Amity and Meridian Project
Development Agreement Modification
Hawkins Companies
September 7, 2011
Hawkins Companies is currently entitling approximately seventy (70) acres of land that is
adjacent to Meridian Road, between Harris Street and Amity Road. When Hawkins
Companies gained control of this property, it was being entitled for residential
development (approximately forty (40) acres); and the remainder had been identified as
"Mixed Use" by the city of Meridian Comprehensive Plan. Our entitlement process
started with changing the Comprehensive Plan to increase the "Mixed Use" provisions
for the property; followed by a Rezone and Annexation process to bring the property
within the city of Meridian; and finally to identify appropriate access to the site. At this
time, we are seeking to modify the existing Development Agreement for the term of two
(2) years so that we can finalize access to the property with Idaho Transportation
Department and the City of Meridian.
Comprehensive Plan Amendment
On September 23, 2008, the Meridian City Council approved the Comprehensive Plan
Map Amendment to change a portion of the site (approximately 40 acres) from Medium
Density Residential to Mixed Use Regional so that now all seventy (70) acres carry the
Mixed Use-Regional (MU-R) designation. The resolution finalizing this process was
adopted by the City Council on October 7, 2008. This Comprehensive Plan amendment
will allow Limited Office (L-O); General Commercial (C-G), Community Commercial
(CC); and Residential (R-15) uses on the property.
Rezone
Following completion of the Comprehensive Plan Map Amendment process, Hawkins
Companies submitted a detailed Rezone application that specifically detailed the
proposed development of the property. That plan identified: 7.48 acres being utilized for
Medium-High Density Residential; 1.69 acres used for Limited Office; 30.46 acres
developed to support Community Commercial uses; and the remainder, 33.47 acres,
utilized for General Commercial. After several iterations of the site plan, Hawkins
Companies has gained a recommendation of approval from the Planning and Zoning
Commission, and Planning Staff has recommended approval of the rezone application in
the October 16, 2008 staff report to City Council.
Annexation
The application submitted to the city of Meridian also contained a request to annex the
entire project property into the corporate boundaries of Meridian. This request ensured
that all necessary provisions of public services would be available to the property. The
city of Meridian plans to provide municipal services to the lands proposed to be annexed
in the following manner:
• Sanitary sewer and water service will be extended to the project at the developer's
expense.
• •
• The subject lands currently lie within the jurisdiction of the Meridian Rural Fire
District. Once annexed the lands will be under the jurisdiction of the Meridian
City Fire Department, who currently share resource and personnel with the
Meridian Rural Fire Department.
• The subject lands currently lie within the jurisdiction of the Ada County Sheriff's
Office. Once annexed the lands will be serviced by the Meridian Police
Department (MPD).
• The roadways adjacent to the subject lands are currently owned and maintained
by the Ada County Highway District (ACHD). This service will not change.
• The subject lands are currently serviced by the Meridian School District No. 2.
This service will not change.
• The subject lands are currently serviced by the Meridian Library District. This
service will not change and the Meridian Library District should suffer no revenue
loss as a result of the subject annexation.
Municipal, fee-supported, services will be provided by the Meridian Building
Department, the Meridian Public Works Department, the Meridian Water Department,
the Meridian Wastewater Department, the Meridian Planning Department, the Meridian
Utility Billing Services, and Sanitary Services Company.
Hawkins Companies has gained a recommendation of approval from the Planning and
Zoning Commission, and the support of Planning Staff regarding the proposed
annexation of the property, as evidenced in the October 16, 2008 staff report to City
Council.
Access
While the roadways adjacent to the property are owned and maintained by Ada County
Highway Department (ACRD), the Idaho Transportation Department has review
authority for Meridian Road, which is State Highway 69. The Hawkins Companies
development proposal depicts three (3) access points to the project from Meridian Road;
one right-in/right-out/left-in access driveway and two right-in/right-out driveways. When
Meridian Road was previously expanded and improved, a portion of the compensation to
the land owners was a deeded access to Meridian Road. Our project has seven (7) deeded
access points to Meridian Road, and we propose to utilize three (3), and rescind the
provisions and authorizations to the remaining four (4).
The Idaho Transportation Department (TTD) is currently in a review process of our
proposed access application, and subsequent challenge.
