City of Meridian Mayorand Council FROM; James Jewett Representative for Edge LLC DATE; December 19, 2011 RE: CPAM-11-002-Millennium Retail Center Per City Councils instructions from the hearing on October 18, 2011, we have worked with Staff and met with the neighbors on a couple of occasions and believe that the best course of action is as follows; 1, Submit a rezone application for the purpose of which will allow us to condition the rezone to eliminate all the commercial uses that were not appropriate for this property. In addition, a development agreement will be created through which certain uses will be restricted, 2. Prepares draftsite plan thatwould show howthe C-N and 1.-0 uses will be laid out harmonious to each other on the property, 3. With the addition of the rezone application, we believe it is in the best interest to all that we ~ request that the City Council remand the CPAM application back to the Planning & Zoning Commission so that the Planning & Zoning Commission can see both the revised Comp Plan Amendment as well as the new rezone application at the same time. It is also clear that we need to revise the original CUP /PUD to remove the retail use that is currently approved under the CUP/PUD, In order to accomplish this we must submit a CUP Modification application. Respectfully we request that the City of Meridian waive the cost for fihe CUP Modification and the Applicant will pay for all other costs associated with the rezone application that will be forthcoming. We hope that what we have suggested is satisfactory to the City Council and we believe that this resolution meets the needs of all parties. With the help of Staff, we believe that the current approved use that is not conducive to the property will be changed and this project will be developed in favorable manner to all.
