This Department would recommend deferral until high seasonal ground water can be determined if other considerations indicate approval. ^ 11. If restroom facilities are to be installed, then a sewage system MUST be installed to meet Idaho State Sewage Regulations. ^ 12. We will require plans be submitted for a plan review for any: ^ food establishment ^ swimming pools or spas ^ child care center ^ beverage establishment ^ grocery store ^ 13. Infiltration beds for storm water disposal are considered shallow injection wells. ITD has the following comments: 1) ITD has no objection to the proposed zoning and annexation request. The proposed change does not require access to the State Highway System. 2) The existing right-of--way abutting this parcel on SH-55 (Eagle Road) is 70-ft. ITD has improved the abutting section of SH-55 and additional right-of--way is not required. 3) We believe that there is an error in the legal description for the property as supplied in the development application. A southwest corner of the parcel has been purchased by others and has been dedicated to ITD for the signal pole installation. 4) No access to SH-55 is reviewed or approved with this application. 5) ITD has comprehensive rules governing outdoor advertising. The submitted application should conform to the size, location and height requirements of IDAPA 39.03.60. IDAPA also requires that signs not "dazzle or blind" drivers. The current trend toward high intensity signs has caused an increasing number of driver complaints on urban segments of the State Highway System. This applicant should be aware of the issue and plan the sign's lighting strategy accordingly. CUP 12-008: All laterals and waste ways must be protected. The District's Stokesberry courses through this proposed project. The District's easement for the Stokesberry at this location is a minimum of forty-feet (40'), twenty-feet (20') each side of the centerline (facing downstream). However please contact the District directly to verify the width of easement necessary to operate, maintain, and repair the Stokesberry. Please send revised plans showing exactly what proposed encroachments, if any, will be within the District's easement and exactly how far. This easement must be protected. Any encroachment without a signed License Agreement and approved plan before any construction is started is unacceptable. All municipal surface drainage must be retained on site. If any municipal surface drainage leaves the site, the Nampa & Meridian Irrigation District (NMID) must review drainage plans.
