September 5, 2012 Re: Applications for Sgroi Property concerning Modification of the Development Agreement — MDA -12-001 Dear Ms. Watters: We are pleased to submit the enclosed applications associated with the proposed development of the Sgroi Property, located at 4405 East Ustick Road in Section 4 of Township 3N, Range 1E, Ada County. This application requests Meridian's approval of a Development Agreement Modification. The applicant proposes to modify the development plan to include fourteen single-family homes and two townhomes on 2.81 acres of land on an existing R-8 zone. The R-8 zoning district was originally approved October 28, 2008 under AZ -08-011 in which the City Council approved the annexation and zoning application with a requirement of a Development Agreement. On September 27, 2011 City Council approved a request for a Development Agreement Modification MDA -11-007 to allow an extension period for up to two years to sign the Development Agreement, while the owner was in negotiations with prospective buyers for an assisted living facility. The Development Agreement was signed and recorded May 9, 2012 under instrument #112043739. Since the original Development Agreement, required with AZ -08-011, assisted living facilities have saturated the market and there are no potential buyers for the land development at 4405 East Ustick Road. The owner is now requesting to develop lots for single-family detached homes and two townhomes. The Development Agreement is proposed to be modified as follows: Section 5.1.3: The site shall be developed into a residential subdivision consisting of fourteen (14) single-family lots and two (2) townhome lots. Section 5.1.4: The proposed conceptual development plan and building elevations are included as an exhibit with the Development Agreement. The resultant modification to the Development Agreement will achieve several purposes, primarily to construct single-family detached homes with two townhomes that are compatible with the surrounding neighborhood subdivisions and comply with the Comprehensive Plan. The proposed development will comply with current zoning standards in effect for the R-8 zone. The following table indicates the compatibility comparison of Redfeather Estates Subdivision and the Sgroi Property: The quality of home construction and materials within the Sgroi Property will match or in some cases, exceed the quality of home construction within the Redfeather Estates Subdivision. Ingress/egress will be via North Sharon Avenue in Redfeather Estates Subdivision at the south property boundary since access to Ustick Road is prohibited. A 35 -foot landscape buffer will be installed along Ustick Road as required by Entryway Corridor design standards. Open space is not required because the site is less than five acres in size. The Sgroi Property is a good fit to the neighborhood and complies with the intention of the Comprehensive Plan.
