Meadow Lake Village Memory Care Facility1~L CERTIFICATE OF ZONING COMPLIANCE REPORT DATE: October 31, 2011 E IDIAN~-- TO: Meadow Lake Village Retirement Resort, LLC I D A H O FROM: Bill Parsons, Associate City Planner SUBJECT: Meadow Lake Village Memory Care Facility -CZC-11-047, DES-11-021, ALT-11-009 OWNER: Meadow Lake Village Retirement Resort, LLC DESCRIPTION OF APPLICANT'S REQUEST The applicant, Meadow Lake Village Retirement Resort, LLC, requests certificate of zoning compliance (CZC) and design review (DES) approval to construct a new 29,920 square foot nursing care facility consisting of 48 beds/units located at 590 S. Arbor Lane. Alternative Compliance (ALT) is also proposed in regard to the fencing requirements contained in UDC 11-3A-7C. The site consists of 13 acres and is zoned L-O. The use and site design was approved through a planned development (CUP-04-014). DECISION The applicant's request for CZC, DES and ALT is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verb if you need a building permit and/or inspection. If you do need a building permit, you must complete that process before you commence the use or construction. As part of the application submittal, you will need to provide two sets of the final, stamped "approved" Planning Department plans. You must provide these plans in PDFformat and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your building submittal set. Please contact Building Services for additional details about building permits and inspections. Process Conditions of Approval 1. Per UDC 11-SB-SB2, the Director (at the applicant's request) approved alternative compliance to UDC 11-3A-7C in regard to the fencing requirements (see Analysis section below for more information). 2. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 3. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-SC-3C. 4. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-3B-14A. 5. The site plan prepared by LRS Architects dated 10/17/11, labeled AlO1X is approved (stamped "approved" on 10/31/11 by the City of Meridian Planning Department) with no changes. 6. The landscape plan prepared by LRS Architects., dated 10/17/11, labeled L1.0 is approved (stamped "approved" on 10/31/11 by the City of Meridian Planning Department) with no changes. Conditions Document Memory Care Facility CZC, DES & ALT 7. The building elevations prepared by LRS Architects, dated 10/17/11, labeled A401X and A402X are approved (stamped "approved" on 10/31/11 by the City of Meridian Planning Department) with no changes. 8. The approved site plan, landscape plan and building elevations shall not be altered without prior written approval of the City of Meridian Planning Department. 9. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 10. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 11. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (CPA-99-004, AZ-99-021, DA #101048096, CUP-99-039 and CUP-04- 014). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A- 3. 7. The applicant shall have an ongoing obligation to comply with any applicable specific use standards for a nursing care facility as set forth in UDC 11-4-3-29. ANALYSIS OF UDC REQUIREMENTS RELATED TO THE ALTERNATIVE COMPLANCE The applicant has submitted a request for alternative compliance pertaining to the fencing requirements as follows: The applicant requests approval of alternative compliance to fencing requirements contained in UDC 11-3A- 7C which requires a maximum 6-foot high fence in the L-O zoning district. The applicant is proposing a 7- foothigh vinyl fence with 8-foot high decorative stone pilasters to complement the design of the proposed building. It is the applicant's desire to incorporate the three (3) proposed courtyards as part of the building design and provide the added security for the future residents rather than provide standard fencing. Staff is of the opinion that the three (3) courtyards as proposed by the applicant provide more of a focal point along the street then standard fencing material and demonstrates a more cohesive design in accord with the guidelines contained in the Design Manual. Staff approves the request in accord with UDC 11-SB-SB.2f. Conditions Document 2 Memory Care Facility CZC, DES & ALT ALTERNATIVE COMPLIANCE FINDINGS: In order to grant approval for alternative compliance, the director shall determine the following findings: 1. Strict adherence or application of the requirements is not feasible; OR The application of the requirements is not feasible due to the applicant's concern for the safety and welling being of the future residents. A taller fence will provide the necessary security for the future residents and contributes to a more cohesive design. Further, fencing is required as part of the specific use standards for nursing care facilities. 2. The alternative compliance provides an equal or superior means for meeting the requirements; and The Director finds the applicant's proposal to construct a 7-foot high vinyl fence and decorative stone pilasters provides a superior means for meeting the fencing requirements in the UDC. The courtyard design provides more of a cohesive design than standard fencing as contemplated by the Design Manual. 