MHS Central Plant BldgCERTIFICATE OF ZONING COMPLIANCE REPORT DATE: July 20, 2012 E IDIAN%~'`'' TO: Hummel Architects FROM: Bill Parsons, Associate City Planner SUBJECT: CZC-12-~ and DES-12-033 -MHS Central Plant Building and (2) Portable Classroom Relocation G, ~C-~o~ _a~~ OWNER: Joilit School District No. 2 ~~ DESCRIPTION OF APPLICANT'S REQUEST The applicant, Hummel Architects, requests certificate of zoning compliance (CZC) and administrative design review approval to construct a new 2,056 square foot mechanical building. The site placement for the mechanical building has necessitated the need to relocate two (2) existing portable classrooms elsewhere on site. Thus, the approval of the CZC includes relocating two (2) existing portable classrooms near the three existing portable classrooms located in the southeast quadrant of the property. A separate design review approval will be required if the temporary portable classrooms are to remain on the property permanently. The site is located at 1900 W. Pine Avenue. The property is zoned R-4. DECISION The applicant's request for CZC and DES is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify if you need a building permit and/or inspection. If you do need a building permit, you must complete that process before you commence the use or construction. As part of the application submittal, you will need to provide one (I) set of the final, stamped "approved" Planning Department plans. You must provide these plans in PDF format and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your building submittal set. Please contact Building Services for additional details about building permits and inspections. Process Conditions of Approval 1. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-SC-3C. 2. The site/landscape plan and overall site plan prepared by Hummel Architects, labeled Sheets A1.01 and C1.0, are approved (stamped "approved" on 07/20/12 by the City of Meridian Planning Department) with no changes. 3. The elevations prepared by Hummel Architects, labeled Sheet A3.01, are approved (stamped "approved" on 07/20/12 by the City of Meridian Planning Department) with no changes. 4. The approved site/landscape plan and/or elevations tnay not be altered without prior written approval of the City of Meridian Planning Department. 5. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 6. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. Conditions Document 1 MHS Central Plant Building CZC 7. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. The existing landscaping surrounding the construction zone must remain protecting during construction on the site. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site. 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 5. The applicant shall have an ongoing obligation to comply with the specific use standards for a portable classroom listed in UDC 11-4-3-14F. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before 08/06/12, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. The temporary portable classroom shall be an accessory use valid for a maximum period of four (4) years from the date of issuance of the certificate of occupancy. Upon termination of the four (4) year permit, the temporary portable classroom approval shall be null and void and the structure shall be removed from the property. In accord with the above provisions, the subject Certificate of Zoning Compliance is valid until July 20, 2013. Any modification of said ditch or cans! by the Licensee or encroachment upon the District's easement along said ditch or canal shall be performed and maintained in accordance with the "Special Conditions" stated in Exhibit D, attached hereto and by this reference made a part hereof: Ah10UnT x5.00 16 ~• This agreement pertains only to the Licensee's modification of said ditch or canal or encroachment to the District's easement for t}ie purposes and in the manner described herein. The Licensee shall not change the location of the ditch or canal, bury the ditch or canal in pipe, ar otherwise alter the ditch or canal in any manner not described in t1~is agreement without first obtaining the written permission of the District. 3. Each facility ("facility" as used in this agreement means any object or thing of any nature installed in or on the District's easement by the Licensee or the Licensee's predecessor in interest) shall be constructed, installed, operated, maintained, and repaired at all times by the Licensee at the cost and expense of the Licensee. - 4• Licensee agrees to construct, install, operate, maintain and repair each facility and conduct its activities within or affecting the District's easement so as not to constitute or cause: a• a hazard to any person or property; b, an interruption or interference with the flow of irrigation water in the ditch or canal or the delivery of irrigation water by the District; ~• an increase in seepage or any other increase in the loss of water from the ditch or canal; - d. the subsidence of soil within or adjacent to the easement; e. any other damage to the District's easement and irrigation works. S• The Licensee agrees to indemnify, bald harmless, and defend the District from all claims for damages arising out of any of the Licensee's construction or activity which constitutes or causes any of the circumstances enumerated in the preceding paragraph, 4.a. through 4.e., or any other damage to the casement and irrigation works which may be caused by the construction, installation, operation, maintenance, repair, and any use or condition of any facility. 6. Licensee agrees that the work performed and the materials used in such construction shall at all times be subject to inspection by the District and the District's engineers, and that final acceptance of such work shalt not be made until all such work and materials shall have been expressly approved by the Dislrict. Such approval by the District shall not be unreasonably withheld. 