DESCRIPTION OF APPLICANT'S REQUEST
The applicant, Walmart Real Estate Business Trust, requests Certificate of Zoning Compliance (CZC)
approval of a 167,653 square foot retail store with adrive-thru pharmacy on 19.75 acres of land in a C-G
zoning district.
The site is located at 795 W. Overland Road on the southeast corner of W. Overland Road and S.
Stoddard Road.
Note: A public access easement for the multi-use pathway along Stoddard Road and along the east
boundary of the site was approved by City Council on February 7, 2012 and subsequently recorded as
Instrument No .112011846. Across-access easement to the ICON Credit Union property located at the
northeast corner of the site was recorded as Instrument No. 111101347.
DECISION
The applicant's request for CZC is approved with the conditions listed in this report.
Note: This is not a building permit Please contact Building Services at (208) 887-2211 to verify if you
need a building permit and/or inspection. If you do need a building permit, you must complete that
process before you commence the use or construction. As part of the application submittal, you will
need to provide two sets of the final, stamped "approved" Planning Department plans. You must
provide these plans in PDF format and hardcopy as specifed in the Building Services "Plan Intake
Checklist" and include them with your building submittal set. Please contact Building Services for
additional details about building permits and inspections.
Site Specific Conditions of Approval
1. The applicant shall construct all proposed fencing and/or any fencing required by the
UDC, consistent with the standards as set forth in UDC 11-3A-7 and 11-3A-6B.
2. The hours of operation of the pharmacy drive-thru are limited to 9 am to 9 pm Monday
thru Friday; 9 am to 7 pm Saturday; and 10 am to 6 pm Sundays, per CUP-11-002.
Process Conditions of Approval
1. No signs are approved with this application. Prior to installing any signs on the property, the
applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3
Article D and receive approval for such signs.
2. The applicant shall complete all improvements related to public life, safety, and health as set forth
in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with
UDC 11-SC-3C.

3. Upon installation of the landscaping and prior to inspection by Planning Department staff, the
applicant shall provide a written certificate of completion as set forth in UDC 11-3B-14A.
4. The site plan prepared by PacLand on 11/8/11, labeled Sheets C-1.0, SP2, & SP2.1, is approved
(stamped "approved" on 12/12/11 by the City of Meridian Planning Department) with no
changes.
5. The landscape plan prepared by PacLand on 11/8/11, labeled Sheet L-1.0, is approved (stamped
"approved" on 12/12/11 by the City of Meridian Planning Department) with no changes.
6. The approved site plan, landscape plan and/or elevations may not be altered without prior written
approval of the City of Meridian Planning Department.
7. The elevations prepared by BIZR Architecture on 11/18/11, labeled Sheets 1 and A2, are approved
(stamped "approved" on 12/12/11 by the City of Meridian Planning Department) with no
changes.
8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit.
9. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant
shall submit a new site plan to the City of Meridian Planning Department for approval prior to
issuance of the building permit.
10. The applicant shall complete all required improvements prior to issuance of a Certificate of
Occupancy. It is unlawful to use or occupy any building or structure until the Building Official
has issued a Certificate of Occupancy.
11. At such time that the multi-use pathway connects from one major street to another and is greater
than one-half mile long, the applicant may petition the City to assume maintenance
responsibilities.
Ongoing Conditions of Approval
1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets
the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth
in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14.
2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in
UDC 11-3A-14.
3. The project is subject to all current City of Meridian ordinances and previous conditions of
approval associated with this site (AZ-07-009; MDA-11-005; CUP-11-002).
4. The issuance of this CZC does not release the applicant from any previous requirements of the
other permits issued for the site.
5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a
minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the
area.
6. The applicant shall have an ongoing obligation to maintain all pathways.
7. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set
forth in UDC 11-3A-11.
8. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping
and constructed features within the clear vision triangle consistent with the standards in UDC 11-
3A-3.