3. The alternative means will not be materially detrimental to the public welfare or impair the intended uses and character of the surrounding properties. Staff finds that the proposed alternative will not be detrimental to the public welfare or impair the use/character of the surrounding properties since the planned courtyards are necessary for the continuing care of the future residents. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before 11/14/2011, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. The administrative design review shall be exercised with the approval period of the underlying permit (CZC) or the approval shall expire. The one-story Memory Care facility will contain three neighborhoods with 16 residents each for a total of 48 residents. Each neighborhood will be connected to its own exterior courtyard containing benches, landscaping and a walking path. The Memory Care facility is complying with the setbacks as outlined in CUP-04-014. This facility is adhering to the minimum setback of 5' from the Property Boundary as it is shown in its approximate location on the Site Plan A101X dated 10.28.2011. The parking ratios for the overall site remain as outlined in CUP-04-014. There are currently 107 parking spaces located on the current site. Urban /Suburban Design Guidelines 1.1 COHERENT PLAN A master plan has been developed for this large-scale, phased project and demonstrates the establishment of an appropriate context and cohesiveness of individual project components. Three buildings have been built with plans for 3 more. The Targhee Lodge Homes and Memory Care buildings are to be completed by the end of 2012. Elkhorn Lodge will be the last remaining phase to be built. 1.2 ACCESS and CONNECTIVITY The site and building layout have addressed vehicle access, pedestrian connectivity, building orientations, parking and public spaces with majority of buildings oriented in the north south direction with a circular `ring' road enclosing the site with all buildings within the 'ring' road. Pedestrian sidewalks provide connections between all buildings, present and future. The main complex entry is on the north side of property with public parking and adjacent green spaces. Outside the ring road, to the north, is the complex's small golf course with associated water feature and club house. 1.3 ORIENTATION and LAYOUT Site ingress/egress is from the north off Franklin Blvd. The ring road creates an internal circulation pattern. Building entries are all clearly defined with connections to pedestrian walkways, roadways and parking areas. The Memory Care facilities main entry is on the west side of the community directly off of the ring road. 1.4 PARKING The design and layout of internal site parking is made up of shorter broken up parking bays. The use of trees, landscaping and architectural elements (benches, gazebos, water features) provide shade and create pedestrian interest while adding. aesthetic qualities to the parking areas. LRS ARCHITECTS Consistent use of materials and colors on each facade are used on all buildings and that contributes to a cohesive and appealing design. Wood, concrete, stone and metal materials are used in consistent, repeating patterns from building to building. At the Memory Care facility, the fences enclosing the exterior courtyards incorporate elements from the building facade in order to convey a unified sense of design and match the character of the building. 3.0 Site Plan and Building Layout a. Per this section, "the maximum fence height shall not exceed 6 feet." For the safety of the residents of the Memory Care facility we would like to request a modification of the code in order to allow a maximum fence height of 7 feet. The exterior courtyards provided at the Memory Care facility are an important part of care for the residents. In addition to allowing the residents basic access to the outdoors, the courtyards also allow areas for exercise, social activities and quiet, self reflection all in a controlled environment. Unfortunately it is a necessary part of these residents care that they live in a monitored environment for their own safety. In order to continue to allow access to the outdoors and to provide a secure setting, it is necessary to provide a taller fence height than is commonly used at residential areas in order to ensure the safety of these residents. As these fences are on the front of the building adjacent to the two main entrances, we do want them to be seen as an extension of the facility. And in order to prevent the fences from appearing as an imposing mass right at the entrance, the height of the fence steps down to a more pedestrian scale through materials. The corner posts are 8 feet tall with a manufactured stone veneer and cap that matches the manufactured stone veneer and sill used on the building. The fence itself is 7 feet tall overall with an approximate 6 foot solid panel and a foot of lattice on top. This fence is vinyl and the color and texture will match the colors used on the building.