7. The District reserves the right, at the District's option, to remove any facility installed by the Licensee and to repair any alteration by the Licensee of said ditch or canal and the easement therefor which does not comply with the terms of this agreement, and to remove anyimpediment to the flow of water in said ditch or canal and any unsafe condition or hazard caused by the Licensee, at any time, and the Licensee agrees to pay to the District, on demand, the costs which shall be reasonably expended by the District far such purposes. If the Licensee shall fail in any respect to properly maintain and repair such facility, Then the District, at its option, and without impairing or in anyway affecting its atlter rights and remedies hereunder, shall have the right to perform. the necessary maintenance and repairs and the Licensee agrees to pay to the District, on demand, the cost or expense which shad be reasonably expended or incurred by the District for such purposes. The District shall give reasonable notice to the Licensee prior to the District's perfornung such ma-intenance, repair or other work except that in cases of emergency the District shall attempt to give such notice as reasonable under the circumstances. Nothing in this paragraph shall create or support any claim of any kind by Licensee or any third party against the District for failure to exercise the options stated in this paragraph, and Licensee shall indemnify, hold harmless and defend the District from any claims made against the District arising out of or relating to the terms of this paragraph except for claims arising solely out of the negligence of the District. LICENSE AGREEMENT -page ~ 8• Neither the kerns of [his agreement, the permission granted by the District to the Licensee, the Licensee's activity which is the subject of this agreement, nor the parties exercise of any rights or performance of any obligations of this agreement, shall be construed or asserted to extend the application of anystatute, rule, regulation, directive ar other requirement, or the j urisdiction of any federal, state, or oth er agency or official to the District's ownership, operation, and maintenance of its ditches, canals, drains, irrigation works and facilities which did not apply to the District's operations and ackivities prior to and without execution of this agreement. In the event the District is required to comply with any such requirements or is subject to the jurisdiction of any such agency as a result of execution of this agreement or the Licensee's activity authorized hereunder, Licensee shall indemnify, hnld harmless and defend the District from all costs and liabilities associated with the application of such laws or the assertion of such jurisdictinn or, at the option of the District, ibis agreement shall be of no farce and effect and the Licensee shall cease all activity and remove any facility authorized by this agreement. ~' In addition to ail ether indemnification provisions herein, Licensee further agrees to indemnify, hold harmless and defend the DisMcC from any injury, damages, claim, lien, cast and/or expense (including reasonable attorney's fees) incurred by, or asserted against, the District by reason of the negligent acts or omissions ofLicensee or its agents, contractors arsubcontractars in performing the construction and activities authorized by this agreement. 10. The Licensee agrees that the District shall not be liable for any damages which shall occur to any facility, structure, plant, or any other improvement of any kind or nature whatsoever which the Licensee shall install on the said easement area of the District in the reasonable exercise of the rights of the District in the course of performance of maintenance or repair of said ditch or canal. The Licensee further agrees to suspend its use of the said easement area when the use of the easement area is required by the District for maintenance or repair under this or any other paxagraplt of this agreement. 11. Licensee shall place no structures, pathways ar Iandscaping of any kind above ar within the District's easement area except as referred to in this agreement or exhibits hereto without the prior written consent of the District. Nor shall Licensee permit, authorize or grant any otherperson or entity to excavate, discharge, construct ar place any structures, pathways or landscaping within the District easement without the prior written consent of the District. 1?. Should either party incur costs or attorney fees in connection with efforts to enforce the provisions of this agreement, whether by institution ofsuit or not, the party rightfully enforcingor rightfully resisting enforcement of the provisions of [his agreement, or the prevailing party in case suit is instituted, shall be entitled to reimbursement for its costs and reasonable attorney fees from the other party. 1~• The parties hereto understand and agree that the District has na right in any respect to impair the uses and purposes of the irrigation works and system of the District by this agreement, nor to grant any rights in its irrigation works and system incompatible with the uses to which such irrigation works and system are devoted and dedicated and that this contract shall be aE all tinter construed according to such principles. 