APPLICATION SUMMARY The applicant, Greg Renfi•ow, has submitted an application requesting approval to vacate the two 5-foot wide public utility, drainage, and irrigation easements located on the interior shared lot line between Lots 4 and 5, Block 3 of Sond Subdivision. ll. STAFF RECOMMENDATION Staff recommends approval of the proposed vacation application. III. APPLICATION ANll PROPERTY FACTS A. Site Address/Location: The subject property is located at 1080 N. Crystal Cove Avenue on Lots 4 & S, Block 3, Sond Subdivision. The site is generally located west of N. Black Cat Road, approximately Y mile south of W. Cherry Lane, in the northeast'/a of Section 9, Township 3 North, Range 1 West. B. Owner/Applicant: Gregory Renfrow & Shenna Smith 11870 W. Tidewater Drive Boise, ID 83713 C. Representative: Richard Evans, Eric Evans Construction, Inc. 9560 W. Pebblebrook Ln. The subject application is a request to vacate platted easements. Per Meridian Cily Code, a public hearing is required before the City Council on this matter. The UDC does not require the site be posted with a public hearing notice sign. B. Newspaper notifications published on: June 25, and July 9, 2012 C. Radius notices mailed to properties within 300 feet on: June 21, 2012 VI. LAND USE A. Existing Land Use(s): The subject property lies within Sond Subdivision, is zoned R-4, and is currently vacant. B. Character of Surrounding Area and Adjacent Land Use and Zoning: The property surrounding the site is a residential subdivision, zoned R-2 and R-4. C. History of Previous Actions: A property boundary adjusUnent (PBA-12-005) was approved on April 19, 20] 2 for this property that combined Lots 4 and 5, Block 3 into one buildable ]ot (ROS #9181). D. Utilities: NA 1. Public Works: a. Location of sewer and water: NA b. Issues or concerns: NA E. Physical Features: 1. Canals/Ditches Irrigation: NA 2. Hazards: NA VII. AGENCY COMMENTS MEETING No comments were received by the Planning Department from other City departments for the subject application. Please see the public record for the VAC file for any written comments that may have been submitted by other agencies. VIII. ANALYSIS Analysis Leading to Staff Recommendation: The applicant requests approval to vacate the two 5-foot wide permanent public utilities, drainage, and irrigation (PUDI) easements located on the common lot line between Lots 4, and 5, Black 3 of Sond Subdivision. The two lots have been combined into one property through a property boundary adjusnnent and record of swvey. The applicant states there are no utilities within the PUDI easements. Approval of the subject vacation will allow the applicant to construct a home over the easement area. All public utilities (Idaho Power, Cenhuy Link, Cable One, Intermountain Gas) along with the Sond Subdivision HOA have given consent to relinquish their easements. NMID submitted a letter stating they have no facilities within the easement area.
