McDonald's at Fairview Remodeld~~ CERTIFICATE OF ZONING COMPLIANCE REPORT DATE: September 5, 2012 E IDIAN~-- TO: Baumgart Construction I D A H O FROM: Bill Parsons, Associate City Planner SUBJECT: McDonalds at Fairview Remodel -CZC-12-058; DES-12-036 OWNER: R&S Enterprises LTD DESCRIPTION OF APPLICANT'S REQUEST The applicant, Baumgart Construction, requests certificate of zoning compliance (CZC) and administrative design review (DES) approval to renovate the exterior facade of the existing 4,300 square foot restaurant. Additionally, minor site improvements are proposed to the existing parking lot and landscaping to segregate the drive-through traffic from the exiting parking lot traffic. The site is located at 1710 E. Fairview Avenue. DECISION The applicant's request for CZC and DES is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify if you need a building permit and/or inspection. If you need a building permit, you must complete that process before you commence the use or construction. As part of the application submittal, you must provide these plans in PDF format and hardcopy as specified in the Building Services "Plan Intake Checklist': Please contact Building Services for additional details about building permits and inspections. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The site plan prepared by URS Corporation Architecture, dated August 30, 2012, labeled SP.1 is approved (stamped "approved" on September 5, 2012 by the City of Meridian Planning Department) with no changes. 3. The building elevations prepared by URS Corporation Architecture, dated September 26, 2011 labeled A-2.0 and A-2.1 are approved (stamped "approved" on September 5, 2012 by the City of Meridian Planning Department) with no changes. 4. The landscape plan prepared by The Land Group Inc., dated September 4, 2012, labeled L1.00 is approved (stamped "approved" on September 5, 2012 by the City of Meridian Planning Department) with the following comment: ~ All existing landscaping adjacent to the construction zone must r+~naiat ~sd~g construction on the site. 5. The approved site/landscape plan and/or building elevations shall not be altered without prior written approval of the City of Meridian Planning Department. 6. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. Conditions Document 1 McDonalds at Fairview Remodel CZC and DES 7. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (McDonalds CUP in 1995 and DA #95037561). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before September 20, 2012, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Architectural Character: The architectural aspects of this proposed remodel are typical of new McDonald's restaurants. After reviewing the City's Design Manual and UDC, it was determined that this design meets and/or exceeds many of the City's criteria. See attached color Elevation rendering of the building. a. Facades The material, appearance and color of the facades proposed for this building will not only be aesthetically pleasing but will compliment other nearby structures. Surrounding restaurants and commercial buildings have similar facades of stucco and/or stone veneers. Every side of the building will be concealed with stucco, stone veneer, or fenestration. b. Primary Public Entrances Currently, there is only one main entrance, to remain as is. c. Roof Lines Rooflines vary and include both primary and secondary roof structures including parapets, canopies over doorways and windows, and decorative arches. Existing mansard roof structures are to be removed in their entirety. ,~ . d. Pattern Variations The materials proposed for this building vary from stucco finishes to varying styles of stone veneers. This building will also feature some metallic arches. e. Fenestration There are ample windows existing, with additional glass placed at the front elevation wall exposed by the enhanced facade of the children's playland. f. Mechanical Equipment: All ground level and rooftop mechanical equipment shall be screened to the height of the unit as view from the proper line. All rooftop equipment will be hidden behind a parapet wall. A single trash enclosure will be removed and relocated to an area compatible with traffic flow and will match facades of the main building on its exterior. 2. Color and materials. Please provide color chips and exhibits of proposed colors. The color and materials proposed for this building have been shown on the attached Elevation photograph. 3. The project consists of remodeling the existing building facade and selective interior renovations to increase site drive-thru efficiency and ADA accessibility. The project also involves the relocation of the trash corral which will result in a change to an entrance into the parking lot. This entrance does not affect a public right of way. It is simply an entrance between the Fred Meyer parking lot and McDonald's. Please let me know if you need any additional information in order to give me a written confirmation that a traffic impact study or change of use is not required.