CITY COUNCIL REVIEW
The applicant or a party of record may request City Council review of a decision of the Director. All
requests for review shall be filed in writing with the Planning Department on or before February 24,
2012, within fifteen (15) days after the written decision is issued, and contain the information listed in
UDC 11-SA-6B.
If City Council review of the decision is not requested, the action of the Director represents a final
decision on a land use application. You have the right to request a regulatory taking analysis under
Idaho Code 67-8003.
EXPIRATION
Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has
not commenced within one year of the date of issuance of the Certificate of Zoning Compliance.
Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure
shall expire if said construction or alteration has not commenced within one year of the date of issuance
of the Certificate of Zoning Compliance.
In accord with the above provisions, the subject Certificate of Zoning Compliance is valid until
February 9, 2013.

Certificate of Zoning Compliance and Design Review Narrative
Walmart Real Estate Business Trust is the contract-purchaser of approximately 20 acres located at
the southeast corner of Stoddard and Overland Roads in Meridian, Idaho. The zoning designation
for the property is C-G "Commercial General", and the planning designation is
"Urban/Suburban". The proposed site development is depicted on the Site Plan included with
Certificate of Zoning Compliance and Design Review application package. Conditions and design
guidelines for development include those presented in the City of Meridian Urban/Suburban
Design Guidelines and the Amended and Restated Development Agreement. It is our opinion
that the proposed application is Zoning Compliant and that it meets all requirements of the
Urban/Suburban Design Guidelines, applicable Conditions of the Development Agreement, and
City of Meridian Unified Development Code. Brief discussion of how the proposed development
meets each criterion is provided below:
A. Applicable Conditions presented in the Amended and Restated Development Agreement
(please refer to the Development Agreement for specific Exhibits. and Articles of the
Agreement referenced in the verbatim conditions listed below):
1. The public stub street (Alaska Street) in Bear Creek Subdivision along the south property
boundary shall not be extended as a public or non-public street into the Property but
shall be used as an emergency access point and pedestrian pathway into the Property.
At no time shall construction traffic associated with the development of the Property be
allowed to access this Property using Alaska Street.
The vehicle access point at the Alaska Street connection is proposed for removal. Only
pedestrian access will be allowed.
2. Access points to/from the site are limited to those shown on the conceptual development
plan attached hereto as Exhibit B and by this reference incorporated herein, unless
otherwise restricted/approved by ACHD.

Accesses are proposed as allowed.
3. Prior to issuance of the first Certificate of Occupancy for either of the two properties
along the east boundary, construct amulti-use pathway from the sidewalk on the stub
street at the south boundary (Alaska Street) along the east side of the property,
connecting to the pathway on the ICON Credit Union site to Overland Road. Prior to
issuance of the Certificate of Occupancy for the largest building pad, construct a multi-
use pathway from the south boundary within the street buffer adjacent to S. Stoddard
Road along the west side of the property to the Overland/Stoddard intersection. In the
interim of the pathway along the east boundary being constructed, a pedestrian
connection shall be provided from Alaska Street at the south boundary to the Walmart
site and Overland Road as shown on the concept plan with development of the largest
building pad. A public pedestrian easement shall be recorded for the portions of the
pathways that lie outside of the right-of-way on the subject property; a copy of said
easement shall be submitted to the Planning Department with the related Certificate of
Zoning Compliance application.
The Owner/Developer shall design and construct the multi-use pathways in accordance
with UDC 11-3A-8 and in conjunction with the Parks Department's standards, except
that the pathways are allowed to be 8 feet in width, instead of 10 feet. Additionally,
where the pathway(s) crosses drive aisles, the pathway(s) shall be distinguished from the
driving surfaces through the use of pavers, colored or scored concrete, or bricks. Any
changes to these requirements can be done pursuant to Article 17 of this Agreement.
Multi-use pathways will be provided as required.
4. The Owner/Developer shall be responsible to obtain a Certificate of Zoning Compliance
(CZC) permit and administrative design review in accordance with the standards listed
in UDC 11-3A-19 and the guidelines listed in the City of Meridian Design Manual, prior
to all new construction on the Property.
CZC will be completed prior to permitting and construction.
5. Development of this Property shall be generally consistent with the conceptual
development plan (attached as Exhibit B). The largest building proposed on the site shall
be not exceed 170,000 square feet and shall have horizontal banding in a different
color and/or material on the side and rear elevations of the building. future
development of the outlots depicted on the conceptual development plan shall be in
accordance with the UDC applicable at the time of such development.
The largest building proposed is less than 170,000 square feet and has horizontal
banding. The proposed development is generally consistent with the conceptual plan
provided in the Development Agreement.

