On March 26, 2012, Mr. and Mrs. Palmer filed an application for a Certificate of Zoning
Compliance Verification to allow a residence within a retail store located at 1524 N.
Meridian Road. The property is located in a Community Business (CC) zone district.
The Unified Development Code, table of allowed uses (Table 11-2B-2) identifies multifamily
development as a Conditional Use in the CC zone district. This is the only form of residential
development referenced in the district. Since the requested use did not constitute multifamily
development by definition or function, the application was denied and the Palmers subsequently
applied for City Council review of that decision.
