APPLICATION SUMMARY The applicant, The Land Group Inc., is requesting to vacate the public water and sewer easement platted on Lots 10-12, Block lof Southeast Corner Marketplace Subdivision No. 2. 2. STAFF RECOMMENDATION Staff recommends approval of the subject application. 3. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The subject property is located near the southeast corner of E. Ustick Road and N. Eagle Road, in the northwest'/4 of Section 04, Township 3 North, Range 1 East. B. Applicant/Representative: Russ Hepworth, The Land group 462 E. Shore Drive Eagle, Idaho 83616 C. Owner: Reddy Development 16679 N. 90`h Street, Suite # 101 Scottsdale, AZ 85260 D. Applicant's Statement/Justification: Please see applicant's narrative for this information. Southeast Corner Marketplace Subdivision No. 2 -VAC-12-004 - 1 - 5. PROCESS FACTS The subject application is a request to vacate platted easements. By reason of the provisions of the Meridian City Code Title 11, Chapter 5, the City Council is the decision making body on this matter. The UDC does not require the site be posted with a public hearing notice sign. B. Newspaper notifications published on: September 3, and 17, 2012 C. Radius notices mailed to properties within 300 feet on: August 30, 2012 6. LAND USE A. Existing Land Use(s): This property is a vacant commercial property proposed to development with a 5,325 square foot bank. B. Character of Surrounding Area and Adjacent Land Use and Zoning: The subject property is surrounded on the north, east, west and south by vacant and developed commercial properties zoned C-G. C. History of Previous Actions: • The final plat (FP-07-020) for Gateway Marketplace Subdivision No. 2 was approved by the Meridian City Council on July 10, 2007. The final plat consists of 16 commercial lots. The existing mains were installed as part of the subdivision improvements. • The Planning and Zoning Commission approved a conditional use permit (CUP-12-007) for a bank and drive-through use on September 20, 2012. A certificate of zoning compliance (CZC-12-067) has been approved to construct the bank. The existing water and sewer mains will be removed and new mains will be installed during the construction of the bank site. 7. AGENCY COMMENTS MEETING No comments were received by the Planning Department from other City departments for the subject application. 8. STAFF ANALYSIS The applicant is requesting to vacate an existing water and sewer easement platted on Lots 10-12, Block lof Southeast Corner Marketplace Subdivision No. 2 (see Exhibit A.3). The utilities were installed in conjunction with the subdivision improvements. A bank is planned to be constructed on Lots 11 and 12 which necessitates the need to vacate the existing easement (see Exhibit A.3). During the construction of the bank, the existing utilities will be abandoned and new mains will be installed and inspected by the Public Works Department. The project is also conditioned to install the new mains and have the required easements recorded and approved by the Public Works Department prior to occupancy of the bank building. Since new easements must be place and Public Works supports the utility relocation, staff recommends approval of the vacation as proposed in Exhibit A.4. 9. EXHIBITS A. Drawings 1. Vicinity Map 2.
