On behalf of our clients, Janicek Properties, LLC; Fedrizzi Ten Mile, LLC; and SJJV, LLC, we
would like to express our sincere appreciation for your patience and cooperation as we have
worked to resolve the divergence in opinions pertaining to the annexation of these .properties
within the Ten Mile Interchange Specific Area Plan (TMISAP). We believe we have an
acceptable compromise and concur with all but one of staff's zoning recommendations.
We hereby respectfully request the following zoning designations:

The attached maps show the staffs recommendation and the applicants' requests. The difference
between the staff's recommendation and the applicants' request is the size of the designated C-C
(Community Business District) area. 'The applicants, the Janiceks, are agreeahle with the TTI-C
(Traditional Neighborhood Center District) on the western 30 acres of the property, but disagree
with TN-C adjacent to Ten Mile Road. The Janicek parcel lies at the one-half mile mark and is
the primary collector .gateway into the section as shown on the TMISAP. The main roadway
artery on the Janicek parcel will be a signalized, four-lane collector essential to the development
of this section. A seven-lane intersection will feed future development to Ten Mile Road and the
I-84 Interchange. A traffic study was prepared which reflects, at build-out, the east-west
collector on the Janicek property could carry a traffic volume up to 30,000 trips per day.

The TMISAP also identifies the primary north-south collector on the Janicek parcel. This
commercial. collector bisects the property, with approximately 27 acres west of the roadway.
The north-south collector will feed significant traffic to Franklin Road. As outlined in the
TMISAP, a large traffic rotary will be constructed on the Janicek property. This parcel will be at
the heart of the interchange development, with the collector roadways a key to development of
the entire section. The TN-C District for the east portion of the property is not logical
considering the surrounding approved zones and anticipated intensity of the uses. The C-C
District is a better fit for the property and wilt flourish with the high volumes of traffic. This
major interchange has potential for great things; a traditional neighborhood on the east portion of
the Janicek property severely diminishes this property's ability to develop.
We have an opportunity to provide for the future collector roadway network for an entire section,
providing access to the new Ten Mile Interchange. This wilt allow different properties under
multiple ownerships to develop without reliance on the parcels that adjoin the arterials. Any
property may construct collectors as needed for development. The Idaho Transportation
Department is doing their part by contributing $458,500 to a trust account at Ada County
Highway District for construction of the primary east-west collector. Any development may
utilize the monies to install the four-lane collector, seven-lane intersection and traffic signal. We
have coordinated with Ada County Highway District (ACRD) by providing a traffic study,
coordinating the sizes of the collectors, intersection and rotary design. ACRD has agreed to
accept unimproved right-of--way from the properties where the collectors are designated on the
TMISAP Transportation Map.
Of the original 79.23-acre Janicek parcel, 5.757 acres has already been taken by ITD, leaving
74.52 acres for development. Janiceks will be required to dedicate additional right-of--way to
accommodate the north-south collector (2.77 acres), and a total of 3.25 acres for the primary
east-west collector. Their contribution to the Ten Mile Interchange area is significant.
We appreciate the cooperation of the City with the application for annexation. Without your
consideration and patience during this process, this would not be possible. We believe we are
proposing a mutually beneficial compromise and look forward to your positive decision for the
annexation and zoning of these properties.
