No special meeting shall be held without atleast atwenty-four (24) hour meeting and agenda notice, unless an emergency exists. An emergency is a situation involving injury or damage to persons or property, or immediate financial loss, or the likelihood of such injury, damage or loss, when the notice requirements of this section would make such notice impracticable, or increase the likelihood or severity of such injury, damage or loss, and the reason for the emergency is stated at the outset of the meeting. The notice required under this section shall include at a minimum the meeting date, time, place and name of the public agency calling for the meeting. The secretary or other designee of each public agency shall maintain a list of the news media requesting notification of meetings and shall make a good faith effort to provide advance notification to them of the time and place of each meeting." CITY OF MERIDIAN RESOLUTION NO. Io2 ' ~s7 BY THE CITY COUNCIL: BIRD, HOAGLUN, ROUNTREE, ZAREMBA A RESOLUTION DECLARING AN EMERGENCY AND DIRECTING PUBLIC WORKS STAFF TO CONSTRUCT AND INSTALL A SEWER AND WATER MAIN UNDER THE PIPED NINE MILE CREEK; AND PROVIDING AN EFFECTIVE DATE. V~VHEREAS, the City of Meridian is empowered by Idaho Code 50-323 to establish, maintain, and operate domestic water systems and is authorized by Idaho Code 50-332 to alter, widen, and pipe any sewer in such City; and, WHEREAS, in furtherance of certain water and sewer capacity upgrades, the City desires to install a sewer and water main under the piped Nine Mile Creek as depicted on Exhibit A, attached hereto (hereinafter referred to as the "City Project" or "Project"); and, WHEREAS, the Proj ect takes place within the City's public water and sewer right-of-way; and, WHEREAS, the City Project will require five (5) crossings, in the form of casings or pipes, to be bored or j acked under the piped Nine Mile Creek and will take place underground at a minimum of three feet under the piped Nine Mile Creek; and WHEREAS, the Nampa & Meridian ItTigation District (hereinafter "District") claims an easement to operate and maintain an irrigation and drainage facility known as the Nine Mile Creek at the location of the City Project; and, WHEREAS, the City provided notice to the District of City's plans for the Project on or about September 27, 2011, and sought any permission that the District believed it was entitled to extend pertaining to the Project; and, WHEREAS, although the District has not shown that such permission is necessary, they provided conditional permission but have recently imposed additional conditions that the project be delayed until the end of the irrigation season at a time when the Nine Mile Creek is not actively conveying water; and, WHEREAS, the City Project will not materially interfere with the District's easement and in fact the City Proj ect does not intersect or encroach upon the District's easement because the five casings or pipes will be located three feet under the location of the piped Nine Mile Creek; and, WHEREAS, the City Proj ect will not interrupt or interfere with the flow of irrigation or drainage water in the Nine Mile Creek, nor will it cause any damage to the District's irrigation works; and, WHEREAS, in the unlikely event of damage or breakage to the Nine Mile Creek piped section, City has adopted a Water Delivery Contingency Plan to assure continued delivery of water through the District's facility; and, WHEREAS, the City acknowledges liability if the Proj ect causes damage, interference, or interruption of the District's service in the Nine Mile Creek, and City shall hold harmless and defend the District from any injury, damages, claim, lien, and/or expense incurred by or asserted against the District RESOLUTION DECLARING AN EMERGENCY & DIRECTING PUBLIC WORKS STAFF TO CONSTRUCT AND INSTALL A SEWER AND WATER MAIN UNDER THE PIPED NINE MILE CREEK PAGE I OF 2 by reason of the negligent acts. or omissions of City or its agents, contractors, or subcontractors in performing the City Project; and, WHEREAS, the planned sewer system upgrade is necessary to provide additional capacity for the sewer system that is currently at full capacity in this location, the planned water system upgrade will provide increased capacity for fire suppression and other purposes, and the Project is necessary to serve the immediate and future needs of the citizens and taxpayers of Meridian; and, WHEREAS, the water and sewer upgrades are scheduled as a precursor to the Meridian Road Split Corridor Phase II prof ect, and any delay in the water and sewer upgrades will result in a corresponding delay of the road project, increased costs to City taxpayers, and disruption of local economic activity dependent upon the timely completion of the Project; and, WHEREAS, failure to install the water and sewer upgrades at this time will result in the inability to perform such work for a period of five years due to the Ada County Highway District's mandatory five year moratorium on cutting into new roadbeds; and, WHEREAS, failure to address the water and sewer capacity issues at this window of opportunity would represent a threat to the public health, safety, and welfare, increase costs to City taxpayers, disrupt needed economic development in the City, and delay the extension of important City services. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MERIDIAN CITY, IDAHO: Section 1. That the City Council of the City of Meridian hereby declares that an emergency exists and the City Project must take place immediately to protect the public health, safety, and welfare. Section 2. That the Public Works Department is hereby authorized and directed to: (a) immediately undertake the water and sewer capacity upgrades at the locations identified on Exhibit A, attached hereto and incorporated herein, and (b) carry out these upgrades in a professional and workmanlike manner that. avoids encroaching on any easement held by the District or causing any damage or injury to District facilities or water deliveries or drainage.
