DESCRIPTION OF APPLICANT'S REQUEST

The applicant, Corey Barton, requests Certificate of Zoning Compliance (CZC) and design review (DES)
approval for the overall site layout, amenities and building design of the Westborough Square multi-
family development. The overall site layout and elevations were approved with a conditional use permit
(CUP -05-027) and remains valid. Currently all of the driveways, parking areas, trash enclosures and
garage footings are constructed on the site.
At build -out, the proposed development will consist of ten (10) multi -family structures with a total of
forty (40) two bedroom residential units. Amenities proposed for the development are as follows: a
community garden, two (2) public art displays, common open space and a play structure with benches
around the play area.
For permitting and occupancy purposes, the applicant is proposing to construct Phase 1 which consists of
two four-plex building, two garages and one (1) public art display. Phase 1 improvements have been
clouded on the approved plans. All improvements associated with phase 1 need to be completed prior to
occupancy of the structures. Future CZC approval is required for the remaining carports, garages and
multi -family structures prior to the issuance of a building permit.
Alternative compliance (ALT) is also proposed in regard to the covered parking requirements set forth in
UDC 11-3C-6. Based on the number of units, 80 covered stalls are required. The site complies with the
required number of parking stalls (86 stalls) as set forth in the UDC. The applicant is proposing to off -set
the required covered parking by providing 13 more covered stalls and three (3) additional site amenities
(see ALT analysis below). A total of 53 stalls will be covered.
The property consists of 5.4 acres of land and is zoned R-15 and L -O. At this time, the owner is only
proposing to develop the R-15 zoned portion of the property (2.85 acres).
The site is located at 6340 N. Jericho Road.
DECISION
The applicant's request for CZC, DES and ALT is approved with the conditions listed in this report
Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify if you
need a building permit and/or inspection. If you do need a building permit, you must complete that
process before you commence the use or construction. As part of the application submittal, you will
need to provide one(]) set of the final, stamped "approved" Planning Department plans. You must
provide these plans in PDF format and hardcopy as specified in the Building Services "Plan Intake
Checklist" and include them with your building submittal set. Please contact Building Services for
additional details about building permits and inspections.

Site Specific Conditions of Approval
1. The applicant shall construct all proposed fencing and/or any fencing required by the UDC,
consistent with the standards set forth in UDC 11-3A-7 and 11 -3A -6B.
2. Record a legally binding document that states the maintenance and ownership responsibilities for
the management of the development, including, but not limited to, structures, parking, common
areas, and other development features, per UDC 11-4-3-27G. Prior to issuance of Certificate of
Occupancy provide a copy of said document to the Planning Department.
Process Conditions of Approval
1. No signs are approved with this application. Prior to installing any signs on the property, the
applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3
Article D and receive approval for such signs.
2. The applicant shall complete all improvements related to public life, safety, and health as set forth
in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with
UDC 11 -5C -3C.
3. Upon installation of the landscaping and prior to inspection by Planning Department staff, the
applicant shall provide a written certificate of completion as set forth in UDC 11 -3B -14A.
4. The site plan prepared by The Architects Office dated 2/1/12, labeled Sheet A1.3, is approved
(stamped "approved" on 3/21/12 by the City of Meridian Planning Department) with no changes.
5. The landscape plan prepared by The Land Group labeled Sheets L1.0 and L1.1, is approved
(stamped "approved" on 3/21/12 by the City of Meridian Planning Department) with no changes.
6. The approved site plan, landscape plan and/or elevations may not be altered without prior written
approval of the City of Meridian Planning Department.
7. The elevations and carport rendering prepared by The Architects Office dated 2/1/12, labeled
A5.0, A2.2, are approved (stamped "approved" on 3/21/12 by the City of Meridian Planning
Department) with no changes.
8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit.
9. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant
shall submit a new site plan to the City of Meridian Planning Department for approval prior to
issuance of the building permit.
10. The applicant shall complete all required improvements prior to issuance of a Certificate of
Occupancy. It is unlawful to use or occupy any building or structure until the Building Official
has issued a Certificate of Occupancy.
Ongoing Conditions of Approval
1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets
the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth
in UDC 11-3B-5, UDC 11-313-13 and UDC 11-3B-14.
2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in
UDC 11-3A-14.
3. The project is subject to all current City of Meridian ordinances and previous conditions of
approval associated with this site (AZ -05-018, CUP -05-027 and Development Agreement
Instrument No. 105152707).

