Re: Preliminary Plat and Development Agreement Modification -Canterbury Commons

Dear Mr. Friedman:
Attached to this letter is a new Preliminary Plat application and associated Development Agreement
Modification application for the Canterbury Commons Subdivision. These applications include parcels
S1211325300,S1211325420,S1211325499,S1211325610,S1211325710,and S1211324810.
This property was annexed and zoned under application AZ-06-013. Other previous applications
include CUP-06-006 to construct amulti-family development; PS-06-005 for a private street within the
multi-family development; and VAR-06-005 to allow lot sizes in the R-15 zone below the 2400 square
foot minimum and to allow for a reduced rear setback. A previous preliminary plat for multi-family
residential was processed under PP-06-011. The previous preliminary plat and other applications were
never finalized and have since expired.
A Development Agreement exists between the City and J.S. Risi Revocable Family Trust and Risi
Family Limited Partnership, Owners, and American West Homes, LLC, Developer and was recorded
November 30, 2006, Instrument number 106187188. The property is under new ownership, namely,
Hartland Homes, LLC. We are proposing that the existing Development Agreement for the multi-family
development be modified specific to a single family development.
The development agreement areas of modification include:
Parties: 2 and 3 be deleted and replaced with Hartland Homes, LLC.
3.2 and 3.3 be replaced with Owner: Hartland Homes, LLC 2358 S. Titanium PI, Meridian, ID 83642.
4.1 delete "of a multi family development consisting of 116 residential lots (49 4-plex lots and 67
townhouse lots" replace with "of 119 parcels including 107 single family dwelling lots and 12
common/open space lots"
5.1.9 replace "May 19, 2006" with "March 27, 2012".
5.1.10 delete and replace with "That no more than 107 single-family buildable lots may be constructed
on the site. "
5.1.11 delete entirely.
5.1.12 add "if required by VRT" at the end of the sentence.
14. Add: "It is the intent that the development will be phased. The Pine Avenue frontage
improvements will be completed with the first phase. All other improvements will be specific to the
phase being developed."
16: Notices: remove the Developer and update Owner per the Parties.

Exhibits: replace with new findings for the proposed single family residential preliminary plat submitted
with this letter including elevations.
The current zoning consists of approximately 21.77 acres of R-15, Medium High Density Residential.
We are not proposing a change to the zoning designation.
The proposed preliminary plat consists of asingle-family residential subdivision which includes 107
building lots with an average lot size of approximately 5700 SF. The proposed plat includes 12
common/open space lots which combined total approximately 2.5 acres or 13.2%. A children's play
area with play structure; an open space with pathway at the western property boundary; and an
additional open space at the south property boundary for a future pathway is included.
All roadways within the plat will be public right of way. ACRD has confirmed that a traffic study is not
required.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11-SA-SD, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
I am aware of the above requirements and will comply with the posting requirements as stated in
UDC 11-SA-5.
