APPLICATION SUMMARY The Applicant, JLJ Enterprises, requests approval to vacate a portion of the Edmonds Court right-of- way platted with Edmonds Subdivision. II. STAFF RECOMMENDATION Staff recommends approval of the subject application. III. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The site is located east of S. Meridian Road and approximately a '/o mile north of E. Victory Road in the Southwest 1/4 of Section 19, Township 3 North, Range 1 East. B. Owner/Applicant: JLJ Enterprises 2894 E. Ragusa Meridian, ID 83642 C. Applicant's Statement/Justification: Please see applicant's narrative for this information. V. PROCESS FACTS A. The subject application is a request to vacate public right-of--way. Per Meridian City Code, a public meeting is required before the City Council on this matter. The Council's decision represents consent for the Ada County Highway District to process the vacation application. The District is the final decision making body. VI. LAND USE A. Existing Land Use(s): The area is developing as a single family residential community. The Larkspur Subdivision No. 4 -VAC-12-003 Page 1 property is currently zoned R-8. B. Character of Surrounding Area and Adjacent Land Use and Zoning: The subject property is surrounded by either planned or existing residential development. The majority of the surrounding properties are zoned R-8. One parcel is zoned RUT in Ada County. C. History of Previous Actions: • The City Council approved the annexation (AZ-06-049) and the preliminary plat (PP-06-051) for Larkspur South Subdivision on January 9, 2007. The approved preliminary plat consists of 60 single-family residential building lots and 6 common lots on 12.81 acres of land. A condition of the approved plat requires the extension of Edmonds Court and vacating the surplus right-of--way. • In 2010, the applicant obtained approval of the first phase of the Larkspur South Subdivision (FP-10-006). This phase developed with 22 residential lots and 1 common lot on 3.79 acres. D. Utilities: 1. Public Works: a. Location of sewer: Currently installed to each lot. b. Issues or concerns: None. VII. AGENCY COMMENTS MEETING No comments were received by the Planning Department from other City departments for the subject application. Please see the public record for the VAC file for any written comments that may have been submitted by other agencies. VIII. ANALYSIS Analysis Leading to Staff Recommendation: The applicant requests approval to vacate a portion of the existing right-of--way (0.11 acres) platted with Edmonds Subdivision. Edmonds Court is currently adead-end cul-de-sac which is proposed to be extended with Larkspur Subdivision No. 4 scheduled in conjunction with this application. The future extension of this roadway has resulted in surplus of right-of way that is not required for any future road access and needs to be vacated (see Exhibit A.2). A condition of approval for the Larkspur South Subdivision also requires vacating the right-of--way and extending the roadway. The surplus right-of--way is to be deeded back to the abutting property owners in exchange for the right-of--way being dedicated via the new plat. In order for ACHD to act on the applicant's request to vacate the existing right-of--way, ACHD must receive a recommendation for approval (consent) from the City Council. Since the applicant is complying with the requirements of the approved plat, staff recommends approval of the vacation as proposed in Exhibit A.3. IX. EXHIBITS A. Maps/Other 1. Zoning/Vicinity Map 2.
