Thank you for the opportunity to review and provide comments on the proposed development
agreement modifications for CarMax Auto Superstore. ACHD looks forward to working with you
on this project, as it goes through the development process. After reviewing the application staff
has a few comments related to access onto Fairview Avenue and general street improvements.
The site plan included as part of the application does not show any direct lot access to Fairview
Avenue, a principal arterial roadway. Staff supports this proposal, as it is consistent with District
Policy 7205.4.7 which states:
• Direct lot or parcel access on to a Principal Arterial is typically prohibited.
• If a property has frontage on more than one street, access shall be taken from the street
having the lesser functional classification.
• Driveways on arterials may be prohibited when the property has frontage on more than
one public street.
Consistent with District Policy and the proposed site plan staff recommends a condition prohibiting
direct lot access to Fairview Avenue be included as part of the modifications to the development
agreement.
Additionally, street improvements including, but not limited to the construction of curb, gutter, and
sidewalk, driveway locations, and signage on Venture Street and Eldon Gray Lane will be
evaluated as part of a future development application.

Nampa & Meridian Irrigation District (NMID) has no comment on the above-referenced
application as no District facilities will be impacted.
All laterals and waste ways must be protected including private facilities. All municipal surface
drainage must be retained on-site. If any surface drainage leaves the site, Nampa & Meridian
Irrigation District (NMID) must review drainage plans. The Developer must comply with Idaho
Code 31-3805.

The Idaho Transportation Department has reviewed the referenced application for the Kleiner
property at the northwest corner of Fairview Avenue and Venture Street. ITD has the
following comments:
1) ITD has no objection to the proposed change in the development agreement. The proposed
change does not require access to the State Highway System or generate additional vehicle
trips.
