Case No. CUP -99-027 FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS The above entitled conditional use permit application having come before the City Council on September 21, 1999, and Shari Stiles, Planning and Zoning Administrator, Gary Smith, City Engineer, and Bob Unger of Pinnacle Engineers, Inc., Architect for the Applicant, appeared and testified in favor of the application and no one appearing in opposition, and the City Council having received the staff report and the record made before the Planning and Zoning Commission, and being fully advised in the premises, the Council finds and concludes as follows: FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS FOR RAILSIDE PARK SUBDIVISION BY WES WORCESTER - 1 Ll FINDINGS OF FACT A notice of a public hearing on the conditional use permit was published for two (2) consecutive weeks prior to the said public hearing scheduled for September 21, 1999, before the City Council, the first publication appearing and written notice having been mailed to property owners or purchasers of record within three hundred (300') feet of the external boundaries of the property under consideration more than fifteen (15) days prior to said hearing and with the notice of public hearings having been posted upon the property under consideration more than one week before said hearing and the copies of all notices were made available to newspaper, radio and television stations as public service announcements; and the matter having been duly considered by the City Council at the said September 21, 1999, public hearing; and the Applicant, affected property owners, and government subdivisions providing services within the planning jurisdiction of the City of Meridian, having been given full opportunity to express comments and submit evidence. 2. There has been compliance with all notice and hearing requirements set forth in Idaho Code §§67-6509 and 67-6512; and §§11-2-416E and 11-2-418E as evidenced by the Affidavit of Mailing, and the Affidavit of Publication and Proof of Posting filed with the staff report. 3. The property is located in the Railside Park Subdivision at Pine and Locust Grove, in Meridian, Idaho. 5. The owner of record of the subject property is Railside Development Inc. of 4414 S. Gekeler Lane, Boise, Idaho. 6. Applicant is Wes Worcester of 10065 Westview, Boise, Idaho. 7. The subject property is currently zoned Light Industrial (I -L). The zoning district of I -L is defined within the City of Meridian Zoning and Development Ordinance, Section 11-2-408(14). 8. The proposed application requests a conditional use permit for townhouse conversion of three buildings on 2.10 acre lot in Railside Park Subdivision. This request is a substantial change from the original and existing Conditional Use Permit requiring the applicant to go through the modification of a conditional use process. 9. The use proposed within the subject application will in fact, constitute a conditional use as determined by City Policy. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS FOR RAILSIDE PARK SUBDIVISION BY WES WORCESTER - 3 10. That the Applicant, Wes Worcester, and Railside Development Inc., owner of the property, is granted a conditional use permit for the development and use to convert multiple buildings to townhouse status in conformance with existing use restrictions, as described in the Site Plan dated March 29, 1999 and stamped 27 1999, NEW DEVELOPMENT FOR WES WORCESTER IN RAILSIDE PARK SUBDIVISION, MERIDIAN, IDAHO, DRAWN: CJC, CHECKED ROC, JOB NO. 98-DRL-145, SHEET C1.1, DESIGN RESOURCES, ARTHITECT, for the development of the aforementioned projects and which property is described hereinbelow to -wit: Lot 3, Block 2, Railside Park Subdivision, Meridian, Idaho. 11. Giving due consideration to the comments received from the governmental subdivisions providing services in the City of Meridian planning jurisdiction, public facilities and services required by the proposed development will not impose expense upon the public if the following conditions of development are imposed and the following is also found to be required to mitigate the effects of the proposed use and development upon services delivered by political subdivisions providing services to the subject real property within the planning jurisdiction of the City of Meridian. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS FOR RAILSIDE PARK SUBDIVISION BY WES WORCESTER - 4 LJ • I LA Conditions requested by the City of Meridian Planning and Zoning Administrator and Assistant City Engineer within their Memorandum dated August 5, 1999, be required as follows: Adopt the Meridian Fire Department's Recommendations as follows: 11.1 Applicants shall satisfy all fire code requirements including those pertaining to water flow and fire hydrants. Adopt the Central District Health Department's Recommendations as follows: 11.2 The Applicant's central sewage and central water plans must be submitted to and approved by the Idaho Department of Health & Welfare, Division of Environmental Quality. 11.3 Run-off is not to create a mosquito breeding problem. 11.4 Stormwater shall be pretreated through a grassy swale prior to discharge to the subsurface to prevent impact to groundwater and surface water quality. 11.5 The Engineers and architects involved with the design of the subject project shall obtain current best management practices for stormwater disposal and design a stormwater management system that prevents groundwater and surface water degradation. Adopt the Nampa & Meridian Irrigation District Recommendations as follows: 11.6 Applicant shall submit a Land Use Change/Site Development application for review prior to final platting. 11.7 Requires all laterals and wasteways be protected. 11.8 All municipal surface drainage shall be retained on site. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS FOR RAILSIDE PARK SUBDIVISION BY WES WORCESTER - 5 11.9 If any surface drainage leaves the site, the Nampa & Meridian Irrigation District must review drainage plans. Adopt the Planning and Zoning Administrator and Assistant City Engineer Recommendations as follows: 11.10 Assessment fees for water and sewer service are determined during the building plan review process. 