4. The issuance of this CZC does not release the applicant from any previous requirements of the
other permits issued for the site.
The applicant and/or property owner shall have an ongoing obligation to prune all trees to a
minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the
area.
6. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set
forth in UDC 11-3A-11.
7. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping
and constructed features within the clear vision triangle consistent with the standards in UDC 1I -
3A -3.
8. The applicant shall have an ongoing obligation to maintain the pathway along Chinden Boulevard
(HWY 20/26).
ANALYSIS OF UDC REQUIREMENTS RELATED TO THE ALTERNATIVE COMPLANCE
The applicant has submitted a request for alternative compliance pertaining to the covered parking
standards, as follows:
The applicant requests approval of alternative compliance to UDC 11-3C-6Awhich requires
covered parking for all two bedroom multi -family units. Because construction has commenced on
the site (driveways, parking and garage footings) per the approved site plan, the applicant is
unable to comply with the current covered parking requirements of the UDC. Further, the site
plan approved by the CUP makes it difficult for the applicant to provide the necessary separation
between carport structures and the dwelling units set forth in the IBC and IFC. As an alternative,
the applicant is proposing to provide five (5) carport structures (13 additional covered spaces) and
provide three (3) additional site amenities (two (2) public art displays, and a community garden).
Since the number of parking stalls complies with the requirements of the UDC and the amount of
amenities proposed for the development exceeds the current requirements for multi -family
developments, Staff believes the proposed changes will enhance the quality of the development as
encouraged by the Meridian Design Manual. Staff approves the request in accord with UDC 1I-
5B-5B.2f.
ALTERNATIVE COMPLIANCE FINDINGS:
In order to grant approval for alternative compliance, the director shall determine the following
findings:
1. Strict adherence or application of the requirements is not feasible; OR
Since the proposed development has commenced and the IBC and IFC limit the separation
between the carports and the dwelling units, strict adherence to the UDC is not feasible. Staff
finds the propose site amenities adds to the quality of life more so than compliance with the
required covered parking stalls. Staff finds the proposed alternative meets the intent of the
Meridian Design Manual.
2. The alternative compliance provides an equal or superior means for meeting the
requirements; and
The Director finds the applicant's proposal to provide the 13 covered stalls and the three (3) site
amenities provides an equal means for meeting the requirement of the covered parking set forth in
the UDC.
3. The alternative means will not be materially detrimental to the public welfare or impair the
intended uses and character of the surrounding properties.

Staff finds that the proposed alternative will not be detrimental to the public welfare or impair the
use/character of the surrounding properties since the number of parking stalls complies with the
requirements of the UDC.
CITY COUNCIL REVIEW
The applicant or a party of record may request City Council review of a decision of the Director. All
requests for review shall be filed in writing with the Planning Department on or before April 6, 2012,
within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-
5A -6B.
If City Council review of the decision is not requested, the action of the Director represents a final
decision on a land use application. You have the right to request a regulatory taking analysis under Idaho
Code 67-8003.
EXPIRATION
Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has
not commenced within one year of the date of issuance of the Certificate of Zoning Compliance.
Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure
shall expire if said construction or alteration has not commenced within one year of the date of issuance
of the Certificate of Zoning Compliance.
In accord with the above provisions, the subject Certificate of Zoning Compliance is valid until March 21,
2013.

Please accept this Design Review Application for the above referenced project. This application is for 10
apartment buildings, garages and carports in the Westborough Square Subdivision. The parking lots,
street and sidewalks are existing, approved under CUP -05-027 before the project was stopped.
The proposed project addresses the guidelines contained in the Meridian Design Manual (specifically
sections C and E) and UDC 11-3A-19:
1. Architectural Character:
a. The building design utilizes facade modulation and changes in materials, details and
colors to offset the visual mass of the building and provide interest at different scales.
b. Roof lines are modulated through the use of hip & gable roof forms.
C. The building entrances provide additional visual interest, a more pedestrian scale and
reduce the appearance of the overall building mass.
d. Pattern variations are achieved by the use of different types of siding, overhangs,
columns and entrance details.
e. Window openings have been placed in appropriate locations for spaces within the
buildings as well as providing a balanced window arrangement.
f. The mechanical equipment will be screened by landscaping and fencing as appropriate.
2. Materials: See attached elevations. Colors will be utilized to reduce the overall mass of the
building and emphasize the modulation of the building mass.
3. Parking Lots: Parking is provided along the interior streets, in garages, and under covered
carports. A mixture of covered and non -covered parking is proposed.
a. Parking areas are located at the interior of the project and contain large planting islands
for trees and shrubs.
b. The parking is screened fi-om adjacent uses and the street by the buildings.
C. Carports with roof shapes similar to those of the apartment buildings are proposed for the
covered stalls.
d. The internal vehicular circulation is an appropriate and efficient configuration for a small
residential project.
4. Pedestrian walkways and facilities:
a. The buildings are located along the private streets to provide convenient walking
distances for pedestrians. The buildings are oriented to the public streets to provide a
neighborhood presence and compatibility with future developments.

Please accept this narrative as required for the Alternative Compliance Application for the above
referenced project. This is application is for ten 4-plex buildings and 10 garage buildings on Lot 7, Block
1, Westborough Square Subdivision. The use of these buildings will be multifamily residential buildings.
As you may be aware, the roadways, curbs, gutters, sidewalks, fencing, landscaping and garage
foundations were constructed before the project was put on hold due to the economy. In the meantime,
various codes and ordinances affecting this development have changed. We are requesting acceptance of
our Alternative Compliance for the following item:
Covered Parking Requirements: Prior requirements for covered parking for this project were met by
providing (36) parking spaces within enclosed garages. In order for the paving of the project to be
accomplished, the foundations for these garages were installed. Current covered parking requirements are
such that all of the (80) parking spaces would need to be covered. We have evaluated the site to add as
many additional covered parking spaces as possible. Due to building/fire code required setbacks between
buildings and carports/garages we are only able to provide a total of (53) total covered parking spaces.
We are proposing to provide (1) additional site amenity, and additional common open space as an
alternative.
