DESCRII'TION OF APPLICANT'S REQUEST
The applicant, Discount Tire, requests certificate of zoning compliance (CZC) and design review (DES)
approval to construct a new 6,947 square foot Discount Tire Center.
The site consists of 1 acre of land and is currently zoned C-G. The proposed use is classified in the
Unified Development Code (UDC) as vehicle repair, minor, which is a principal permitted use in the C-G
zoning district.
The site is located at 2821 N. Eagle Road.
DECISION
The applicant's request for CZC and DES is approved with the conditions listed in this report.
Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verb if you
need a building permit and/or inspection. If you do need a building permit, you must complete that
process before you commence the use or construction. As part ojlhe application submittal, you will
need to provide two sets of the final, stamped "approved" Planning Department plans. You must
provide these plans in PDF format and hardcopy as specified in the Building Services "Plan Intake
Checklist" and include them with your building submittal set. Please contact Building Services for
additional details about building permits and inspections.
Process Conditions of Approval
1. No signs are approved with this application. Prior to installing any signs on the property, the
applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3
Article D and receive approval for such signs.
2. The applicant shall complete all improvements related to public life, safety, and health as set forth
in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with
UDC 11-SC-3C.
3. Upon installation of the landscaping and prior to inspection by Planning Department staff, the
applicant shall provide a written certificate of completion as set forth in UDC 11-3B-14A.
4. The site plan prepared by Erikson Civil, dated 09/28/11, labeled C 1.0 is approved (stamped
"approved" on 09/30/11 by the City of Meridian Planning Department) with no changes.
5. The landscape plan prepared by South Landscape Architecture, dated 09/19/11, labeled L1.0 is
approved (stamped "approved" on 09/30/11 by the City of Meridian Planning Department) with
the following comment:

6. The building elevations prepared by Bergman Architecture, dated 09/29/11, labeled ALT-IE.L is
approved (stamped "approved" on 09/30/11 by the City of Meridian Planning Department) with
no changes.
7. The approved site plan, landscape plan and/or building elevations shall not be altered without
prior written approval of the City of Meridian Planning Department.
8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit.
9. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant
shall submit a new site plan to the City of Meridian Planning Department for approval prior to
issuance of the building permit.
10. The applicant shall complete all required improvements prior to issuance of a Certificate of
Occupancy. It is unlawful to use or occupy any building or structure until the Building Official
has issued a Certificate of Occupancy.
11. Prior to the issuance of certificate of occupancy for the building, the property boundary
adjustment tentatively approved with file #PBA-11-006 must be completed (recorded) in accord
with UDC 11-6B-8C.
Ongoing Conditions of Approval
1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets
the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth
in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14.
2. The project is subject to all current City of Meridian ordinances and previous conditions of
approval associated with this site (RZ-OS-019, AZ-OS-057, CUP-OS-052, PP-OS-059, VAR-06-
018, FP-07-012, and Development Agreement instrument #104107406 and #107044347 and
PBA-11-006).
3. The issuance of this CZC does not release the applicant from any previous requirements of the
other permits issued for the site.
4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a
minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the
area.
5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set
forth in UDC 11-3A-11.
6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping
and constructed features within the clear vision triangle consistent with the standards in UDC 11-
3A-3.
7. The applicant and/or assigns shall have the continuing obligation to meet the specific use
standards for the proposed use as set forth in UDC 11-4-3-37.
ANALYSIS OF UDC REQUIREMENTS RELATED TO SITE SPECIFIC CONDITIONS:
Earlier this year, the Planning Department issued a tentative approval of a property boundary adjustment
(PBA-11-006) that reconfigured the lot for the proposed discount tire site. The UDC allows up to a year
to record the record of survey and comply with PBA requirements outlined in UDC-11-6B-8C. Certificate
of Occupancy for the building is predicated on the owner complying with the City's PBA requirements.

