CHERRY LANE MERIDIAN IDAHO 83642 A. INTRODUCTION/ GENERAL PROVISION The intent of this sign program is to provide guidelines to achieve a visually coordinated, balanced and appealing sign environment that is harmonious with the architecture of the buildings. 1. These sign guidelines shall be enforced and nonconforming signs shall be removed by the tenant at their expense, upon written notification by the Landlord. 2. Exceptions to these standards. shall not be permitted with out approval from the Landlord and will require approval of the modification to the sign program application by the City of Meridian. 3. The Landlord will retain full rights of approval for any sign used in the center. 4. No sign shall be installed with out the written Landlord approval. 5. No sign shall be installed without the required permits from the City of Meridian, Idaho. 6. Each Tenant shall pay all costs for its signs including manufacture, installation, maintenance, and City of Meridian permit fees. 7. Each Tenant shall be fully responsible for and repair any damage to any surface caused by the signage or its' installation. 8. Upon vacancy, Tenant shall remove sign and restore fascia to original condition at Tenant's sole cost and expense within fifteen (15) days of expiration of term or earlier termination of Tenant's lease. 9. Illumination of signage shall be controlled so that no signs are illuminated after normal business hours for those tenants not open 24 hours/day. 10. Any tenant sign left after thirty (30) days from vacating premises shall become the property of Landlord. B. LANDLORD/ TENANT REQUIREMENTS Prior to submittal to the City of Meridian, Owner's approval must be obtained. 1. The Tenant shall submit for approval four (4) sets of detailed drawings to: • Supervalu • 250 Parkcenter Blvd. • Boise, ID 83706 • Telephone 208-395-4571 • Fax 280-395-4476 2. These drawings shall include all building elevation to which the signs are to be attached, sign dimensions, graphics, location, colors, and method of attachment per the specifications identified in this Master Sign Program. 3. All signs shall be reviewed for conformance with this criteria and overall design quality. 4. Approval or disapproval of sign submittals based on aesthetics of design shall remain the sole right of the Landlord. C. PROHIBITED SIGNS The following types of signs are prohibited in all districts: 1. Signs within public right of way or upon city owned property. 2. Signs or posters which are within or visible from a public right of way and are tacked, pasted, or otherwise affixed to or upon the walls of buildings, barns, sheds, or upon trees, poles including, but not limited to, power poles, posts, fences, bridges, or other structures, except official public notices posted by a public officer. 3. Portable signs, banners, pennants, strings of lights, ribbons, streamers, spinners, twirlers or propellers, balloons, bubble machines and similar devices of a carnival nature except as may be permitted by The City of Meridian, and the Owner. 4. Signs which because of color, wording, design, movement, location or illumination resemble or conflict with any traffic control device or with the safe and efficient flow of traffic. 5. Signs which emit any sound, odor or visible matter. 6. Abandoned nonconforming signs. 7. Any sign erected and constructed wholly on and over the roof of a building, supported by the roof structure or extending vertically above the highest portion of the roof. 8. Any signs on a vehicle or trailer, on either public or private property which is visible from a public right of way, which is intended to attract or direct customers to a business on or near the property. 9. Strobe lights. 10. Signs for illegal uses. D. INSPECTION Landlord reserves the right to hire an independent electrical engineer at the Tenant's sole expense to inspect the installation of all Tenant signs and to require the Tenant to have a discrepancies and /or code violations corrected at the Tenant's expense. E. SIGN CONSTRUCTION / DESIGN REQUIRMENTS 1. All signs and their installation shall comply with all local building and electrical codes. 2. All electrical signs will be fabricated by a U.L. approved sign company according to U.L. specifications and bear U.L. Label. 3. Sign company to be fully licensed with the City and State and shall have full Workman's Compensation and general liability insurance. 4. All penetrations of building exterior surfaces are to be sealed waterproof in color and finish to match existing exterior. 5. Internal illumination to be 30 or 60 milliamp neon, LED's or fluorescent tubes. 6. Logo and letter heights shall be as specified and shall be determined by measuring the normal capital letter of a type font exclusive of swashes. 7. Sign must be made of durable rust -inhibiting materials that are appropriate and complimentary to the building. 8. Exposed raceways are not permitted unless they are incorporated into the overall sign design. 9. Exposed junction boxes, lamps, or tubing of any type are not permitted. 10. All raceways, conduits, etc... installed on rock background, corrugated metal and/or back of parapets to be painted a specific color to be obtained from the architect. 11. The following types of construction shall be allowed: • Acrylic face channel letters or cabinets • Reverse pan channel letters with halo illumination • Push thru letters and logo in aluminum cabinets • Flat cut out dimensional shapes and accents • Metal screen mesh accents F. WALL SIGNAGE 1. The following signs shall be allowed: a. Any number of wall signs at any location or orientation, except toward an adjoining residential property, provided that the total square footage of all signs do not exceed nine percent (9%) of the wall. 2. Major tenants (Albertsons Sav-on Pharmacy) a. Shall be considered the primary signs b. Front Elevation shall be allowed: i. Trademark colors, font style and logo design, not to exceed the allowable nine (9) percent of the wall area. c. Any other side of the building that does not face residentially i. One (1) wall sign ii. Shall count towards the allowable nine 9% on the wall area 3. Sub -Tenants a. All bullet and sculpted cabinet logos shall be secondary in nature to the primary signs b. Front Elevation i. Businesses with registered trademark shall be allowed their colors, font style and logo design. ii. Tenants that do not have registered trademark shall be allowed signs per general requirements outlined with in the sign criteria. iii. One wall (1) sign may be permitted and square footage shall count towards the allowable nine 9% on the wall area. c. Any other side of the building that does not face residentially i.