14. Nothing herein contained shall be construed to impair the right of way of the District in the said di tch or canal and all uses of said ditch or canal by the Licensee and the license herein provided therefor shall remain inferior and subservient to the rights of the District to the use of said ditch or canal for the transmission and delivery of irrigation water. In the event of the failure, refusal or neglect of the Licensee to comply with all of the terms and conditions of this agreement, the license of the Licensee under the terms hereof may be terminated by the District, and any facility, structure, plant, or any other improvement in ar over said ditch or canal, and the right of way therefor, which may impede or restrict the maintenance and operation of such ditch or canal by the District with its equipment for the maintenance of its said ditch or canal may be removed by the District. I6. The Licensee agrees to pay attorney fees or engineering fees charged by the attorney for the District ar by the engineers for the District in connection with the preparation of this License Agreement or in connection with negokiations covering the terms and conditions of this License Agreement. Licensee also agrees to pay any fees incurred in connection with the recording of this Agreement. 1.7. Nothing in this agreement shall create or support a claim of estoppel, waiver, prescription or adverse possession by the Licensee or any third party against District. I8. This agreement is nok intended for the benefit of any third party and is not enforceable by any third party. 19. If any provision of this agreement is determined by a court of competent jurisdiction to be invalid or otherwise unenforceable, all remaining provisions of this agreement shall remain in full force and effeck. 20. The word "Licensee", if used in the neuter in this agreement, includes the masculine and feminine genders, the singuIa~r number includes the plural, and the plural number includes the singular. The covenants, conditions and agreements herein contained shall constitute covenants to run with, and running with, ail of the Lands of the Licensee described in said Exhibit A, and shall be binding an each of the parties hereto and on al! parties and all persons claiming under them or either of them, and the advantages hereof shall inure to the bene£rt of each of the parties hereto and their respeckive successors and assigns. EXH1~D Special Conditions a• Construction shall be in accordance with certain plans consisting of four sheets: sheet CI.O entitled "Technical Education Center -Meridian HS, Sheet Demolition," bearing engineer's stamp dated December 6, 2005; sheet C2.t) entitled "Technical Education Center -Meridian HS, Sheet Gravity Irrigation plan," bearing engineer's stamp dated December ti, 2005; sheet C3.0 entitled "Technical Education Center - Meridian HS, Sheet Gravity Irrigation Details,"bearing engineer's stamp dated December 6, 2005; and sheet L3.1)0 entitled "Technical Education Center -Meridian HS, Sheet Qverall Layout Plan," dated Noverrtber 21, 2005. These plans have been delivered to the District's water superintendent, are in his possession in his offices, and are hereby incorporated by this reference. b• Licensee shall convey to the District an easement for that section of the Rutledge Lateral relocated by Licensee under the terms of this agreement. In addition, as a condition of allowing Licensee to construct the baseball field within the District's easement, Licensee is providing a access easement around the baseball Meld so that the District has continuous access along the Rutledge Lateral. Accordingly, Licensee shall also convey to the District an easement for the access and maintenance road. Execution and delivery of said easements are material and essential term of this agreement and if not executed and delivered, at [he option of the District this agreement may be terminated and be of no force and effect. Upon request by Licensee and submission of a legal description to the District, the District shall relinquish its easemenk along the Rutledge Lateral where it has been replaced by reIocatian of the Rutledge Lateral. c• The District and Licensee recpgpize that there is currently sorue uncertainty as to Licensee's ownership of a small portion of the real property described in Exhibit A, and that Licensee would have no authority to grant the District an easerrrent across or over said property if it is not owned by Licensee. Licensee agrees that it shall make efforts to clarify and confirm Licensee's ownership of the property at Licensee's own expense and cost. If Licensee is ever determined not to be the owner o£ the property, Licensee shall indemnify, defend and hold harmless the District for any claims, demands, damages, injury cost or expense incurred by or asserted against the District arising out of the District's easement and pipe ar the Rutledge Lateral across said property, In addition, Licensee agrees that if Licensee is deter-rnined ~~ not to be the owner of the property, and a suitable easement cannot be obtained from the recognized owner, Licensee agrees to relocate the Rutledge Lateral and the District's easement onto property in which Licensee is the undisputed property owner, at Licensee's sale cost and expense. LICENSE AGREEMENT -page 6 d• The pipe, installation, and baci..fi11 shall, at a miniraura, meet the requirements of the District and standard Specifications for such materials and construction, as set forth in the Idaho standards for public works construction or other standards recognized by the city or county in which the pipe is to be placed. e, Supplementing paragraph 9 of this agreement, within one week after the execution of this Agreement, the Licensee shall provide the District written notice that the facilities installed and work performed by the Licensee are ready for final inspection and approval by the Dis[ric[. Within one month after receiving such written notification from the Licensee, the District shall perform an inspection and, if the facilities have been constructed and installed and all work has been performed in compliance with the terms of this agreement, the District shall provide written notice to the Licensee of final approval. If the District's engineers perform such inspection, Licensee shallpay the District's engineers any reasonable charge in connection therewith, The Licensee shall not