Commercial Court. The facade improvements include a new 2,164 square foot foyer and fellowship area, new paint, and new decorative metal wall panels and metal awnings added to the north and northern half of the east and west facade. Phase 1: The site improvements with the first phase include a new round-about, removal of the western driveway, restriping of the parking area, a 10-foot multi-use pathway along Eagle Road, a 5-foot wide attached sidewalk along Commercial Court and additional trees to mitigate for the removal of existing trees. Phase 2: The site improvements with the second phase include a new northern parking lot consisting of 139 parking stalls, the widening of the existing entrance driveway and the associated perimeter and internal landscaping. The site consists of 4.22 acres and is zoned I-L. The church use was approved with CUP-11-003. DECISION The applicant's request for CZC and DES is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify if you need a building permit and/or inspection. If you need a building permit, you must complete that process before you commence the use or construction. As part of the application submittal, you will need to provide two sets of the final, stamped "approved" Planning Department plans. You must provide these plans in PDF format and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your building submittal set. Please contact Building Services for additional details about building permits and inspections. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-SC-3C. If deferment of the pathway and sidewalk is necessary, the applicant shall submit an alternative compliance application and provide a surety for the multi-use pathway and provide documentation that the Commercial Court improvements (curb, Conditions Document 1 Life Church CZC & DES REVISED gutter and sidewalk) are bonded with ACHD. Final occupancy of the building shall not be released until the site improvements are complete. 3. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-3B-14A. 4. The site plan prepared by LKV Architects dated 11/O1/11, labeled S-land S-1.1 are approved (stamped "approved" on 11/14/11 and 06/13/12 by the City of Meridian Planning Department) with no changes. 5. The landscape plan prepared by LRS Architects., dated 11/O1/11and 6/08/12, labeled L-1 and L- 1.0 is approved (stamped "approved" on 11/14/11 and 06/13/12 by the City of Meridian Planning Department) with no changes. 6. 7 The building elevations prepared by LKV Architects, dated 11/O1/11, labeled A-5.1 and A-5.2, identified as ALT-1 by the Planning Department are approved (stamped "approved" on 11/14/11 by the City of Meridian Planning Department) with no changes. The approved elevations are the elevations labeled as ALT-1 in Exhibit D. If the funding is unavailable to complete the required facade improvements as depicted on ALT-1; the applicant shall inform the Planning 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 10. Prior to Certificate of Occupancy, the applicant shall record a public access easement for the multi-use pathway along SH 55 (Eagle Road) and submit copy of said easement to the Planning Department. 11. At such time that the multi-use pathway along SH 55 (Eagle Road) connects from one major street to another and is greater than one-half mile long, the applicant may petition the City to assume maintenance responsibilities. 12. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (CUP-11-003). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. Conditions Document 2 Life Church CZC & DES The approved site plan, landscape plan and building elevations shall not be altered without prior written approval of the City of Meridian Planning Department. REVISED 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3. 7. The applicant shall have an ongoing obligation to comply with any applicable specific use standards for a church as set forth in UDC 11-4-3-6. 8. The applicant shall have an ongoing obligation to maintain all pathways. ANALYSIS OF UDC REQUIREMENTS Due to funding constraints, the applicant has indicated that the proposed facade improvements, the 10- foot wide multi-use pathway and the 5-foot wide attached sidewalk may be deferred for short period of time. In the interim, the applicant has provided an alternative set of building elevations (not approved and has indicated that surety/bonding may be an option to defer the completion of the sidewalk and multi- use pathway. At this time, all of the proposed facade and site improvements are approved with the subject CZC application. If deferment is necessary, the applicant shall coordinate with Staff regarding the revised elevations, an alternative compliance application, provide a surety for the multi-use pathway and provide documentation that the Commercial Court improvements (curb, gutter and sidewalk) are bonded with ACRD. Final occupancy of the building is predicated on the completion of the site improvements. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before " ~''~n- 06/28/12, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. The administrative design review shall be exercised with the approval period of the underlying permit (CZC) or the approval shall expire. The Phase 1 Certificate of Zoning Compliance covered a total of 95 off-street parking spaces located for the most part on previously paved, concrete surfaces. Phase 2 pazking lot development will include the addition of 139 parking spaces on the northern part of the property and the widening of the entrance driveway from 25 to 35 feet. This additional pazking lot will be asphalt paving with extruded concrete curbing and interior landscaping per City of Meridian requirements. Additional pazking lot lighting will be provided as shown on the Site Plan and will be the same type of shielded fixture being added in Phase 1 areas. Three additional existing trees must be removed in the Phase 2 area. Trees with an equivalent number of caliper inches aze being added at the perimeter of Phase 2 parking. Two more handicap accessible pazking spaces are being added on the east side of the building bringing the total number of accessible spaces to eight. Conditions Document 2 Life Church CZC & DES ANALYSIS OF UDC REQUIItEMENTS Due to funding constraints, the applicant has indicated that the proposed facade improvements, the 10- foot wide multi-use pathway and the 5-foot wide attached sidewalk may be deferred for short period of time. In the interim, the applicant has provided an alternative set of building elevations (not approved and has indicated that surety/bonding may be an option to defer the completion of the sidewalk and multi- use pathway. Commercial Court Planning Staff: Life Church respectfully requests Certificate of Zoning Compliance approval for the conversion and remodel of the old Coors Distribution Center, located at the southeast corner of Eagle Road and Commercial Court, into a church facility for Life Church. A Conditional Use Permit was approved for the project by the City of Meridian Planning Commission on September 15, 2011. The scope of the project includes the phased conversion of open warehouse and office space into a church sanctuary, classrooms, and support spaces; the addition of a new, predominantly glass entrance foyer and fellowship area; and phased exterior remodeling and site improvements. The existing 41,820 square foot building has a main floor level of about 36,253 square feet and a small second floor level of about 5,567 squaze feet. The building also includes a 3,482 square foot roofed- - loading dock that abuts railroad right-of--way along the property's southern boundary. The site is approximately 4.22 acres and includes an existing concrete driveway off Commercial Court, a concrete passenger caz pazking lot on the north side of the building, concrete truck pazking lot on the east side of the building, and concrete driveway for warehouse access on the west side of the building. The majority of the unpaved portion of the site is landscaped with lawn and trees. The requested Certificate of Zoning Compliance is for Phase 1 of the Church's remodel of the facility. Phase 1 will. include the interior remodeling of about 24,066 square feet of existing ground level space and the addition of roughly 2,164 square feet of new church foyer and fellowship azea. On the building's exterior, all walls will be repainted. New decorative metal wall panel "and sunshade elements will be added to the north facade and to the northern half of the east and west facades. In compliance with City of Meridian requirements, a ten foot wide paved and lit pathway will be constructed in the 35 foot landscape buffer along Eagle Road, and new curb, gutter, and 5' sidewalk will be added along Commercial Court as required by ACRD. Project funding constraints, however, may also necessitate deferral of these improvements for a brief period following initial building occupancy. If this becomes necessary, Life Church will submit a written explanation to the City of Meridian and/or ACID, request that a letter of credit or bond be accepted in lieu of initial completion of these improvements, and further request that this LOC or bond serve as the necessary alternative means of compliance. Life Church will also provide construction bid amounts related to the work to assist the City in calculating the amount of the letter of credit or bond. A time frame for completion of the deferred work will also be provided by Life Church. In future phases the remainder of the first floor as well as the second floor portions of the building will be remodeled and additional parking lot will be constructed. Commercial Court Planning Staff: Life Church respectfully requests Design Review approval for the conversion and remodel of the old Coors Distribution Center, located at the southeast corner of Eagle Road and Commercial Court, into a church facility for Life Church. The long range scope of the project includes phased conversion of the entire warehouse and. office building into church sanctuary, classrooms, and support spaces; the addition of a new entrance foyer and fellowship area; and phased exterior remodeling and site improvements. This Design Review application is for Phase 1 of the project. Exterior work in Phase 1 includes the entrance foyer and fellowship azea addition, initial exterior facade modifications, existing pazking lot and driveway restriping, new vehicle round-about, new pedestrian pathway. in the landscape buffer abutting Eagle Road, and related landscaping modifications. Architectural Character The existing building facades are a combination of smooth and split face, painted and unpainted concrete masonry. Phase 1 modifications will include complete repainting