This matter coming on regularly before the City Council on March 13, 201 1, upon the
A licant's submittal of a request for City Council review of the Director's decision in regard to

the accessory use permit application submitted by the applicant for the allowance of a home
occu anon in an accessory structure. The Director denied the applicant's request based on the
p
ro osed home occupation did not meet the standards set forth in Unified Development Code 11-
pp
4-3-21.
IT IS HEREBY ORDERED THAT:
The above named Applicant is granted approval to operate a home occupation out of an
accessory structure at 1750 N. Ten Mile Road with the ongoing conditions of approval:

1. No outdoor storage, display or signs in the front yard adjacent to N. Ten Mile Road. The
sign on Ten Mile that says" I Replace Shovel Handles" is allowed to remain as long as
the sign does not change in terms, cost, times, locations, or any other advertising, and
there is no complaint from the owners of the fence.
2. Vehicular access to the accessory structure (detached garage) shall be taken from N. Ten
Mile Road between Walgreens and just south of the subject property.
3. One sign, prepared by a professional sign designer, not to exceed six square feet in size is
allowed. The subject sign may be a freestanding sign located near the display area or a
building sign attached to the accessory structure.
4. Only refurbished and other goods for sale may be displayed on the pad in front of the
accessory structure. All raw materials (goods not refurbished for sale) shall be stored out
of public view either on the north side of accessory structure or shall be screened by a six
foot fence. The raw materials may not be stored on the pad of the accessory structure.
This area is for the display of goods for sale.
5. The accessory structure shall be connected to the main house with a trellis as approved by
City Council.
6. One space for customer parking is required. If parking is not provided on the pad in front
of the accessory structure, written permission for off-site parking is required from the
appropriate adjacent property owner.
7. The permit is subject to revocation by the City with thirty days notice and the approval
shall cease with a change of ownership of the property.