11.11 Staff recommend monument signs in Railside Park. Subdivision. Signs shall be placed outside of the sight triangle. Detailed signage plans shall be subject to design review. 11.12 Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance 11-9-605.M. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. No variances have been requested for tiling of any ditches crossing this project. 11.13 Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non-domestic purposes such as landscape irrigation. 11.14 Off-street parking shall be provided in accordance with Section 11-2-414 of the City of Meridian Zoning and Development Ordinance and/or as detailed in site-specific requirements. 11.15 Paving and striping shall be in accordance with the standards set forth in Sections 11-2-414.D.4 and 11-2- 414.13.5 of the City of Meridian Zoning and Development FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS FOR RAILSIDE PARK SUBDIVISION BY WES WORCESTER - 6 9 Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements. 11.16 A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. All site drainage shall be contained and disposed of on-site. 11.17 Outside lighting shall be designed and placed so as not to direct illumination on any nearby residential areas and in accordance with City Ordinance Section 11-2-14.D.3. 11.18 All signage shall be in accordance with the standards set forth in Section 11-2-415 of the City of Meridian Zoning and Development Ordinance. No temporary signage or flashing signs will be permitted. 11.19 Applicants shall provide five -foot -wide sidewalks in accordance with City Ordinance Section 11-9-606.B. 11.20 All construction shall conform to the requirements of the Americans with Disabilities Act. 11.21 Provide the Public Works Department with information on anticipated fire flow and domestic water requirements for the proposed site. Flow and pressure from the existing mains should be monitored with the Meridian Water Department to determine whether adequate fire protection exists. 11.22 Calculations shall be provided to P&Z staff showing total square footage of asphalt and demonstrate compliance with one, 3" caliper tree per 1,500 s.f of asphalt. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS FOR RAILSIDE PARK SUBDIVISION BY WES WORCESTER - 7 0 E 11.23 Locations and construction requirements of trash enclosure shall be coordinated with Sanitary Services, Inc., and applicant shall provide a letter of approval from their office prior to applying for building permits. 11.24 Applicant shall provide a letter of approval from Ada County Highway District with submittal of site plan prior to issuance of Certificate of Zoning Compliance. 11.25 All outdoor storage of equipment and material shall be enclosed with a screening fence. 11.26 Handicapped accessible parking spaces and associated signage shall be provided in accordance with the Americans with Disabilities Act. All building and parking lot construction shall meet the requirements of the Americans with Disabilities Act. 11.27 Applicant shall be required to make application with the Meridian Building Department for development within a flood plain. 12. The proposed uses within the subject application will be harmonious with and in accordance with the Meridian Comprehensive Plan and the City of Meridian Zoning and Development Ordinance. 13. The uses proposed within the subject application will be subject to the conditions set forth in Finding of Fact no. 11 and will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance or intended character of the general vicinity and that such uses will not change the intended essential character of the same area. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS FOR RAILSIDE PARK SUBDIVISION BY WES WORCESTER - 8 14. The uses proposed within the subject application will not be hazardous or disturbing to existing or future neighboring uses. 15. The uses proposed within the subject application will be served adequately by central public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water, and sewer. 16. The applicant has agreed to pay any additional sewer, water or trash fees or charges, if any associated with the use. 17. The uses proposed within the subject application will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors. 18. The development will not result in the destruction, loss or damage of natural or scenic feature of major importance relating to the property. CONCLUSIONS OF LAW 1. Idaho Code § 67-6512 provides in part that: (A) As part of a zoning ordinance the City Council may provide for the processing of applications for special or conditional use permits; and FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS FOR RAILSIDE PARK SUBDIVISION BY WES WORCESTER - 9 • (B) That a special use permit may be granted to an applicant if the proposed use is otherwise prohibited by the terms of the zoning ordinance, but may be allowed with conditions under specific provisions of the zoning ordinance, subject to the ability of political subdivisions, including school districts, to provide services for the proposed use, and when it is not in conflict with the plan; and (C) That upon the granting of a special use permit, conditions may be attached to a special use permit, including, but not limited to, those: 1) Minimizing adverse impact on other development; 2) Controlling the sequence and timing of development; 3) Controlling the duration of development; 4) Assuring that development is maintained properly; 5) Designating the exact location and nature of development; requiring the provision for on-site or off-site public facilities or services; requiring more restrictive standards than those generally required in an ordinance; requiring mitigation of effects of the proposed development upon service delivery by any political subdivision, including school districts, providing services within the planning jurisdiction. 