This letter is to confirm that th irector approved your request for a modification to the
conditional use permit (CUP-0032) for the subject property. The subject application modifies
the site layout and building design proposed for Pad #5 as shown in Exhibit A.3 of the attached
staff report.
The applicant, director, or a party of record may request City Council review of a decision of the
Director. All requests for review shall be filed in writing with the Planning Department on or
before May 15, 2012, within fifteen (15) days after the written decision is issued, and contain the
information listed in UDC 11-SA-6B.
If City Council review of the decision is not requested, the action of the Director represents a final
decision on a land use application. You have the right to request a regulatory taking analysis under
Idaho Code 67-8003.

Conditional Use Permit Modification MCU-12-001
I. APPLICATION SUMMARY
The applicant, Fairview Lakes, LLC, has requested approval of a modification to the previously
approved conditional use permit (CUP-06-032) for Fairview Lakes Shopping Center, Phase II. The
proposed modification includes changes to the site plan and building elevations for building pad #5
on Lot 4, Block 3, Devon Park Subdivision No. 1.
The structure is proposed to be reduced in size from 4,200 square feet (s.f.) to 3,840 s.f. and parking
is proposed on three sides of the structure rather than two. The building elevations have been
amended to better match the existing building on the same lot.
The subject property is located at 910 E. Fairview Avenue, in Section 6, Township 3 North, Range 1
East.
II. STAFF RECOMMENDATION
Staff recommends approval of a two (2) year time extension for the conditional use permit, as
requested by the applicant, to expire on April 1, 2013, with the conditions listed in Exhibit B.
III. STAFF ANALYSIS
The City of Meridian's Unified Development Code (UDC 11-SB-6F.3) authorizes the Director to
grant a single extension of time not to exceed one two (2) year period to commence the use approved
with the conditional use permit as specified in UDC 11-SB-6F.1, provided that none of the conditions
listed in UDC 11-SB-6F.4 exist. Further, the Director may require compliance with the current
provisions of the UDC as a condition for granting a time extension (UDC 11-SB-6F.3).
This project was evaluated and approved under the current design review guidelines and standards
(Design Manual and the UDC) and the multi-family standards (UDC 11-4-3-27), thus staff is not
recommended additional conditions of approval for the subject project. All conditions approved with
CUP-09-008 apply to the subject application.
