THIS INDENTURE, made llxis ,~, day of~~ 2o~between I/ynx Investments* LP
the parties of the first pa~~, and herena~~tex called the Grantors, aid the pity of
Meridian, Ada Go~inty, Idaho, the party of the second part, and hereinafter Balled the Grantee;
w1T~ESSETH
WHEREAS, the Grantors desire to provide a sanitary sewer right-ol~way across the premises
a.nd prope~•ty hei'elnafter particularly bounded and described; and
wHERE.AS, the sal~itary :sewer is to be provided for through an underground pipeline to he
constructed by others and or Grantee; and
NOW, THEREh`ORE, in Consideration of the benefits to be received by the Grantors, at~d
,.~ other good and valuable consideration, the Grantors do hereby give, grant and convey unto
the Grantee the rightMof-way for an easement for the const~•uction of a sever line over and
ac~•oss the following described prope~~ty;

The fiem~poraj;~ construction e~asenrent is for the purpose of construction of a sanrta~•y sewel•
line and related incidental work and storage of materials related to the construction process.
T~ SAVE AND TO HOLD, the said easement and zigh~wof way unto the said Grantee, its
successors and assigns shall be temporal. The termination oftl~is easement shall expire 30
days after the installation and acceptance of said sewer line by the Grantee,
IT I5 EXPRESSLY UNDERSTOOD AND AGREED, by and between the parties hereto,
that after installing and accepting said sewer line, Grantee shall restore the a~•ea of the
easement and adjacent properfiy to that existent prior to u~idertaking s~reh repairs and
maintenance. However, Grantee shall not be responsible for repairing, replacing or restoring
anything placed within the area described in this easement that was placed they e in violation
of this easement,
THE GRANTORS her eby covenant and agree that they will not place or allow to be placed
ally permanent strlictlires, trees, ~Orusla, or• perennial shrubs or flowel•s withal the area
desc~•ibed for this easement, which would interfere with the use of said easement, for the
pu~~oses stated herein.

THE GRANTORS hereby covenant and agree with the Grantee that should any part of the
right-of--.way and easement hereby granted shall become part of, or ]ie within the boundaries
of any public street, then, to such extent, such right-of--way and easement hereby granted
which lies within such boundary thereof or which is a part thereof, shall cease and become
null and void and of no further effect and shall be completely relinquished.
THE GRANTORS do hereby covenant with the Grantee that they are lawfully seized and
possessed of the aforementioned and described tract of land, and that they have a good and
lawful right to convey said easement, and that they will warrant and forever defend the title
and quiet possession thereof against the lawful claims of all persons whomsoever.
IN WITNESS WHEREOF, the said parties of the fast part have hereunto subscribed their
signatures the day and year first herein above written.