6. The following uses shall be prohibited along the southern half of this site: fuel sales
facility; building material, garden equipment & supplies; and vehicle washing facilities.
The prohibited uses are not proposed along the southern half of the site, as required.
7. Construct a 25-foot wide landscape buffer along Overland Road in accordance with the
standards in UDC 11-3B-7.
A 25 foot landscape buffer is proposed along Overland Road.
8. Construct a 20-foot wide landscape buffer along Stoddard Road in accordance with the
standards in UDC 11-3B-7.
A 20 foot landscape buffer is proposed along Stoddard Road.
9. At least a 60-foot wide separation is required along the southern Property boundary.
Within said 60 feet a 25-foot wide landscape buffer shall be constructed at the south
property line, then a drive aisle. Landscape buffers shall be designed and constructed in
accordance with UDC 11-3B-9.
The required buffer and separation are provided.
10. Along the southern boundary of the Property, provide a mix of evergreen and deciduous
trees and shrubs that are a minimum 8-feet in height when planted and result in a
barrier that allows trees to touch at the time of maturity to assist in providing a buffer
to the residents in Bear Creek Subdivision in, in accord with the landscaping
requirements listed in UDC 11-3B-9C.1.a and b.
The required tree and shrub mix and size are proposed.
11.The Owner/Developer shall comply with all landscaping standards described in UDC 11-
36, including but not limited to UDC 11-3B-8 which outlines the standards for parking
lot landscaping.
The proposed landscaping generally conforms to the UDC.
12.Owner/Developer shall be responsible to install street lighting along the project's
frontage on W. Overland Road and S. Stoddard Road in accord with the City's
Improvement Standards, prior to occupancy of the first building on the site.
Street lighting shall be constructed as required.
13.Owner/Develop shall record an easement granting cross-access to the ICON Credit
Union property at the northeast corner of the site (parcel #R7288000004). A copy of
said easement shall be submitted with the first Certificate of Zoning Compliance
application for this site.

The Declaration of Restrictions and Grant of Easements document, which encumbers both
the ICON Credit Union and the subject property, allows cross access. A copy of this
document is included with this application.
14.Overnight recreational vehicle parking/camping on the site is prohibited.
Signage prohibiting overnight recreational vehicle parking/camping will be installed.

1.1 Coherent Plan
C-1.1.3.1 Developments should establish an appropriate and compatible transitional
development pattern that reflects planned and anticipated land uses, development character,
and mixed-use opportunities.
There are no opportunities for mixed use because the site is zoned General Retail and Service
Commercial. The development is compatible with the anticipated commercial land use.
C-1.1.3.1.1 Develop a master plan for large-scale, phased, and multiple-site proposals to
demonstrate the establishment of an appropriate context and the cohesiveness of individual
project components.
The site is currently the part of a larger master plan that is governed by a previously approved
development agreement.
C-1.1.3.1.2 Where appropriate, coordinate with adjacent uses and residential areas, including
single-project phases, to promote a cohesive neighborhood.
Neighborhood meetings were held to involve the adjacent community, the Bear Creek
Subdivision, with the development process. A pedestrian pathway is designed to continue from
the Bear Creek Subdivision through the proposed development.
C-1.1.3.1.3 Avoid piecemeal and fragmented development that detracts from the establishment
of an aesthetic neighborhood appearance and character.
The development is governed by a development agreement ensuring an aesthetic and consistent
appearance and character.
