DESCRIPTION OF APPLICANT'S REQUEST
The applicant, Ben Helton, requests Certificate of Zoning Compliance (CZC) approval to remove an eight
inch caliper evergreen tree and replace the evergreen tree with two four inch caliper deciduous trees for
Ada West Dermatology.
The site is located at 1618 S. Millennium Way.
DECISION
The applicant's request for CZC is approved with the conditions listed in this report.
Note. This is not a building permit. Please contact Building Services at (208) 887-2211 to verify if you
need a building permit and/or inspection. If you do need a building permit, you must complete that
process before you commence the use or construction. As part of the application submittal, you will
need to provide two sets of the final, stamped "approved" Planning Department plans. You must
provide these plans in PDFformat and hardcopy as specified in the Building Services "Plan Intake
Checklist" and include them with your building submittal set. Please contact Building Services for
additional details about building permits and inspections.
Process Conditions of Approval
1. Upon installation of the landscaping and prior to inspection by Planning Department staff, the
applicant shall provide a written certificate of completion as set forth in UDC 11 -3B -14A.
2. The landscape plan prepared by Total Maintenance Solutions on December 22, 2010, labeled tree
removal plan, is approved (stamped "approved" on January 11, 2011 by the City of Meridian
Planning Department) with no changes.
3. The approved site plan, landscape plan and/or elevations may not be altered without prior written
approval of the City of Meridian Planning Department.
Ongoing Conditions of Approval
1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the
standards as set forth in UDC 11-313-6 and to install and maintain all landscaping as set forth in UDC
11-3B-5, UDC 11-3B-13 and UDC 11-3B-14.
2. The project is subject to all current City of Meridian ordinances and previous conditions of approval
associated with this site (RZ-00-003; CUP -03-046; CUP -00-017; PP -00-006; FP -00-019; MI -04-
014; CZC-05-012).
The issuance of this CZC does not release the applicant from any previous requirements of the other
permits issued for the site.

4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a
minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the
area.
5. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping
and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-
3.
CITY COUNCIL REVIEW
The applicant or a party of record may request City Council review of a decision of the Director. All
requests for review shall be filed in writing with the Planning Department on or before January 26,
2011, within fifteen (15) days after the written decision is issued, and contain the information listed in
UDC 11 -5A -6B.
If City Council review of the decision is not requested, the action of the Director represents a final
decision on a land use application. You have the right to request a regulatory taking analysis under
Idaho Code 67-8003.
EXPIRATION
Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has
not commenced within one year of the date of issuance of the Certificate of Zoning Compliance.
Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure
shall expire if said construction or alteration has not commenced within one year of the date of issuance
of the Certificate of Zoning Compliance.
In accord with the above provisions, the subject Certificate of Zoning Compliance is valid until January
11, 2012.

In response to your request for comment, the Ada County Highway District (ACHD) staff has
reviewed the submitted application and site plan for the item referenced above. It has been
determined that the Right -of -Way and Development Services Department does not have any site
specific requirements for you at this time due to the fact that:
➢ On May 3, 2000, the Ada County Highway District acted on Resolution Business
Park/MAZOO-004/MCUP00-015/MCUP00-016/MCUP00-017
➢ The same Conditions and Requirements also apply to MCZC-05-012.
If the site plan or use should change in the future, ACHD will review the site plan and may require
improvements to the transportation system at that time.
A traffic impact fee will be assessed by ACHD and will be due prior to the issuance of a

Protection of Existing Trees: Any existing trees on site must be protected in accordance with the Tree
Preservation section of the City's Landscape Ordinance. Per MCC 12-13-13-4, coordinate with the Parks
Department Arborist (Elroy Huff) for approval of protection measures prior to construction. Any severely
damaged tree must be replaced in compliance with MCC 12-13-13-6.
Parking: Off-street parking is approved as shown on the approved site plan. In accordance with MCC 11-13-
5, all standard parking stalls must be constructed 9 feet by 19 feet minimum and drive aisles must be at least
25 -feet wide. The project engineer/architect shall certify that the number and size of handicap -accessible
spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage
in accordance per ADA.
Sidewalks: All sidewalks shall be constructed as submitted and in accordance with MCC 12-5-2.K.
Sidewalks shall be constructed prior to occupancy.
Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and
shall be designed in compliance with the MCC.
Lighting: Lighting shall not cause glare or impact the traveling public or neighboring development.
Signage: No signs are approved with this CZC. All signs will require a separate sign permit in compliance
with the sign ordinance.
Trash Enclosure: Any dumpster(s) must be screened in accordance with MCC 11-12-1.C. Trash enclosures
must be built in the location and to the size approved by SSC.
Handicap -Accessibility: The structure, site improvements and parking must be in compliance with all federal
handicap -accessibility requirements.
ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any
changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be
submitted to the City of Meridian Planning and Zoning staff for approval prior to the issuance of a building
permit. The applicant shall be responsible for meeting the requirements of ACHD as they pertain to this
development.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of
Occupancy. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the
form of a Letter of Credit or cash in the amount of 110% of the cost of the remaining improvements. A bid
must accompany any request for Temporary Occupancy. No occupancy will be granted until the final plat for
the property is recorded.
Plan Modifications: The approved Site Plan and Landscape Plan, stamped "approved" on 1-18-05 are not to
be altered without prior written approval of the Planning & Zoning Department. No significant field changes
to the site or landscape plans are permitted; prior written approval of all changes is required.

automatic underground irrigation system. Additional requirements affecting pressurized
irrigation systems can be found in City Ordinance 9-1-29.

Use of non -potable irrigation water is required when determined to be available by the City
Public Works Department as regulated by City Ordinance 9-1-29. If city potable water is used, a
separate water meter is recommended so the owner can avoid paying sewer fees for irrigation
