DESCRIPTION OF APPLICANT'S REQUEST
The applicant, Perryman Construction, requests Certificate of Zoning Compliance (CZC) approval of
two (2) single-family attached homes on Lots 4 & 5 and Lots 9 & 10, Block 2 of Waverly Place
Subdivision.
The properties are located at 473 & 457 S. Fiddle Avenue and 2724 & 2736 E. Bowstring Street,
north of E. Magic View Drive, approximately % mile west of S. Eagle Road.
DECISION
The applicant's request for CZC and DES is approved with the conditions listed in this report.
Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify if you
need a building permit and/or inspection. If you do need a building permit, you must complete that
process before you commence the use or construction. As part of the application submittal, you will
need to provide one set of the final, stamped "approved" Planning Department plans, stamped and
signed by the architect and/or civil engineer as applicable. You must provide these plans in PDF
format and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them
with your building submittal set. Please contact Building Services for additional details about building
permits and inspections.
Site Specific Conditions of Approval
1. The applicant shall construct all proposed fencing and/or any fencing required by the UDC,
consistent with the standards as set forth in UDC 11-3A-7 and 11-3A-6B.
Process Conditions of Approval
2. The site plans prepared by Bayne Design LLC on 5/22/12 & 6/28/12, labeled Sheet 1, are
approved (stamped "approved" on 7/2/12 by the City of Meridian Planning Department) with no
changes.
3. The approved site plan and/or elevations may not be altered without prior written approval of the
City of Meridian Planning Department.
4. The elevations prepared by on Bayne Design LLC on 5/22/12 & 6/28/12, labeled Sheet 4, are
approved (stamped "approved" on 7/2/12 by the City of Meridian Planning Department) with no
changes.
5. The applicant shall pay any applicable impact fees prior to the issuance of a building permit.
6. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant
shall submit a new site plan to the City of Meridian Planning Department for approval prior to
issuance of the building permit.

The applicant shall complete all required improvements prior to issuance of a Certificate of
Occupancy. It is unlawful to use or occupy any building or structure until the Building Official
has issued a Certificate of Occupancy.
Ongoing Conditions of Approval
1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets
the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth
in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14.
2. The project is subject to all current City of Meridian ordinances and previous conditions of
approval associated with this site (AZ-06-047; RZ-10-004; Development Agreement Inst. No.
111032844; PP-10-003; VAC-07-010).
3. The issuance of this CZC does not release the applicant from any previous requirements of the
other permits issued for the site.
4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a
minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the
area.
5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set
forth in UDC 11-3A-11.
CITY COUNCIL REVIEW
The applicant or a party of record may request City Council review of a decision of the Director. All
requests for review shall be filed in writing with the Planning Department on or before June 17, 2012,
within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-
SA-6B.
If City Council review of the decision is not requested, the action of the Director represents a final
decision on a land use application. You have the right to request a regulatory taking analysis under
Idaho Code 67-8003.
EXPIItATION
Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has
not commenced within one year of the date of issuance of the Certificate of Zoning Compliance.
Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure
shall expire if said construction or alteration has not commenced within one year of the date of issuance
of the Certificate of Zoning Compliance.
In accord with the above provisions, the subject Certificate of Zoning Compliance is valid until July 2,
2013.

Hi Kelly,
I've finished my review of the CZC & design review applications you submitted for Lots 4£x5 and Lots 98:10 at Waverly
Place. Both of the site plans need to be revised to include sidewalk location and square footage of livine space
(excluding garage) -minimum square footage of liwng space is required to be~'500 per Scott's proposal at the
Commission hearing. Submit (2) copies of the revised site plan along with an 8 Yz" x 11 " reduction & electronic copy
(email is fine).
Assuming the living space.is a minimum of 1,500 s.f., the building elevations for Lots 4 Et 5 are approved; please submit
(1) additional copy of the elevations. If not, revise accordingly & submit (Z) revised copies of the elevations.
The building materials on the elevations for Lots 9 8: 10 are not consistent with design guidelines & the materials
shown on the previously approved elevations. Provide a mix of materials on the front elevation. Submit (Z) copies of
the revised elevations along with an 8 %z" x 11"reduction 8 electronic copy (email is fine).
As soon as I get the revised plans, I can issue the CZC.

located on the North side of E. Magic View Cir approximately one-half of a mile West of S. Eagle Road.
The site is annexed into the City of Meridian. The site is bounded by Snorting Bull Sub Phase 2 to the
West; Greenhill Estates Sub Phase 2 to the North and Magic View Sub Amd to the South and East.

B. Agency Comments/Conditions of Approval
On October 7, 2010, Planning Staff held an agency comments meeting. The agencies and departments
present include: Meridian Fire Department, Meridian Public Works Department, and Meridian Parks
Department. Staff has included all comments and recommended actions in the attached Exhibit B.
1. PLANNING DEPARTMENT
1.1 REZONE
1.1.1 The legal description and exhibit map for the proposed rezone submitted with the application
(stamped on September 28, 2010, by D. Terry Peugh, PLS) shows the property within the existing
corporate boundary of the City of Meridian (see Exhibit C).1.1.2.
1.1.2 A Development Agreement (DA) will be required as part of the rezone of this property. Prior to the
rezone ordinance approval, a DA shall be entered into between the City of Meridian, the property
owner(s) at the time of rezone ordinance adoption, and the developer. The Applicant shall contact
the City Attorney's Office to initiate this process. Currently, a fee of $303.00 shall be paid by the
applicant to the City Attorney's office prior to commencement of the DA. The DA shall be signed by
the property owner and returned to the city within one year of the City Council granting the rezone.
The DA shall, at minimum, incorporate the following provisions:

b. Off-street parking shall be provided on the site in accord with the requirements for townhouse
dwellings listed in UDC Table 11-3C-6.
c. All townhome structures constmcted on the site shall substantially comply with the elevations

constructed within the development for variety.
d. The clubhouse/caretaker structure shall substantially comply with the building elevation
(including construction materials) shown in Exhibit A.6.
e. Development of this site shall substantially comply with the site plan and landscape plan
included in Exhibit A.
£ A Certificate of Zoning Compliance (CZC) application is required to be submitted for each of
the proposed townhome structures and the clubhouse structure. More than one of the structures
may be contained in the same CZC application.
g. An Administrative Design Review application is required to be submitted concurrently with the
CZC application for all attached residential structures containing two or more dwelling units and

shall comply with the standards listed in UDC 11-3A-19 and the guidelines contained in the
City's Design Manual.
