Bill Parsons:
The United States' Carlson and Tumbler Laterals lie within the boundary of the above-
mentioned location. The easement for these .laterals is held in the name of the United
States through tlae Bureau of Reclamation uztdex the authority of the ,A,et off' August 30,
1890. (26 5tat. 391; 43 U.S.C_ 945)
The Boise Project Board of Control is contracted to operate and, maintain these laterals.
We assert a. federal. easement 22' north and 20' south of. the Carlson Lateral centerliune
and we assert a federal easement l8' west and 18' east feet East of the Tumbler Lateral
centerline. Whereas this area is for the operation and maintenance of our facility, no
activity should hinder our ability to do so.
Fencing (as may be required) must be constructed just off of Boise Project facilities, to
insure public safety and prevent encroachments.
Wording on the preliminary and final recorded plat needs to be noted that this
development must adher. a to Idaho Statutes, Title 42-1209.
Whereas, these easements are for the operation and maintenance of our facility, no
activity should hinder our ability to d.o so. The Boise Project does not approve

of, maintenance.

Project facilities and/or easements that parallel, and are within and/or intended to be
within road right-of--ways due to any development of this property must be relocated
outside of road right-of--ways. The easements of Boise Project facilities will rcmai.n the
sam..e unless agreed upon and/or approved with written pcrmi.ssion from Boise Project
Board of Cozttrol..
Crossing agreements must be secured and signed by all parties prior to March lsc o£ each
year. e~, ti.rne schedule for the construction to be done during the non-irrigation season
must be approved by Boise Project prior to any activity within Project easements. No
construction will be allowed within the easement boundaries of the Boise Project Boazd
of Control facilities after March 15`" of each year. However, on a case by case basis,
overhead utilities and utilities boring underneath a Project facility may be allowed after
Nfarch 15~' if reviewed and approved by the Boise Project.
Sturm Drainage and/or Street Runoff must be retained on site.
Laval i,.mgationldrainage ditches that cross tl~,is property, iz~ order to serve neighboring
properties, must remain un,obstructcd and protected by an appropriate easement_
Boise Project Board of Control requests an irrigation and drainage plan for review.

Nampa & Meridian Irrigation District has no comment on the above-referenced application as
this project lies outside our district boundaries. Please contact Bob Carter, Boise Project -
Board of Control, at 344-1141 or 2465 Overland Rd., Room 202, Boise, Idaho 83705-3173.
All laterals and waste ways must be protected. All municipal surface drainage must be
retained on-site. If any surface drainage leaves the site, Nampa & Meridian Irrigation District
must review drainage plans. The Developer must comply with Idaho Code 31-3805.