2. The City of Meridian has exercised its authority to provide for the processing of applications for Conditional Use Permits by the enactment of § 11-2-418 Municipal Code. 3. Signs shall be placed outside of the sight triangle. Detailed signage plans shall be subject to design review. 2.12 Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance 11-9-605.M. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. No variances have been requested for tiling of any ditches crossing this project. 2.13 Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5 -7 - ORDER OF CONDITIONAL APPROVAL 2 OF CONDITIONAL USE PERMIT WES WORCESTER / RAILSIDE PARK SUBDIVISION - 2 517. All site drainage shall be contained and disposed of on-site. 2.17 Outside lighting shall be designed and placed so as not to direct illumination on any nearby residential areas and in accordance with City Ordinance Section 11-2-14.D.3. 2.18 All signage shall be in accordance with the standards set forth in Section 11-2-415 of the City of Meridian Zoning and Development Ordinance. No temporary signage or flashing signs will be permitted. 2.19 Applicants shall provide five -foot -wide sidewalks in accordance with City Ordinance Section 11-9-606.B. 2.20 All construction shall conform to the requirements of the Americans with Disabilities Act. 2.21 Provide the Public Works Department with information on anticipated fire flow and domestic water requirements for the proposed site. Flow and pressure from the existing mains should be monitored with the Meridian Water Department to determine whether adequate fire protection exists. 2.22 Calculations shall be provided to P&Z staff showing total square footage of asphalt and demonstrate compliance with one, 3" caliper tree per 1,500 s.f of asphalt. The applicant has now decided he wants to convert these buildings into townhouse units, and that's the reason for the two public hearings. One is for the plat; the second one is for a conditional use permit which would allow for the townhouse units, the zero lot lines and the fact that the townhouse units, the individual lots would not have frontage on a public street. Maws Addition here, this Pine Street, this is where Locust Grove will eventually come through. There's some existing development in this area. This lot is still vacant. This is a residential home that is zoned I -L. If you remember Wayne Forrey coming through with a development, this is for conditional use permit for elderly housing development. This would be the plat itself. As you can see, there are three buildings and they have designated the separate lots for the townhouse units so they can sell those individually. We have received response from the applicant. They have agreed with all the terms of our comments, and staff recommends approval of the development. Rountree: Any questions of Shari? On that other overhead that you showed, then, it appears to me that that's an industrial park and everything that's been developed in that so far has been industrial? Is that correct? Stiles: Yes. Anderson: So we're going to put townhouses in the middle of an industrial park. Stiles: They call it townhouses. It's like a — they first proposed a condominium concept, but now they're asking for a townhouse concept because each person will own their own lot, but the buildings will be attached. They'll have fire walls between each unit, each individual unit, but each of them will be owned by an industrial user. So it's kind of misleading to call it a townhouse. No residential use in it. Steve Siddoway did prepare some response to the recommendation to Council on Item 1.26 on Page 6 regarding pre-treatment of storm water through a grassy swale. That was a recommendation from Central District Health Department, not a requirement. Item 1.27, Page 6 states the applicant shall resolve hook-up to city sewer, water and sewer issues prior to the issuance of a building permit. The applicant has issued a letter dated September 20th that requests this requirement be revised to condition their Certificate of Occupancy rather than the building permit upon satisfactory resolution of the utility problem. Our response is as follows: Applicant shall resolve hook-up to city water and sewer issues prior to the issuance of a building permit. Building permits cannot be issued until the site has adequate fire protection. The water lines must pass pressure tests and bacteriological tests prior to activating the fire hydrants. Also, the sewer must be pressure tested and proved prior to issuance of a building permit. This is a standard requirement for all subdivisions in the city as well. The City will accept and process the building plans if the applicant signs a letter stating that they understand a building permit will not be issued until water and sewer lines are complete and approved. This will eliminate the six to eight weeks of processing time required after the lines are approved, and it will give the applicant approximately two months additional time to work out the water and sewer line issues while the plans are being processed without additional down-time. The multiple units was the first time it had been done in Meridian and then come back in for the townhouse conversion because that is also the first time it's been done in Meridian. Also, it's the first time it has been done in the state that I know of. Have you ever seen an office warehouse townhouses in the state? We went to townhouses because of the demising walls. We are going to have a full 2 hour wall between the units which would give me better security and in a condo you only have to have a one hour wall to your ceiling grid. Then you've got you draft stops, but to me that give very much security. We going to go all the way up to the roof deck with our townhouse walls and that will give us a better insurance rates too. There was a lot that has gone on to this point. Borup: One is not closed so it's open— Barbeiro: Mr. Chairman it is imperative that at least one of them sit in on as I will be down on Family Center. Borup: Oh that's right. We'll still have a quorum. We will be all right. I have something I wanted to ask earlier on the Bear