of all four facades, the addition of decorative metal wall panel groupings and metal sunshades, removal. of three large overhead delivery doors and replacement with infill walls, and the addition of a dramatic new, two story glazed entrance foyer and fellowship area. The new entrance foyer element will provide the church with a welcoming, .highly visible building entrance oriented toward the intersection of Eagle Road and Commercial Court. The exterior of the entrance foyer /fellowship area addition will be a glass curtain wall with metal clad fascia and sunshade above.. The building roofline, a metal coped horizontal pazapet, will remain unchanged except for new stuccoed pilaster features flanking the foyer addition. These will be painted the same accent color as the vertical columns that sepazate the individual sections of the glass curtain wall and the infill walls and pilasters on the east and west facades. Unlike the uniform roofline, the monolithic, planaz walls of the existing building will be dramatically changed through the introduction of smooth, white colored, metal wall panel groupings set out approximately six inches from the plane of the masonry walls. These panel groupings will be the same metal panel material used above the addition's curved glass curtain wall. The metal wall panels will provide variation in plane, color, and texture in contrast to the building's adjacent painted masonry surfaces. White colored metal sunshades over areas of glazed fenestration will add further dimensionality to the building's planer exterior walls. All building windows, existing and new, will have tinted glass. Existing dazk bronze aluminum window frames will be painted white to match the white powder coating of the new glass curtain wall framing and entrance doors. Vertical column and pilaster elements as well as new infill walls will be painted a dark brick-red color and the metal panels, sunshades, window mullions, and entrance doors will all be white. Pre-fmished metal coping at the top of parapet walls and at the top of the projecting metal wall panels will be dazk bronze. Incidental steel handrails and. guardrails will be white. As noted in the church's Certificate of Zoning Compliance application letter, completion of the entrance foyer and fellowship hall addition, along with installation of the decorative metal wall panels, may need to be deferred for a short time following completion of other Phase 1 work. If this proves to be the case, a simple entrance canopy will be constructed, similar in appeazance to the new sunshades, above the temporary main entrance doors. At locations to receive the decorative metal wall panels, the concrete masonry walls will be painted white to achieve, on a temporary basis, a similaz aesthetic effect. Siting and Landscaping Most siting and building location Design Review criteria is not applicable due to the fact that the project is a conversion and remodel of an existing facility. However, Phase 1 improvements related to parking, public access, internal circulation, and pedestrian pathways do comply with vazious Design Review criteria and specific Design Review guidelines. Although the church's new main entrance is oriented towazd the intersection of Eagle Road and Commercial Court, most of the facility's off street parking, at least in Phase 1, is located on the east side of the building away from the view of passing motorists and pedestrians. Handicap accessibility is provided from the pazking lot to the building by means of at-grade doors on the east side of the building and a new handicap ramp on the north side. Direct pedestrian access to the building from the public right of way, specifically a new public sidewallc along Commercial Court, is provided by means of the new ten foot wide pedestrian pathway along Eagle Road and a connecting sidewalk to the main building entrance. Should Life Church be unable to complete these pedestrian improvements prior to initial building occupancy, City acceptance of a letter of credit or bond will be requested in lieu of and to serve as an interim alternative means of compliance. Internal circulation within the site is also being improved for vehicles, both passenger and emergency. Pazking on the east side of the.building has been configured to allow vehicles to loop through the entire west lot, and a round- about has been added at the west end of the north pazking area to permit both passenger and lazge emergency vehicles to turn azound without back-up maneuvers. The new ten foot wide pedestrian pathway along Eagle Road improves pedestrian circulation not only internal to the site, but also provides safe pedestrian connectivity along the Eagle Road corridor to other properties and businesses. Most of the site's existing lawn, trees, and shrubs will remain. Where existing trees must be removed to accommodate Phase 1 construction, replacement trees will be provided per City Code replacement requirements. Although the large existing lawn between the building and Commercial Court will remain in Phase 1, parking lot planting in the second phase will incorporate low water-use plant materials. New Phase 1 trees and shrubs will be moderate to low water-use varieties as appropriate. Existing lawn and trees will provide an aesthetically simple and comfortably shaded pedestrian experience within the Eagle Road landscape buffer.
