Meridian Town Center Retail Building ShellsCERTIFICATE OF ZONING COMPLIANCE REPORT DATE: January 11, 2012 E IDIAN*� TO: CenterCal Properties, LLC a FROM: Sonya Watters, Associate City Planner SUBJECT: Meridian Town Center — Retail Building Shells 1010, 1020, 1050, 1060 & 1070 CZC-11-075; DES -12-003 OWNER: CenterCal Properties, LLC DESCRIPTION OF APPLICANT'S REQUEST The applicant, Nadel Architects, Inc., requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval of one multi -tenant building shell at the Meridian Town Center project. The shell is proposed to contain five (5) tenant spaces (1010, 1020, 1050, 1060, & 1070) for future retail shops . (Gormans, Petco, Tilly's, Nike, &.Gap) with the following square footages: (10 10) 50,000 s.£; (1020) 12,000 s.f.; (1050) 9,000 s.f.; (1060) 12,022; (1070) 7,514. The site is located at 2200 N. Eagle Road, east of N. Eagle Road & north of E. Fairview Avenue (Parcel No. S 1104325505). The master site development plan that included the overall site configuration, building pad locations, parking areas, traffic circulation, landscaping, and similar elements for the Meridian Town Center project was approved under CZC-11-021. All of the site parking & landscaping within the Power Center area located between E. River Valley Street and the 1/ mile access road is required to be completed prior to issuance of Certificate of Occupancy for the structure approved with CZC-11-048 (Marshall's). DECISION The applicant's request for CZC and DES is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify if you need a building permit andlor inspection. If you do need a building permit, you must complete that process before you commence the use or construction. As part of the application submittal, you will need to provide two sets of the final, stamped "approved" Planning Department plans You must provide these plans in PDF format and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your building submittal set. Please contact Building Services for additional details about building permits and inspections. Site Specific Conditions of Approval 1. If Certificate of Occupancy (C of O) for the structure approved with this CZC is requested prior to the C of O for the structure associated with CZC-11-021 (Marshall's), a copy of the recorded public access easement for the multi -use pathway along N. Eagle Road required with CZC-11- 021 shall be submitted. 2. If Certificate of Occupancy (C of O) for the structure approved with this CZC is requested prior to the C of O for the structure associated with CZC-11-021 (Marshall's), all of the site parking and landscaping within the Power Center area located between E. River Valley Street and the mile access road shall be completed as approved with CZC-11-021. 3. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7 and 11 -3A -6B. Conditions Document 1 Meridian Town Center CZC-11-075; DES -12-003 Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 A ticle.D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 3. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11 -3B -14A. 4. The site plan prepared by The Land Group on 10/7/11, labeled Sheet CZC, is approved (stamped "approved" on 1/11/12 by the City of Meridian Planning Department) with no changes. 5. The landscape plan prepared by The Land Group on 10/7/11,1abeled Sheet L1.01, is approved (stamped "approved" on 1/11/12 by the City of Meridian Planning Department) with no changes. 6. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Department. 7. The elevations prepared by Nadel Retail Architects, LLP, labeled Sheets A-4.0 & A-4.1, dated January 9 and 10, 2012, are approved (stamped "approved" on 1/11/12 by the City of Meridian Planning Department) with no changes. 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 10. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (AZ -07-012; VAR -07-017; NIDA -11-002; CZC-11-021; CZC-11-048). 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 6. The applicant shall have an ongoing obligation to maintain all pathways. Conditions Document 2 Meridian Town Center CZC-11-075; DES -12-003 7. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 8. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before January 26, 2012, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. At the heart of the shopping complex, the building is designed to create a pleasing and inviting environment for the tenants, shoppers and the neighborhood. The building facade is designed as an inviting expression to serve as a welcoming visual for people driving down the main drive as they enter the site. The wide sidewalk in the front of the building provides for a dynamic walking/shopping experience. As a major building intended for nationally recognized tenants, corporate identities have been incorporated into the design yet still maintaining the overall design of the shopping center. The building is enhanced by stepped and layered parapets, cantilevered awnings and canopies in metal and fabric. Tower elements and building projections help break up the building and are finished with stone, brick and plaster for a rich finished appearance. The overall building is constructed using different colors of split -face CMU and capped with plaster finished cornices. Pedestrian level decorative lighting as well as building accent lighting are used to enhance the front of the building and specific elements of the design. All utilities have been located at the rear of the building and screen walls are used to screen the loading docks that service the tenants.
