the North end of our existing building to store and secure our business
tools and ladders.
This new addition, structure, roof, siding an color will match our existing building, so as not
to look like an add-on.
