Tenant shall have the right to place signage subject to applicable codes and Landlord's prior written consent. Upon termination of the term hereof, Tenant shall, at its sole cost and expense, remove all signs, installation and devices and repair all damage caused by the installation, maintenance and removal thereof, including repainting as needed. ARTICLE 16 SURRENDER OF PREMISES 16.1 TERMINATION. Tenant shall, upon termination of the term hereof or any extensions or renewals thereof, or any earlier termination of this Lease, surrender the Premises to the Landlord, including, without limitation, all building apparatus and lmprovements not covered by Paragraph 17.2 hereof and all alterations, Improvements and other additions which may be made or installed by either party. 16.2 REMOVAL OF FIXTURES, FURNITURE, ETC. Trade fixtures, furniture, equipment and signs that may be installed in the Premises prior to or during the term hereof at the cost of Tenant shall not be deemed to become a part of the Premises and may be removed by Tenant from the Premises at or before the end of the term hereof, if Tenant be not then in breach. Tenant shall repair, at its own cost and expense, any and all damages to the Premises resulting from or caused by such removal, and shall restore the Premises to their original condition, reasonable wear and tear excepted. Lighting fixtures, electrical panels, heat, ventilation and air conditioning units, wiring and duct work, security systems, all other attached systems or appliances, and all other Tenant Improvements shall be the property of the Landlord and shall not be removed. Tenant shall have fifteen (15) business days after termination of this Lease for any reason whatsoever to effect such removal, repair and restoration; provided, however, that no such fixtures or equipment placed on or in the Premises by Tenant, and which remain the property of Tenant, may be removed at a time when Tenan# is in breach in payment of rent or any other money payable hereunder. Tenant shall not be required to pay rent for the fifteen (15) business day removal period. 16.3 HOLDING OVER. if Tenant remains in possession of the Premises or any part thereof after the expiration of the term hereof without the express written consent of Landlord, such occupancy shall not be deemed a renewal or extension of this Lease for any term whatsoever or for a month to month tenancy. To the extent Tenant occupies the Premises beyond the term of this Lease, Tenant agrees: (a) to pay Landlord as rent per day a sum equal to one hundred and twenty five percent (125%) of the Monthly Minimum Rent per day applicable to the last month of the term hereof (b) to pay all other charges payable hereunder; and (c) to otherwise abide by all the terms, covenants and conditions of this Lease applicable to such an occupancy. Nothing contained in this section shall be construed as consent to such occupancy. If Tenant fails to surrender the Premises upon the termination of this Lease, Tenant shall indemnify, defend and hold harmless Landlord from loss or liability resulting from such failure, including, without limiting the generality of the foregoing, any claims made by the succeeding tenant arising out of such failure to surrender the Premises. ARTICLE 17 MISCELLANEOUS PROVISIONS 17.1 ESTOPPEL STATEMENT. Tenant shall from time to time and within thirty (30) days after receipt of written notice from Landlord execute, acknowledge and deliver to Landlord a statement in writing, in a form provided by Landlord, that may be relied upon by any prospective purchaser or encumbrancer of the Premises or of all or any portion of the real property of which the Premises are a part. Sign Location: Free-standing signs shall be located as near to the primary access driveway as practical. Distance, for the purpose of establishing location, shall refer to the linear distance in either direction on the street to which the sign faces only. c. Number: One center sign per one-thousand feet (1000') of street frontage, or fraction thereof, may be permitted. In addition to the main center sign, one (1)free-standing sign for each building within the center is permitted, with size and background area in accordance with Tables C-G, provided that no sign exceeds a height of ten feet (10') and background area of seventy (70) square feet. d. This letter outlines my review and approval notes of the Planned Sign Program. The number and types of approved signage are as follows: Center Signs (the larger signs on Franklin and Linder Roads) Total # of allowed Center/Commercial type signs = 2 (one on each street frontage) • Total # of proposed Center/Commercial signs = 2 (one monument on Franklin and one pole-type on Linder) • Applicant applied for both of these signs with a Commercial Sign Permit and they are approved as submitted. The maximum height and background area for any future sign modifications shall be as per the adopted sign code. Single Building Signs (smaller free-standing signs to identify individual buildings within a project) • N/A (none proposed) Wall Signs • Total # of allowed wall signs =one (1) per business, plus one (1) additional sign per wall • The following wall signs were proposed under a Commercial Sign Permit application: a) Arctic Circle (submitted by Lytle Signs for north elevation), b) Shell food mart, and c) the car wash facility. These signs are approved as submitted. One (1) additional wall sign is proposed under the Sign Program for the east elevation of Arctic Circle and one (1) additional for the coffee shop. These future signs will require separate Commercial Sign Permits.
