Please note that the distance from the State Avenue right-of-way to the telephone easement is shown in the insets on the plat. The bearing of the line from the east corner to the initial point is shown on the plat as the basis of bearing; however, we showed that bearing beneath the 70.01 foot dimension. Enclosed for your records is a copy of the easement deed, instrument 18537988, of the easement for the sewer and water line that was granted by Upland Industries Corporation in 1984. After reading this easement deed, we feel there is no reason to vacate the easement inasmuch as Hickory Avenue was platted over the existing easement. For the portion of the easement that lie outside the Hickory Avenue right-of-way the fourth paragraph of the easement says "that all rights granted by this easement shall cease for any portion of this easement that is abandoned by the Grantee", Therefore, the easements that are outside of the public right-of-way of Hickory Avenue should be automatically abandoned. Please let me know if you find otherwise after reading the easement deed. 1 have reviewed the late comer agreement and agree with your numbers for the assessment rate of $0.009'71 per square foot. Based on the information provided in this letter, the following are our calculations of the bonding amount: 1. Street lights - Ten (10) in Treasure Valley Business Center and eleven (11) in Gemtone. Total bond = 21 x $1,500.00 = $31,500.00. 2. Stiles: Mr. Mayor and Council, this was before you at the last City Couricil meeting; however, since the applicant's representative was not available at that meeting, he asked that it be continued to tonight. The parcel in question is located — this would be the Blue Cross building on Eagle Road. The City has a well lot here, has the trucking companies and the meat company, The Food Services of America. The previous plat that was submitted, there was a final plat submitted for No. 4 that was acted by the Council in May of 1999, that would give them until May of this year to record the plat.. That will be their deadline for recording this plat. They resubmitted — this was -the previous plat. If you can see, they have shown the dedication of right-of-way here, dedication of State here, and also showed the dedication of Pine clear to the westerly boundary of the property. The revised final plat that they submitted has deleted all of the Pine Street dedication. if this was the applicant's desire, staff would recommend that it be denied. The applicant's representative is here tonight to make a presentation before you, but as we all know, it's very important that this Pine Street be dedicated and extended as soon as practical, and we're afraid that if this is not dedicated, it will cause further delays in the extension of Pine Street. The applicant did indicate that they didn't want to dedicate that at this time because none of ;these lots will have frontage, they will not be able to access Pine. As Shari indicated, in May of 1999, we submitted a final plat to you. It was approved. It looked like this. This fourth phase that we have is bounded on all sides by right-of-way. We've got to construct East State Avenue, extension of Hickory Avenue here, and then it's bounded by Pine; however, it's restricted for no vehicular access to Pine, and there's a half of a right-of-way on this section at this point. We processed this through the Council. We did our construction plans, got some construction estimates for our clients. They did not have a buyer for this property, and the only reason that they were submitting this Phase 4 is to get their preliminary plat.approval valid. When we discussed the costs, they decided that their preference would be to go this route and then build the rest of Pine in Phase 5. I brought a copy of the preliminary plat. Sorry it's kind of dark. This is the Phase that you see right now, Phase 4. Phase 5 comes down along and connects this lot -here, so there will be a Phase 5. 1 spoke with Mr. Tom Wright today. I passed on Staffs concerns about the Pine Street extension, and I said, you know, these are their concerns that they want to see Pine extended in the near future. His statement to me was, well, you know, we're only running this h Meridian City Council 09 e February 15, 2000 Page 9 plat through because we want to keep our preliminary plat approval alive, and he said, secondly, we have no problem with building Pine and dedicating that right- of-way, but we don't have any purchaser or buyer at this time; therefore, we would be willing to do it prior to the issuance of building permit on any of those lots. So, you know, I don't know what to tell Council. I guess if they have some concerns over that, then I think our only choice is to probably come back and ask for a time extension prior to May 4th of this year and try to wait until they can get — find out who their users are going to be. Bird: Mayor and Becky, we have never, since I've been on the Council, allowed a plat like that where there was a road that didn't go through the complete deal. I would — my opinion is to come back and get an extension on the preliminary. I for one, to be truthful, am not going to vote for it unless Pine Street goes all the way through at this plat right now. Bowcutt: Yes, sir. I understand. This is an unusual situation where we have this phase bounded on three sides by public rights-of-way. It's very strange. I've never faced it before. I can understand your concern. So I guess, then, I would like this probably to go ahead and withdraw this application, and then we'll submit for a time extension, come back before you and give those guys a little more time if that's acceptable. Pine is one very important street for us to interconnectivity and to be able to develop a thoroughfare through. That's something that we're going to look for, so I'd appreciate if you'd do that. The original Gemtone Center No. 4 included the entire Pine Street right-of-way and this one has excluded it. The only things I can see that have changed is they had the same number of lots although they have included a little sliver of a lot along the west boundary and along the southern boundary, and the note says that is for landscape and drainage. I would like to have the applicant's representative present to explain§their reason for not including Pine Avenue, and if they propose this plat as revised, I would recommend it be denied due to the fact that they are not dedicating that additional right-of-way for Pine. Furthermore, we recommend that all of the proposed stormwater disposal seepage pits be excavated into the native, clean sand or gravel that was observed at each of the three test pit locations at a depth that ranged from 4.5 to 8.5 feet below the existing ground surface. For your convenience, we have also indicated the depth to the top of the clean sand or gravel at each test pit location on the attached site plan.
