Bears, Bolts and Bodies~~ CERTIFICATE OF ZONING COMPLIANCE DATE: October 2, 2012 TO: Barry Blessin FROM: Bill Parsons, Associate City Planner SUBJECT: Bears, Bolts and Bodies -CZC-12-070 OWNER: Barry Blessin DESCRIPTION OF APPLICANT'S REQUEST ~E IDIZ IAN ~J The applicant, Barry Blessin, requests Certificate of Zoning Compliance (CZC) approval to convert a portion of the parking/paved area into accessory outdoor storage. Parking is being reduced on the site however; two (2) stalls will remain consistent with the parking standards set forth in UDC 11-3C-6B. The applicant conducts long term vehicle restoration and has no employees thus the additional parking is not necessary. To address code violations on the site, the outdoor storage area is required to screen the dismantled vehicles being stored on site from public view. The site is 0.20 acre in size, zoned I-L (Light Industrial District). Per UDC 11-3A-14, accessory outdoor storage is allowed for an approved use subject to specific standards. The applicant received CZC approval for a vehicle repair (major) facility in 2001. The subject property is located at 343 E. Bower Street. DECISION The applicant's request for CZC is approved with the conditions listed in this report. Site Specific Conditions of Approval 1. The site/landscape plan prepared dated 08/28/01, labeled Sheet 1, is approved (stamped "approved" on 10/02/12 by the City of Meridian Planning Division Department) with no changes. 2. The site/landscape plan shall not be altered without prior written approval of the City of Meridian Community Development Department. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and any applicable conditions of approval associated with this site (CZC-01-011). Conditions Document Bears Bolts and Bodies Auto Body CZC 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant shall comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3B. 7. The applicant shall comply with the accessory outdoor storage standards as set forth in UDC 11- 3A-14. 8. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the approved vehicle repair (major) use as set forth in UDC 11-4-3-37. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before October 17, 2012, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11- SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. In accord with the above provisions, the subject Certificate of Zoning Compliance is valid until October 2, 2013. EXHIBITS A. Vicinity Map B.
