RE: Browning Plaza Subdivision Time Extension -Justification Letter
Dear Mayor and Council;
As representative for Boise-Waltman, LLC, please accept this request for a time extension for
Browning Plaza Subdivision preliminary plat, located on the south side of Waltman Lane, west of
Meridian Road in Meridian, Idaho. Browning Plaza Subdivision includes 38.21 acres and was
originally approved for 40 commerciaUoffice/retail lots with 2 common lots. The original approval
included annexation with a zoning designation of CG.
This letter is included with the land use applications for administrative time extension, together with
filing fees and required exhibits.
'The original approval date on this application was October 7, 2008 with a two year approval period.
Due to the fact that the original developer of the property had fallen out of contract with the properly
owner, and because of the slow commercial market, an 18 month time extension was requested and
approved by the Planning Director on October 8, 2010. The applicant is continuing to market the
development, and has recently received approval of a two year extension on their agreement with
MDC, thus insuring the property's attractiveness to a new potential buyer. It is hereby requested that a
two year extension be granted for the preliminary plat. It is understood that all conditions of approval
and the existing development agreement are in place with this development, and the applicant
continues to honor those agreements.

COMNIITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC} 11-SA-SD, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when. the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
