Memo by Planning 8/2August 2, 2012 MEMORANDUM TO: Planning and Zoning Commission FROM: Bill Parsons, Associate City Planner CC: Bruce Chatterton, Bill Nary, Jaycee Holman, Pete Friedman, Machelle Hill; Jacy Jones; Scott Steckline; the applicant; Project File RE: Accolade Apartments (MCU-12-002) August 2, 2012 Planning and Zoning Commission Agenda Item (Continued from July 19, 2012) On July 19, 2012, the Planning and Zoning Commission heard the Accolade Apartment conditional use permit modification application. Public testimony presented at the hearing lead to the continuance of the project to the regularly scheduled meeting of August 2, 2012. The applicant was directed by the Commission to work with the adjacent property owners on a resolution to address the southern and southwest landscaping and the garage design along the south boundary. Staff has received written testimony from the adjacent property owner's representative in agreement with the proposed changes. Attached to this memo are the revised plans and list of the proposed changes for your consideration: 1) Both the southwest and south boundary will be bermed no less than two feet and include a mix of shrubs and ornamental grasses. The applicant has agreed to plant twenty-eight (28) 3- inch caliper deciduous trees along the southern boundary. The previous plan proposed forty trees. A cluster of plantings (trees and shrubs) will be provided adjacent to the open parking stalls along the southern boundary to screen these areas from the southern residents. The neighbors are in agreement with the proposed changes provided taller ornamental grasses are added to the southwest berm as approved on the original plan and that nine (9) additional trees (28 in total) are added to the southern berm per the UDC. Upon recommendation from Commission staff will amend the conditions of approval to include the aforementioned changes. 2) The proposed garages along the southern boundary will include a mix of building materials and a gable roof element on the rear of the buildings to match the proposed apartment buildings. Fax 208-888-6854 . www.meridiancity.org Page 2 siding and asphalt shingles. The body of the garages will include two body colors and one trim color consistent with the proposed apartment buildings. This is already conditioned in the staff report. Staff and the neighbors are supportive of the proposed garage design. 3) Agate is proposed for the third access on the south boundary of the site. The fire department does not support a gate at this location based on the requirements of the international fire code. The owner of the 5 acre parcel has agreed to provide a temporary dirt berm south of the required fire lane to screen the southern access point from the southern neighbors. If Commission supports this offsite improvement the appropriate mechanism is to include the off-site improvement with the DA modification which is scheduled for August 21, 2012. Because the development agreement modification is required to move forward with the application and the approved landscape plan is tied to the DA, staff is of the opinion the applicant should submit a revised landscape prior to City Council to memorialize the proposed changes thus solidifying the agreement between the developer and the adjacent home owners.
