The property owner, Nunzio Sgroi, at 4405 East Ustick Road, is requesting a
Development Agreement Modification.
The following modifications are requested to Section 5 `CONDITIONS GOVERNING
DEVELOPMENT OF SUB.IECT PROPERTY.
5.1.3. Allow 14 Single Family Homes 8~ 2 Townhomes with the rezone to R-8.
5.1.4. A conceptual development plan for the subdivision is attached.
The Single Family Lots would range in size from 5,016 to 6,731 Sq. Ft. The Townhome
lots would be 4,339 & 4,562 Sq. Ft. The subdivision would be accessed from Red
feather Estates Subdivision No. 2 on East Arch Drive. This is required by ACRD, who
will closed off access from Ustick Road after it is widened and the property is
developed. A landscape island with signage would be located at the entry to the
subdivision. Traffic speed bumps and a stop sign would also be located at the
entrance, The street would be 37' from back of curb to back of curb. A 5' sidewalk and
2' strip would be between back of curb and lot property lines. ACRD requires an 18'
paved drive to the adjacent property to the west. The street will dead end into a 4$'
radius turn-a-round for use of emergency vehicles. A 35' landscape buff separated the
property from Ustick road. ACRD purchased a 24' strip on the north-end of the property
in March of last year.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11-SA-SD, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
I am aware of the above requirements and will comply with the posting requirements as stated in
UDC 11-SA-5.