Creek project, but felt I rather wait till now. Meeting is still open. Maybe I could think of some good comments to make about City Council or something. We were talking about the Ten Mile Trunk line. What I was thinking about is amount of money in the sewer enterprise fund. Is that all at this point pretty much earmarked for the no name trunk and some on going things and sewer expansion. One time there was a nice amount. How much is available for that expansion. Freckleton: I think there is some on going discussions right now with City Council. Correct me if I'm work will, but aren't they talking about that trying to determine how much of the no name to do and the funding for it. I have not been involved in those discussions, but my understanding is that they are trying to establish the scope of the project and the funding for it. Berg: That is correct. Bruce is right there has been a lot of discussion at City Council of which direction to go. The other concern is funding. There is certain designated funds for certain areas that they have to put the money back into those areas. All the monies that's collected in the enterprise fund isn't just for any future development wherever in the city. There is some designated areas that it has to be. It is when you pay your water and sewer bill, some of those fees into the whole fee structures is for updating and maintaining certain lines. There is projects that we are going to have to parallel lines, have bigger lines. Borup: That's what I wondered. Some of these bottlenecks they are talking about are funds available for those items. Berg: When you say bottlenecks—improving existing things and parallel lines yes because those fee structures were structured for those areas. Hatcher: How is it determined what's done when with what type of money. I mean in regards to Bear Creek. A quick fix. Not saying it is the right one. Just a quick fix would be to fix those bottlenecks so that they could tap into the Ten Mile, because they are at the end of the Black Cat. That way a project could go in. The city could accumulate the Meridian Planning and wing Committee Special Meeting August 25, 1999 Page 67 money from those fees. I roughly estimated their doing a $1500 hookup fee plus a $1000 impact fee per lot, that is roughly a million dollars off of that development alone that could be implemented to the Black Cat trunk. Freckleton: And I think that the assessment fees are one of the fees that Will is eluting to that I don't think that assessment fees can be used for actual capital improvement projects. Right Eric? (Inaudible) New mainline extensions, trunk line extensions and that sort of thing. I think it has to be used for existing facilities maintenance upgrade, things like that. I don't think it can be used for future or new trunk line extensions. Berg: I think you'll probably get in to the philosophy of things because the direction the Council gives to the Public Works Dept. of which way to engineer, which way to go is sometimes up to their decision, but that's also in the planning stage. To me planning goes from inside out. Unfortunately, trunk lines, I was not here for the discussion of the project, but trunklines at the end of the road, somebody has to plan to go from the plant to get there. The City I don't think right now is looking into funding a bunch of those kinds of projects. We've always had developer driven mainlines. Freckleton: Right. There has been discussion about the city getting some projects started. I think that they kind of set a priority on the north corridor, the north quadrant. In looking at Brads report, there are some things that could be done to alleviate some of these bottlenecks and that sort of thing. I guess it all depends on where Council decides to apply those funds. Berg: One issue is the (inaudible) impact that the Ada County had given us some land that we have some commitments to work on in the north quadroon of the city, especially the northeast. Some of those things are going to have to be happening fairly soon. Borup: So it sounds like the north trunkline is going to exhaust all the available funds anyway. Freckleton: It is a large project. A very large project. I think once—it will have a snowball effect. Once the city gets the ball rolling, I think your going to see it carried on. It just takes somebody stepping up to the plate to get it going. Borup: Yeah because they know they've got something to connect on to and go with. I wonder if the same thing would happen on the Black Cat Trunk. Freckleton: Quite possible. But like I say the priority has been set in discussions I've heard for that northern quadrant. De Weerd: Mr. Chairman, I have just one more thing and that is on Cobblestone, if staff can do a comparison of Jabils and Cobblestones traffic analysis for the next meeting. I don't know who would be appropriate, but — Borup: Unless you get a traffic engineer, it's got to be ACHD. Freckleton: That would be my recommendation. I don't think staff can make that judgement call. The Ada County Highway District needs to look at the traffic study from the Cobblestone project and apply the Jabil. De Weerd: Well I guess my request would be could staff request that of ACHD. Hatcher: Could we go back to them and just have them give us a logical deduction based upon the review of both of those traffic studies so that we could have a overall idea of what the total impact would be, not this and that and the other thing. Here it is all lumped together. Freckleton: Certainly. We can make a call. Borup: Was there a study done on Jabil, a traffic study from ACHD. Freckleton: I don't recall seeing one. Borup: That was (inaudible) okay but a staff report would talk about what traffic would be generated on which road. (Inaudible) Freckleton: The Ada County Highway District in those staff reports they will try to determine vehicle trips and levels of service. Borup: They should have both. All they need to do is combine them. De Weerd: Well then perhaps they could just come and address the Commission and answer questions. Freckleton: That may be the best solution.
