Broadway Ste. 210 Meridian, ID 83642 Attn: Bill Parsons Spurwing Greens, LLC is submitting this letter in support of their request for vacation of an Emergency Access Easement and an elimination of certain lots from restrictions contained in notes on the plat of Jayker Subdivision. Said plat is filed in Book 101 at pages 13341-13352. The applicant, Spruwing greens LLC, attended a pre -application meeting on 9-27-11 to go over submittal requirements with City of Meridian Planning Staff, a copy is attached. The three requests are as follows: 1. Vacation of the "20' Emergency Vehicle Access Easement" that is located across Lots 1 and 7, Block 11 of said Jaykers Subdivision. It is shown on sheet 6 of the plat. A copy of sheet 6 and an exhibit of the easement showing existing conditions are attached. The applicant is requesting a vacation of this easement because it encumbers the use of said Lot 7 and there is no apparent benefit to the public. The easement that crosses Lots 1 and 7 does not have an engineered surface that would support any type of emergency vehicle and it dead -ends into an open, un -platted portion of the applicant's property. There is no provision or reason for extension of the easement in future phases that can be found in the Development Agreement or Conditions of Approval for said Jayker Subdivision as stated in the pre -application meeting by a representative of the City of Meridian Fire Department "They support the removal of the easement" 2. Vacation of the "CDE", Common Driveway Easement, from the following Lots — Lots 6 & 7, Block 11, Lots 8 & 9, Block 11 and Lots 15,16 & 17, Block 11 as shown on sheet 6 of said plat and noted on sheet 10 of said plat. The CDE was placed on these lots as a developer option. They were not required because of traffic concerns or planning requirements from the City of Meridian. Since the new developer of these lots doesn't wish to follow the original developers concept in this area of the plat they are asking for relief on these requirements. Attached are the site plans of how the applicant intends to build on these lots. 3. Removal of Lot 18, Block 11 as shown on sheet 6 of said plat.from designation as a common lot as designated in Note No. 16 on page 10 of said Jayker Subdivision. A copy of pages 6 and 10 are attached and the note is highlighted. An exhibit is also attached to 0 • show existing condisions. Lot 18 was going to serve as a pedestrian connection to Spurwing Subdivision to the East. This connection was not a condition of approval from the City of Meridian and as it now exists there is no connection to a public or private pathway to the East. The applicant has built an access way between Jayker Subdivision and Spurwing Subdivision approximately 500' South of this location. This newly constructed pathway satisfies the City of Meridian requirements for pedestrian and emergency vehicle access.
