We believe the application number is PP 12-010 CUP 12-006 Mulberry Sub. Although we understand the need for our local community to have continued growth and how important new building is to the economy, we can not support the building of apartments that will essentially be located at one of our most used parks (Settler's Park). Our main points of opposition are: 1. The traffic studies that were discussed during the neighborhood meetings held by Engineering Solutions referenced studies there were done in 2008 and February 2010. Given that the most recent study occurred in the middle of winter, we do not feel that the data collected is of any merit and should not be used in the evaluation of whether or not the current road system would be adversely impacted by this new complex. As you know, this park has grown in popularity by leaps and bounds since 2008 and therefore we believe that new statistics are warranted. 2. Potential impact to home values. Although we realize that all Meridian homeowners are in the same situation with our home values depleting so drastically during the down economy, allowing these apartments to be build right next a existing subdivision without any requirements of a separate entrance will have a further negative impact on our homes value. 3. There are already several apartment complexes in the construction phase in this particular area. Although it is important to ensure that there is the right blend of housing for our communities, it is just as important to monitor that we do not over build and create an environment where we have more housing than we have tenants to rent them. 4. General concern of the park atmosphere. Given where the apartments are being proposed to be built with no distinct divide between them and the park, we feel that cosmetically it is not a good fit. Over the past several years events in the park have grown considerably. We feel that these apartments may adversely impact future events, and that is not what we are looking for in our community. Something as simple as "movie in the park" may be impacted due to the noise level of the movies and the location of the apartments. We realize this is a very small item in such a large subject, but these types of events in the park are important to the community and draw families from all over. We received the information regarding Notice of Hearing. We have attended all meetings regarding this property. And will be at the scheduled meeting on July 19,2012. We don't wish to speak at the meeting. However, we want our concerns addressed and recognized at the meeting and before the meeting. Our backyard backs up to the Settler Park LLC development. We are very concerned and upset with the zone change that is different than the zoning mentioned in our ccr by laws. The medium/high density development will invade in our privacy greatly. And as existing home owners this is a problem. If we wanted rear neighbors/2 storey or more behind us we would have purchased a home according. Our rights as an existing homeowners and tax payer we have the right to keep our privacy. We are very concerned how it will effect our property value. Living next to any apartment type living will make a huge difference in our property value/ home resale. With the economy the way it is no one can afford to take a bigger hit/loss as we already have. We are also concerned with Neighborhood safety, traffic, crime and overall security in what comes with apartment building living. As homeowners that have spent/lost money on a serious water problem due to the type of soil, improper grading of the land, we are very concerned about the grading, drainage/seepage that this development may cause on our property. Since spending thousands of dollars to correct our problem back in 2007 we have not had drainage problems since. We feel with incorrect grading of the development, over water of the property, seepage drainage, etc. this will make a impact on our property. As property tax payers we are concerned what this development will do to our beautiful Settlers Park and the safety of all the many decent families that go there daily. Building apartments basically right on the park is huge problem. Especially if the apartments do not have a fence, wall etc. built around the property. This can be a huge problem for our community. Apartment living brings in a different clientele of people and being built on a park this will bring drugs, alcohol, crime etc to our existing community. Please take all of our many concerns into consideration. Building multi-family homes in our existing neighborhood and on a park is just not good. Please don't allow this project to proceed. Please require them to build something in the line of the current community/neighborhood environment. Bruce Murdock on July 31, 2003 (Subdivision CCRs ,written by Howell-Murdock Development Corporation and signed by Kevin A Howell (President) dated & notarized 12/10/2002). In this contract, Page 2, Section 1.3, states that "Phase 4 and possible Phase 5 are intended to be developed by the Declarant (Development Owner) and may be developed as some form of commercial office retail or other business related uses. A portion may or may not also be developed as a school site. "Also "In the event that the school site or the business phases are not developed f r school and business uses and are developed as single family residential uses, then the