fill, alter, orperform any work affecting the Rutledge Lateral or the District's easements for the Rutledge Lateral, and the Rutledge Lateral shall remain open and serviceable for use and maintenance by the District forali irrigation and drainagepurposes until and unless the Licensee has received written notice from the District offinal approval of the construction and installation of the new ditch and pipe for the Rutledge Lateral as provided in paragraph d. of this agreement, After the Licensee receives notice of:6nal approval from the District, and upon request by Licensee and submission of a legal description to the District, the District shall relinquish its easement along Edwards Lateral where it has been replaced by relocation of Rutledge Lateral. Licensee shat] be responsible for operation and maintenance associated with the Licensee's backfil] of the Rutledge Lateral, Licensee further agrees to indemnify, hold harmless and defend. the District from any injury, damages, claim, lien, cost and/or expense {including reasonable attorney's fees) incurred by, ar asserted against, the District by reason of drainage or seepage associated with the Licensee's bac~iJ afthe Rutledge Lateral. g• With respect to the piping of the Rutledge Lateral, the District shall continue to have the right and responsibility for operation and maintenance of the relocated Rutledge Lateral, however, the Licensee steal] be responsible for operation and maintenance associated with the Licensee's piping of the Rutledge Lateral, including rehabilitation or replacement of the pipe and rehabilitation of the District's easement for a period of three years from the date of this Agreement. Maintenance shall include, but not be limited to, the removal and disposal ~f silt, gravel, plant material, and all hash and debris which may accumulate in the pipe. Repairs shall include, but not be limited to, all repairs necessary io preserve the structural integrity and unobstructed flow of water through the Rutledge Lateral and prevent the Loss of water from the Rutledge Lateral. If the Licensee shall fail in any respect to properly operate, maintain and repair such portion of the Rutledge Lateral, then the District, at its option, and without impairing or in anyway affecting its other rights and remedies hereunder, shall have the right to perform the necessary maintenance and repairs and the Licensee agrees to pay to the District, on demand, the cost or expense which shall be reasonably expended or incurred by the District for such purposes. The District shall give reasonable notice to the Licensee prior to the District's performing such maintenance, repair or other work except that in cases of emergency the District shall attempt to give such notice as reasonable under the circumstances. Nothing in this paragraph shall create or support any claim of any kind by Licensee or any third party against the District for failure to exercise the options stated in this paragraph, and Licensee shall indemnify, ]cold harmless and defend the District from any claims made against the District arising out of or relating to the terms of this paragraph except for claims arising solely out of the negligence or fault of the District. h• The District's easement along the section of the Rutledge Lateral as relocated shall be 40 LICENSE AGREEMENT .page 7 feet, ?~ feet to the left and IS feet to the right of the center]ine laolting downstream, and shall include all easements for the Rutledge Lateral described herein. Licensee recognizes its continuing duty to comply with all such regturemenis that now exist or that may be implemented or imposed in the future. By executing this agreement the District assumes no responsibility or liability for any impact upon ar degradation of water quality or the environment resulting from the discharge ar other.acdvity by Licensee which is the subject of this agreement. j• Licensee hereby indemnifies, holds harmless and shall defend the District from any and all penalties, sanctions, directives, claims or any action taken or requirement imposed by any party or entity, public or private, with respect to environmental matters relating to the subject matter, terms or performance of this agreement unless the District shall be solely responsible for the condition or activity which gives rise to any such penalty, sanction, directive, claim, action or requirement. k. In the event the District is required by any governmental authority to acquire or comply with any permit or other operational requirements associated with Licensee's discharge and other activity which is the subject of this agreement, Licensee shall indemnify, hold harmless and defend the District form all costs and liabilities associated with such permit and other requirements, including but not limited to all costs associated with all permit acquisition, construction, monitoring, treatment, administrative, tiling and other requirements. I. The parties to this agreement recognize this license agreement is an accommodation to Licensee. The District by this agreement does no[ assume, create, or exercise legal nr other authority, either express or implied, to regulate control, or prohibit the discharge or contribution ofpollutants or contaminants to the District's facilities or to any groundwater, waters of the State of Idaho or the United States, or any ocher destination. Such authority, to the extent thak it exists, is possessed and exercised by governmental environmental agencies. m. Licensee shall not excavate, discharge, place any structures, nor plant any trees, shrubs or landscaping within the District's easements, nor perform any construction or activity within tEie District's easements for the Rutledge Lateral except as referred to in this agreement or exhibits thereto without the prior written consent of the District. n. The scope of work will be to completely remodel the Classroom Building.