CITY COUNCIL REVIEW
The applicant or a party of record may request City Council review of a decision of the Director. All
requests for review shall be filed in writing with the Planning Department on or before October 15, 2011,
within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-
SA-6B.
If City Council review of the decision is not requested, the action of the Director represents a final
decision on a land use application. You have the right to request a regulatory taking analysis under Idaho
Code 67-8003.
EXPIRATION
Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure
shall expire if said construction or alteration has not commenced within one year of the date of issuance
of the Certificate of Zoning Compliance.
The administrative design review shall be exercised with the approval period of the underlying permit
(CZC) or the approval shall expire.
In accord with the above provisions, the subject Certificate of Zoning Compliance and Design
Review is valid until September 30, 2012.

Please find the enclosed application requesting approval for the Discount Tire Certificate of Zoning Compliance.
The application and site plan were prepared in accordance with previous City of Meridian approvals for AZ-05-057,
PP-05-059, RZ-05-019, PS-05-002 and CUP-05-052 as referenced within the Development Agreement for the
property that is recorded as instrument # ,107044347, Ada County Records.
The Discount Tire project includes construction of a 6,947 sq. ft. tire sales and service store on a 1.00 acre parcel
within the Bienville Square Subdivision. Site improvements will be constructed as shown on the attached CZC site
and landscape plans and will include a pavement parking lot; concrete sidewalk, curb & gutter; a screened trash
enclosure; planter landscaping, landscape buffers and pressure irrigation sprinkler system;; site utilities; and
drainage improvements. An existing a 10-foot wide asphalt multi-use pathway exists along the site Eagle Road
frontage that will be retained and protected.
The current Comprehensive Land Use designation for the property is "Commercial" and the property currently has
a C-G zoning designation, which principally permits the Tire Store use; and the project proposal in consistent with
the approved CUP for the subdivision.

The proposed Dtscaunt Ttre project is located in tf~e Benville Square
subdivision just south of the existing multi-tenant retail building. Access to the
site is via existing rn$in drive off N. Eagle Road :and thru the privy#~ drive {N.
Cajun Ln.) to the west with a proposed driveway cutting into the adjacent parcel.
An interior drive aisle to the north parcel axis#s which serves as a common
access between parcels.
The parcel is designed to provide connectivity of the parking. lot to the
north parcel, minimize impact to the exiting utility infrastructure and use existing
sidewalk for pedestrian access between huildirtgs. Proposed building issituated
on the south end of the parcel with the parking stalls provided on the north and
west of the parcel. There are 36 parking stalls provided complying with the. City's
min. requirements of which 2 are handicap parking stalls that are located close to
the #acility's main entry. An open- public space is provided next to the handicap
parking stabs connecting to the<facility's main entry and street .sidewalk. The site
drainage is designed for a storm water filtration system at 3 locations. Trash
enclosure far waste .and recyclables is iocated on the west end of the building
keeping it from' public view. Aland/oil interceptor wil( be installed to filter vUaste
particles coming from the Service Bays drain line before wastewater gets
transmitted to the public's sewer main.
The proposed building is oriented with the building facade ~Showroam
Areal facing N. Eagle Road and the service bays #acing the parking lot. The
building fa+~ade is provided with a comer entry tower element with parapet at 28
ft. high. This tar~rer el+emient is designed with banner red storefronUglazing and
entry door w/burgundy metal awning above storefront along with .building
signage. The storefront system. provided for this facility is a 1"insulating law-e
glazing system: keeping outside temperature to penetrate inside. The service
area which fiaces the parking lot is provided wloverhead steel sectional doors in
worsted tan color complimenting the: overall. color scheme. The building materials
used far the design are split face cmu in red brown, tan, and peach light colors
with an accent. band of burnished .emu, steel canopies in vrrorsted tan, standing
seam metal awning. in burgundy color and EIFS parapet cornice in worsted'tan.

Mindy - I'm working with Discount Tire to help them with due diligence on a site that they are considering at the
southwest corner of the intersection of Ustick Road and Eagle Road in Meridian within the Bienville Square Subdivision
and have a few questions for you.
1. Impact Fees - I wanted to confirm the category that they would fall under. I see "Tire Store" is listed and
that seems to be the obvious fit. Is that the category that Les Schwab and Commercial Tire fall Wnder? All of
these users sell and service tires as well so I wanted to be sure that there wasn't some overlap ihto the
Automobile Care Center category.
2. Traffic Study -The site is located two lots south of the Eagle Road Access and fronts Eagle Road. Will a
traffic study be required?