lots therein shall be subiect to these CCRs when and_ if annexed into these CCRs ". The section sites Exhibit C as reference which is a plot plan and specifically has Phase 4 identified as 61ots and written as "possible business lots". We signed off on this contract with the understanding there would possibly be business related use, if not more single family residential use. Under no circumstances would we have signed this contract as a home owner, if instead the intent stated by the "Declarant" included multi family residential use. Therefore, when the City of Meridian granted the zoning change from R4 to R15 during 2004- 2005 ,the City of Meridian failed to complete the legal land use rezoning process by not reviewing all legal documents (contracts in place with Owners in Cedar Springs Subdivision and the development owner) and by not requiring an undated development agreement in line with the legal CCR documents. It is the responsibility of the City of Meridian to serve its citizens with all legal due diligence. If the City of Meridian does not reverse the rezoning of this particulaz property back to R4 as required in legal contracts, legal recourse by hundreds of homeowners could result. Also, lack of action by the City of Meridian and the developer may be construed as fraudulent. Property owners throughout the subdivision were not informed of this rezoning change and did not receive any updated contractual information from the developer regarding the change from R4 to R15. Broadway Avenue Meridian, Idaho 83642 Re: PP 12-010 & CUP 12-006 To Whom it May Concern: This letter is in reference to the July 19, 2012 public hearing of the Meridian Planning and Zoning Commission of the City of Meridian pertaining to the Applicant's efforts to okaain preliminary plat approval consisting of five (5) building lots on 2.39 acres of land as well as approval of amulti-family development consisting of 36 units. I have been retained by the Cedar Springs Neighborhood Association, Inc. to address certain concerns that have been raised by a number of homeowners that live in that subdivision. A large number of homeowners have strong opinions conceming the proposed development. The Association has requested that I submit on its behalf the enclosed petition containing the original signatures of a significant number of residents in the subdivision. The petition specifically references an issue concerning the process through which the subject property was rezoned from R-4 to R-15. The strong opinions articulated by the homeowners derive from the fact that when they were induced by the developer to purchase lots in the subdivision they were assured that the subject property would not be developed in the manner that is now being sought. The Declaration of Covenants, Conditions and Restrictions for Cedar Springs Subdivision City Clerk LTR 07-12-12 No. 1 was recorded on January 8th, 2003 and provided to each of the lot purchasers prior to the closing of their purchase. Consistent with the verbal representations made by agents of the developer, the contemplated use was "some form o[fi] commercial, office, retail, or other related business uses." The developer also stated that it was possible that a portion could be used as a school site. My client has no objection to those intended uses. The lot purchasers were provided notice before they closed the transaction that the property could be developed in that manner. The developer also suggested that in the event that the subject property was not developed for business or school use any single family home located on the subject property would be subject to the same or similar covenants. The homeowners are upset because no effort has been made to reach out to them to explain the reasoning behind the current proposed use. Pursuant to rezone application RZ 04-014, the developer sought rezoning of the subject properly without disclosure to the homeowners who had already purchased lots, and those who would later purchase lots, that the contemplated use would be significantly different than those set forth in the covenants. The circumstances attendant with the rezone should be revisited and those issues raised in the petition explained. The Association also has no objection to those uses allowed in an R-4 zone. The Association does not believe that the posting requirements of UDC 11-5A-5 have been met but will further comment on this issue after the Applicant provides proof of property posting. The relevance of the applicable covenants is clear after reviewing the Applicant's claim that the currently proposed development is entitled to be connected to the existing pressurized irrigation system, presumably the system maintained by the Association, when the Association has not agreed to that use. Many of the homeowners have voiced concerns over the issue of safety. The issues relate primarily to the unique circumstances attendant with the adjacent Settlers Park. The Park's location has historically created parking and traffic demand which exceeds the neighborhood's capacity to comfortably accommodate the increased use. The Applicant's development will increase those stressors without mitigation. The Association contends that increased lighting, additional parking and installation of crosswalks is necessary to reduce the risks of injury or death. The Association understands that this property can and should be developed.
